PRE COUNCIL MEETING
APRIL 9, 1991
RAY DOWDY: Informal request for direction regarding a garage
addition to a house in a commercial district. Council suggested
he apply for a conditional use but wanted him to understand that
if the CUP were granted it would be conditioned on a discontinued
use as a residence upon sale of the property.
DESIGN REVIEW: Discussion regarding repealing the section of the
code implementing a Design Review Committee resulted in a
proposal to submit an ordinance repealing that section and
establishing the City Clerk and Building Inspector as control for
design review for the City; however the City Clerk has the option
that if she recommends decision of the Council it becomes a
Council decision, or if the applicant requests an appeal of a
decision it goes to Council. The City Clerk will initiate the
necessary Ordinance for the next meeting.
ISLAND WOODS: Dennis Baker reported on the progress of the
proposed subdivision and asked for consideration of a continuance
to the public hearing scheduled for regular Council meeting
tonight.
EAGLE CITY COUNCIL MEETING

The Eagle City Council met in regular session on April 9, 1991.

The following members were present:

Moved by MINOW and seconded by YZAGUIRRE to approve the minutes
of the April 9, 1991 meeting as presented. ALL AYE: MOTION
CARRIED.
STEVE HAMMONS, GARY
PUBLIC HEARING/Island Woods Subdivision:
Mayor GUERBER announced that this was the time and place set for
a public hearing on Island Woods Subdivision.
Moved by MINOW and seconded by WALKER to continue the public
hearing regarding Island Wood Subdivision at the request of the
owner/developer Dennis Baker until May 14, 1991, to be heard by
Council at that time. ALL AYE: MOTION CARRIED.
ORDINANCES-RESOLUTIONS:
Moved by YZAGUIRRE and seconded by HAMMONS to dispense with the
three day ruling and to consider Ordinance 184 at this time. ALL
AYE: MOTION CARRIED.
Moved by YZAGUIRRE and seconded by HAMMONS to adopt Ordinance
184, an Ordinance changing the zoning classification of the real
property described herein from the C3 Commercial Classification
to R5 Residential Classification and amending the zoning map of
the City of Eagle to reflect said change. ALL AYE: MOTION
CARRIED.
NEW BUSINESS:
Ada County Transmittals:
Moved by WALKER and seconded by MINOW to approve Ada County
Transmittal 91-09-TLQ CUBER with the condition that the sole
occupancy is limited to the use of relatives as indicated in the
application but is removed once it is no longer needed for said
relatives. ALL AYE: MOTION CARRIED.

Moved by YZAGUIRRE and seconded by WALKER to approve Ada County
Transmittal 9l-13-PR JONES for a private road to a 10 acre
parcel. ALL AYE: MOTION CARRIED.
Ada County Transmittal 9l-17-PDR GOLD RIDGE ESTATES (NORTH EAGLE
51). Presentation by Bob Parsons, developer and Dave Roylance,
Engineer, indicated that they can provide a bike path up Eagle
Road and some portions of Beacon Light Road as requested by
Planning and Zoning. The total gross density is 48 acres, the
net is 26 lots based on 5 acres net. Moved by MINOW and seconded
by YZAGUIRRE to approve this transmittal with conditions: (1) an
easement be provided for a bike path be established along Eagle
Road, the canal, and portions of Beacon Light Road, and (2) a
rural road approach be allowed in the subdivision. AYE: MINOW,
YZAGUIRRE, HAMMONS. NAY: WALKER. MOTION CARRIED.
Moved by HAMMONS and seconded by WALKER to deny Ada County
Transmittal 91-08-ZC QUINNEY for a rezone from RT to Rl, to split
a 5 acre parcel to 3 and 2 acres. AYE: HAMMONS, WALKER. NAY:
YZAGUIRRE, MINOW. MAYOR: AYE. MOTION CARRIED TO DENY THE
APPLICATION. Basis of denial: Additional development is not
desirable at this time in an existing, platted subdivision.
Moved by WALKER and seconded by HAMMONS to approve Ada County
Transmittal 9l-12-TLQ CHASE for temporary living quarters for
replacement of a mobile home for a relative. AYE: WALKER,
HAMMONS. NAY: MINOW, YZAGUIRRE. MAYOR: AYE: MOTION CARRIED
TO APPROVE THE TRANSMITTAL.
ADA COUNTY AMENDMENT FOR THE BOISE IMPACT AREA: Moved by MINOW
and seconded by YZAGUIRRE to approve the amendment as presented.
ALL AYE: MOTION CARRIED.
ADA COUNTY AMENDMENT FOR RESIDENTIAL CARE FACILITIES- 90-03-Z0A:
Moved by YZAGUIRRE and seconded by WALKER to approve the
amendment as presented. ALL AYE.: MOTION CARRIED.
2010 TRANSPORTATION PLAN AND FUNCTIONAL STREET CLASSIFICATION
MAP, an APA request for approval. Moved by HAMMONS and seconded
by MINOW to approve the plan as presented, but to have the inside
cover of the plan updated to read the correct Committee Members
from Eagle. The plan now reads HAMMONS and should read MINOW.
ALL AYE: MOTION CARRIED.
UNFINISHED BUSINESS:
Findings of Fact and Conclusions of Law/Trail Creek Ranch
Subdivision. Moved by MINOW and seconded by YZAGUIRRE to approve
the findings and conclusions as presented. ALL AYE: MOTION
CARRIED.
MAYOR'S REPORT/ATTORNEY'S REPORT: Mona Mack reported that
Carlyle Briggs, B&A Engineering was contacted regarding lack of
notice to property owners on the Highway 55 annexations in 1990,
due to the complaint from property owners regarding Prime Earth
Gravel Co. He requested that he be allowed additional time to
review the situation. He acknowledges that there may have been a
failure to notify. Mona advised Mr. Briggs that he would need to
appear before Council at the next Council meeting, preferably
with a written report.
ADA COUNTY SHERIFF REPORT: The patroling district for Eagle has
been changed due to the annexed areas, but the reports have not
reflecting this in the past. The problem has been corrected and
reports will reflect the entire City limits from now on. Harvey
and Edgewood has been heavily patrolled this last month at the
request of Council. He inquired about a contract between the
City and Sheriff's Dept. YZAGUIRRE reported that the budget
constraints will not permit a contract at this time.
COMMITTEE REPORTS:
PARKS: Bids have been received from Troutman Lawn, one for full
maintenance of the parks, the other for lawn care only. Both
bids were given on an hourly basis. Moved by WALKER and seconded
by MINOW to begin the maintenance on the parks now, but request a
total cost estimate for the summer care in order to make a
decision at the next meeting. Troutman should be advised of the
budgeted amount of funds for parks. MOTION CARRIED.
SENIORS:
Council.
They are having a Saturday breakfast and have invited

DOWN TOWN REDEVELOPMENT: The sub committee has come to some
decisions regarding the area and will present it to the
Committee. They hope to meet the May 20, 1991 grant deadline.
The application will probably be $500,000. we may need a LID to
finish the project.
SEWER: Annexed Circle D.J. Ranch and Island Wood Subdivision
last night.
LIBRARY: They will be submitting a proposal for a board member
to replace Kelli Blair, Kelli resigned. Maintenance (janitorial
duties) was brought up in the board meeting. Mike Covalt
indicated that the City should pay it. We need to check with
Lynn Milton regarding the problem. The revenue statement will be
provided to the City.
HORIZONS: Will have a decision for the next Council meeting
regarding the McEnroe Comprehensive Plan amendment.
CENTENNIAL: The Eagle is 99% completed, they will have it ready
in time for Eagle Fun Days on June 8. There is $290. left in the
Centennial account. HAMMONS would like some direction as to
where to dedicate the funds, there have been some suggestions
but no decisions. The Council agreed to dedicate the funds for a
City seal for the wall behind the Council Chambers,
