Minutes - 1991 - City Council - 03/26/1991 - Regular EAGLE CITY COUNCIL MEETING MARCH 26, 1991 The Eagle City Council met in regular session on March 26, 1991. Mayor GUERBER presiding. The following members were present: GARY WALKER, RICK YZAGUIRRE, TOM MINOW. Absent: STEVE HAMMONS Moved by YZAGUIRRE and seconded by MINOW to approve the minutes of the March 9, 1991 meeting as presented. ALL AYE: MOTION CARRIED. PUBLIC HEARING/Private Roads in the Eagle Impact Area Mayor GUERBER announced that this was the time and place set for a public hearing on adopting the Ada County Development standards for private roads in the Eagle Impact Area. Public Testimony: none Public hearing closed at 7:35 p.m. Moved by MINOW and seconded by YZAGUIRRE to adopt the Ada County Standards for private roads in the impact area as submitted. ALL AYE: MOTION CARRIED. PUBLIC HEARING/Trail Creek Ranch Subdivision Mayor GUERBER announced that it was the time and the place for a public hearing for a preliminary plat for Trail Creek Ranch Subdivision and rezone of a portion of the C3 to R5. Applicant: Location: Proposal: portion of Testimony: Treasure Valley Village, LTD NW corner of Highway 55 and Floating Feather Rd 50 lot subdivision on 19.71 acres, zoned R5 and a the C3 area to R5. In favor Phil Barber Todd Shaffer Bill Guhrke opposition none Public hearing closed at 8:05 p.m. Moved by MINOW and seconded by WALKER to approve the preliminary plat for Trail Creek Subdivision with the following conditions: 1. 2. zoning change on that portion of the property from C3 to R5 that the water, sewer and greenbelt requirements be met COX: Vacation of easement: Moved by MINOW and seconded by YZAGUIRRE to deny the request for vacation and to notify the applicant on procedures and guidelines for public hearing notice. ALL AYE: MOTION CARRIED. Ada County Transmittal 91-09-ZC Scrivner: Moved by MINOW and seconded by YZAGUIRRE to approve the transmittal as submitted. ALL AYE: MOTION CARRIED. Ada County Transmittal 91-13-PDC/91-07-ZCl Musick: Moved by MINOW and seconded by YZAGUIRRE to approve the transmittal as submitted. ALL AYE: MOTION CARRIED. FINDINGS OF FACT AND CONCLUSIONS OF LAW/Floating Feather Hills: Moved by MINOW and seconded by WALKER to approve the findings as submitted. ALL AYE: MOTION CARRIED. FINDINGS OF FACT AND CONCLUSIONS OF LAW/Avante Annexation/zoning: Moved by MINOW and seconded by YZAGUIRRE to approve the findings as presented. ALL AYE: MOTION CARRIED. ORDINANCES-RESOLUTIONS: Moved by MINOW and seconded by YZAGUIRRE to dispense with the three day ruling and to consider Ordinance 179 at this time. ALL AYE: MOTION CARRIED. Moved by MINOW and seconded by WALKER to adopt Ordinance 179 an ordinance adopting the Ada County Development Standards for private roads in the Eagle Impact Area. ALL AYE: MOTION CARRIED. Moved by MINOW and seconded by WALKER to dispense with the three day ruling and to consider Ordinance 182 at this time. ALL AYE: MOTION CARRIED. Moved by MINOW and seconded by WALKER to adopt Ordinance 182 an ordinance rezoning the Floating Feather Hills Development from an Agricultural classification to the R5 Residential classification. ALL AYE: MOTION CARRIED. Moved by YZAGUIRRE and seconded by MINOW to dispense with the three day ruling and to consider Ordinance 183 at this time. ALL AYE: MOTION CARRIED. Moved by YZAGUIRRE and seconded by MINOW to adopt Ordinance 183 an ordinance annexing the property known as "Avante" and zoning said property R4 Residential classification. ALL AYE: MOTION CARRIED. ATTORNEY'S REPORT: Barking dogs: can proceed under the nuisance ordinance but would need a complaint against the property owner, It would be advisable to create an ordinance dealing directly with the issue of "barking dogs", the City of Boise has such an ordinance that the City of Eagle may want to adopt. The Code regarding kennel licensing can be used for the number of animals ---'----'--'-- retained by property owners, but it must be established that the dogs are being kept for compensation. The proper order is to require a verbal complaint, notify under the current nuisance ordinance then adopt a new ordinance and proceed to prosecute if the problem has not abated. COMMITTEE REPORTS: Parks: 2 bids have been received regarding refinishing the tennis courts, both are approximately $7,000. Moved by WALKER and seconded by MINOW to accept the portion of the bid from Cascade Fence Co. for tennis nets only, at this time, ALL AYE: MOTION CARRIED. MINOW will check on some possibilities for funding designated toward parks. P&Z: They are considering the possibility of controlling the Design Review responsibilities instead of relying on a separate committee. Greenbelt: The Committee met with Dennis Baker regarding his development and incorporating a greenbelt within the development. Bypass: the Greenbelt Committee is drafting a letter supporting the long route. Law Enforcement: The estimate is at $28,000 for 20 hours patrol coverage for Ea~le. The Council ~ecommended that no additional coverage can be used at the prese^t time due to budget constraints, however, it will be reviewed again at Budget time. Downtown Development: YZAGUIRRE and MINOW met with Phil Choate regarding the business survey, and completion of a market research. Proposal from Barbara Montgomery regarding Ada County Transmittals, charging a referral fee, as set up by the resolution establishing fees, of $50, for the impact area. The suggestion given to Ada County Development Services is to have the applicant come directly to the City and pay the fee. The Clerk asked for guidance from Council. The Council felt it was appropriate to assess the fee for all referrals. CLAIMS AGAINST THE CITY: Moved by YZAGUIRRE and seconded by WALKER to approve the claims as presented. MAYOR STEVE GUERBER ., PRE COUNCIL SESSION MARCH 26, 1991 1. LYLE POPE presentation regarding a mobile home site within the City of Eagle, next to the fire station. Council suggested going through the CUP process. 2. FLEA MARKET-Council suggested going through a CUP process but noted that it would look favorably on the business established as inside a building rather than outside. They will need an outline of plans, parking, etc. 3. MEDICAL REPORT-MINOW gave a report on medical findings and will negotiate with potential applicants. 4. PRIME EARTH: Mona reported on findings from the Attorney General's office. 5. ANIMALS: There is an Idaho Code regarding animals, there needs to be a complaint, and action.
