1. CALL TO ORDER: Meeting called to order at 6:00 P.M.
2. ROLL CALL: Present: WRIGHT, GUERBER, MCLAUGHLIN, and SMITH. Absent:
MCCAULEY. A quorum is present.
3. ALL CONSENT AGENDA ITEMS ARE ACTION ITEMS. CONSENT AGENDA:
♦ Consent Agenda items are considered to be routine and are acted on with one motion. There
will be no separate discussion on these items unless the Chairman, a Commissioner, member
of City Staff, or a citizen requests an item to be removed from the Consent Agenda for
discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in
a sequence determined by the Rules of Order.
♦ Any item on the Consent Agenda that contains written recommendations from the City of Eagle
shall be adopted as part of the Planning & Zoning Commission's Consent Agenda approval
motion unless specifically stated otherwise.

Guerber moves to accept the consent agenda items as presented. Seconded by McLaughlin.

5. PUBLIC HEARINGS:
A. ACTION ITEM.- A-03-18/RZ-05-18 & PP-04-18 — Annexation and Rezone (with a
development agreement) from RUT to R-3-DA and Preliminary Plat for Headquarters
Subdivision: Madera Development, Inc., represented by Mary Wall and Jon Breckon with
Breckon Land Design, is requesting an annexation, rezone from RUT (Rural -Urban Transition
— Ada County designation) to R-3-DA (Residential with a development agreement), and
preliminary plat approvals for Headquarters Subdivision, a 23-lot (20-buildable, 3-common)
residential subdivision. The 10-acre site is located on the south side of West Floating Feather
Road at the southwest corner of West Floating Feather Road and North Lanewood Road at
5655 West Floating Feather Road. (DCL) This item was continued from the September 21,
2020 Planning & Zoning Commission meeting. Staff is requesting that this application be
remanded.
City Planner, Mike Williams, informs the Commission that the applicant has requested to continue
the application to December 21 ". Staff, however, is requesting that the item be remanded and re -
noticed at a future date.
Guerber moves to remand item 5A on the public hearing agenda to Staff for further
consideration. Seconded by McLaughlin. ALL AYES... MOTION CARRIES.
B. ACTIONITEM: A-05-20/RZ-06-20/CU-04-20/PPUD-02-20/PP-03-20 — Mosscreek Planned
Unit Development — Urban Solutions, LLC: Urban Solutions, LLC, represented by Steve
Hart, is requesting an annexation, rezone from RUT (Rural -Urban Transition — Ada County
designation) to R-5-DA-P (Residential with a development agreement — PUD), conditional use
permit, preliminary development plan, and preliminary plat approvals for Mosscreek
Subdivision, a 64-lot (56-buildable, 8-common) residential planned unit development. The
21.6-acre site, consisting of three (3) parcels, is located at the west terminus of West Escalante
Drive, south terminus of North Tempsford Way, and 5806 West State Street. (MJW)

Thomas York, 703 North Foudy Place. York thanks Staff for a thorough presentation, states that
he has a letter from Mike Mongelli discussing a procedural issue with the application, and invites
Mr. Hart to join into a partnership and discussions with the Preserve HOA. York discusses
maintenance of landscaping, traffic speeds and safety, and street lighting. York discusses amenities
and security issues.
York responds to comments from the Commission.
City Planner, Mike Williams, requests that the claim regarding procedural issues be read into the
record.
York reads Mr. Mongelli's letter regarding a procedural issue.
Jeanne Rose Leathers, 5731 West Durning Drive. Leathers discusses drainage concerns, inquires
about buffer sizes, landscaping, and fencing, and expresses concerns about noise from the roadway.
Bob Hart, 5789 West Durning. Hart expresses concerns about the landscape buffer.
The applicant provides rebuttal and addresses concerns raised during the public hearing.
Chairman Wright closes the Public Hearing.
Williams responds to questions from the Commission.

Guerber moves to recommend for approval item 5B Mosscreek Planned Unit Subdivision,
Urban Solutions, LL with the site -specific conditions as included by Staff.

C. ACTIONITEM: CU-06-20 — Building Height Exception and a Waiver Pursuant to
Idaho Code �67-6512(f) for a Parking Reduction — Eagle River, LLC: Eagle River, LLC,
represented by Joshua Hersel with Cushing Terrell, is requesting conditional use permit
approval for a building height exception to 39' 6" and a waiver pursuant to Idaho Code §67-
6512(f) for a parking reduction of five (5) parking spaces. The request is in association with a
proposed two (2) story, 21,556-square foot office building. The 1.48-acre site is located on the
north side of East Riverside Drive approximately 865-feet east of South Palmetto Avenue
within the Eagle River Development (Mixed Use Subdivision No. 4 Lot 08, Block 03). (DCL)

7. REPORTS:
A. Commission: Commissioner Smith inquires about entity review letters from the Fire
Department. Commissioner McLaughlin inquires when changes regarding maximum heights
will be made to City Code.
B. City Attorney: City Attorney, Victor Villegas, provides an update regarding the status of the
petition for judicial review for Molinari Park.
C. Staff: Pathways and Trails Superintendent, Steve Noyes, provides an overview of trails and
pathways within the City of Eagle and explains the Parks, Pathways, and Recreation
Commission recommendation process.
8. ADJOURNMENT:
