Due to weight restrictions, heavy materials such as but not limited to sod, dirt or gravel are limited to one
cubic yard per container.
Due to DOT weight restrictions, contents are limited to eight tons. Overweight fines will be passed to the
customer.
Liquids, vehicle tires & batteries, oils, or hazardous waste such as but not limited to pesticides, chemicals,
paints and thinners. Large items that may cause damage to our trucks such as but not limited to tree stumps,
rock, concrete or asphalt are NOT allowed in commercial containers.
1 Coverage
This agreement shall include collection and disposal of trash and recycling generated
by the customer, excluding hazardous, contaminated, or otherwise prohibited
materials. The title to all solid waste, except hazardous and other prohibited materials,
shall pass to the contractor when placed in the contractor's collection vehicle,
removed by the contractor from a container, or removed by the contractor from the
customer's premises.
6 Force Majeure
Neither the contractor nor the City of Eagle shall be liable for failure to perform
due to contingencies beyond reasonable control, including, but not limited to,
riots, war, fires, acts of nature, injunction, compliance with any law, regulation,
guideline or order of any govemmental body or any instrumentality thereof.
2 Access
The customer agrees to maintain convenient ingress and egress to solid waste
containers including removal of vehicles, snow, and/or ice
3 Loss or Damage to Property
The customer acknowledges the care and custody of equipment owned by the
contractor and accepts responsibility for the equipment and its contents, except when
it is being physically handled by employees of the contractor_ The customer agrees to
defend, indemnify, and hold harmless the contractor and/or municipality from and
against any and all claims for loss of or damage to property or Injury to or death of a
person or persons resulting from or arising in any manner out of customer's use,
operation or possession of equipment as fumished under this agreement.
7 Changes in Service
Requests for changes in service (container sue, frequency of collection, etc.)
must be placed with the contractor
8 Exclusivity & Non -Payment
The contractor holds exclusive authority and privilege to collect, transport,
process and dispose of trash & recycling that is generated within Eagle City
limits. Rates may be adjusted in full accordance with franchise agreement. The
contractor may stop service if non-payment extends beyond 90 days.
Reinstatement and/or late fees may be charged. All prices are subject to
change
4 Indemnification
The customer and the contractor agree to defend, indemnify and hold harmless the
other for claims, damages, liabilities, penalties and costs (Including reasonable
attomeys fees) caused by or arising from the negligence or willful misconduct,
respectively, of the customer and the contractor
9 Deposit & Payment Policies —ANEW
The customer agrees to prepayment or deposit if required and accepts financial
responsibility for payment within 45 days of date on bill. The customer agrees to
pay additional and reasonable attomeys fees if it becomes necessary to place
this account for collection.
5 Damage to Pavement
The customer acknowledges that the contractor and/or municipality shall not be liable
for damage to pavement or driving surfaces resulting from the contractor's trucks
servicing an agreed -upon area
10 Binding Effect
This agreement is a legally binding contract on the part of the contractor and the
customer and their respective heirs, successors, and assigns in accordance
with terms and conditions set out herein.
5 Overloaded Containers
Additonal fees will be charged for overloaded containers
