EAGLE CITY COUNCIL MEETING
May 28, 1991
The Eagle City Council met in regular session on May 28,
1991. Mayor GUERBER presiding,
The following members were present: STEVE HAMMONS,
YZAGUIRRE, TOM MINOW. Absent: GARY WALKER
RICK
Moved by MINOW and seconded by YZAGUIRRE to approve the minutes
of the May 21, 1991 meeting as presented. ALL AYE: MOTION
CARRIED.
UNFINISHED BUSINESS: Boise-Ada Trash license. Moved by
YZAGUIRRE and seconded by MINOW to approve the application for
renewal of the trash license for Boise-Ada to serve Eagle from
May 1991-May 1992. ALL AYE: MOTION CARRIED.
PRIME EARTH: Stan McHutchinson will have the names and addresses
by the first of the week, so that the notice of publication can
be sent to Valley News on June 7, for a July 1, public hearing
before Planning and Zoning and a July 25 public hearing before
Council, Mona Mack will advice Prime Earth of the hearings,
RANDALL ACRES: The City Clerk reported that we are tracking on
the mobile homes in Randall Acres to make sure that all the
mobile homes are in compliance and/or those in violation.
KATHY ROBERTS HOME: (Green house on State and First St,) The
building inspector will need to talk to the attorney on action to
be taken regarding safety and hazardous conditions,
FINDINGS OF FACTS AND CONCLUSIONS OF LAW/TOWNE REZONE: Moved by
MINOW seconded by YZAGUIRRE to adopt the findings as submitted.
ALL AYE; MOTION CARRIED.
ORDINANCES
Moved by HAMMONS and seconded by YZAGUIRRE to dispense with the
three day ruling and to consider Ordinance 187 at this time.
ALL AYE: MOTION CARRIED,
Moved by HAMMONS and seconded by YZAGUIRRE to adopt Ordinance 187
the Towne Rezone, changing the zoning classification from (A)
Agricultural to (C2) Commercial. ALL AYE: MOTION CARRIED.
APPOINTMENTS: Mayor GUERBER presented the appointment of Sandra
Shellnut as Recreation Director for the City of Eagle for the
summer 1991 season and asked for Council consideration, Moved by
HAMMONS and seconded by MINOW that approval be given to the
appointment of Sandra Shellnut as Recreation Director for the

ALL AYE:
MOTION CARRIED.
EMPIRE ESTATES: J.J. Howard, Engineer for the project submitted
a written request for extension of time on approval of the final
plat of 6 months. Moved by YZAGUIRRE and seconded by MINOW to
approve the requested 6 months extension of time as requested.
ALL AYE: MOTION CARRIED.
NEW BUSINESS:
Audit contract reviewed by Council for the FY 1991-1992, with
Gibbons, Scott and Dean CPA. Moved by MINOW and seconded by
YZAGUIRRE to award the contract to the firm, as they have been
the auditors for the City of Eagle for some years now and have
represented the City well. ALL AYE: MOTION CARRIED.
OK PARK: Discussion regarding the hillside portion of the
property and the fact that the park was developed with grant
funds makes selling that portion of the property impossible
without a conversion. Conversion means that the City would have
to substitute that property for other property currently being
purchased in its place. The City Attorney, Mona Mack, was
instructed to draw up a 50 year lease for the (3) three property
owners located above the hill.
MAYOR'S REPORT: The Eagle Chamber of Commerce is sponsoring a
clean up day this coming Saturday, June 1. Once again, the Mayor
asked for written comments regarding the bypass (Eagle
Alternative Route) and announced that the issue will be placed on
the agenda of June 11, 1991 for Council consideration. The Mayor
has written ACHD regarding an extension of Palmetto to connect
to State Street. He also advised the Council that the seniors
will be bringing in a new proposal for a fee schedule for the
center, Eagle Fun Days are almost here, Butch Otter will make
the presentation of the Eagle provided by Centennial funds at
that time.
COMMITTEE REPORTS: MINOW: Reported on the availability of grants
for swimming pools and parks and APA, YZAGUIRRE: Reported that
Horizons Task Force will have a proposal by July 1, and that the
Boise River Ordinance is being reviewed for Eagle. He also
reported on the progress of the greenbelt.
Moved by MINOW and seconded by HAMMONS to add another item to the
agenda. A Resolution regarding designation for emergency
response in the Eagle area. ALL AYE: MOTION CARRIED,
Moved by MINOW and seconded by YZAGUIRRE to approve Resolution
11-91, designating the Eagle Fire District for emergency
response. ALL AYE: MOTION CARRIED.
CLAIMS AGAINST THE CITY: Moved by YZAGUIRRE and seconded by MINOW
to approve the claims as presented. ALL AYE: MOTION CARRIED.
There being no further business the meeting adjourned at 8:45
