CALL TO ORDER: Meeting called to order at 6:00 P.M.
2. ROLL CALL: Present: WRIGHT, GUERBER, MCCAULEY, MCLAUGHLIN, and SMITH. A
quorum is present.
ALL CONSENTAGENDA ITEMSAREACTIONITEMS. CONSENT AGENDA:
♦ Consent Agenda items are considered to be routine and are acted on with one motion. There
will be no separate discussion on these items unless the Chairman, a Commissioner, member
of City Staff, or a citizen requests an item to be removed from the Consent Agenda for
discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in
a sequence determined by the Rules of Order.
♦ Any item on the Consent Agenda that contains written recommendations from the City of Eagle
shall be adopted as part of the Planning & Zoning Commission's Consent Agenda approval
motion unless specifically stated otherwise.
A. Minutes of August 3, 2020.
McLaughlin moves to accept the consent agenda items as presented. Seconded by Guerber.
ALL AYES... MOTION CARRIES.
4. UNFINISHED BUSINESS: NONE.
PUBLIC HEARINGS:
A. ACTION ITEM. CU -05-20 — Change of Nonconforming Use — Jamison Nakaya: Jamison
Nakaya is requesting conditional use permit approval for a change of nonconforming use to
allow an addition of a breezeway, porch, and an enlarged patio cover to the existing home,
renovation and expansion of an existing shop, and to allow an accessory dwelling unit (up to
800-sqft). The .48 -acre site is located on the east side of North Eagle Road approximately
1,150 -feet north of West Floating Feather Road at 1638 North Eagle Road. (DCL) This site
was not posted in accordance with Eagle City Code Section 8-7-8(E), therefore, this
application will be re -noticed for a public hearing at a future date.
City Planner, Mike Williams, informs the Commission that the item was improperly noticed, will
be renoticed for a future date, and no action by the Commission is needed at this time.
B. ACTION ITEM: RZ-08-20 — Rezone from A -R (Agricultural -Residential) to MU -DA
(mixed Use with a Development Agreement [in lieu of a conditional use permit]) — Hatch
Design Architecture: Hatch Design Architecture, represented by Jeff Hatch, is requesting a
rezone from A -R (Agricultural -Residential) to MU -DA (Mixed Use with a development
agreement [in lieu of a conditional use permit]) to allow for a storage facility (with reduced
setbacks) and a residential use. The 7.3 -acre site is located on the south side of West State
Street approximately 400 -feet west of the intersection of South Payette Way and West State
Street at 1601 West State Street. (MJW)
Jeff Hatch, 200 West 36t1' Street, Boise, Idaho 83714. The applicant's representative provides an
overview of the application.
Hatch responds to questions from the Commission.
Rob Martin, 372 South Eagle Road. The applicant explains market needs and demands for storage
in this area.

Chairman Wright opens the Public Hearing.
Jeff Schroeder & Carol Schroeder, 1548 West Kenai Court (via WebEx). Schroeder states support
for the project, explains that the applicant's representative has incorporated their suggestions into
the plan, and explains that they do not want a pathway to be required along the eastern boundary
of the application site. Schroeder also explains that they do not want Kenai Court to be opened up
for traffic.
Patricia Hicks, 1520 West Kenai Court (via WebEx). Hicks states her support for the application.
Schroeder responds to questions from the Commission.
Anne Ritter, 1270 West Beacon Light Road. Ritter states concerns related to water, traffic, and
education, and explains that she supports the application due to the fact that it will generate less
traffic than a residential project.
Ritter responds to comments from the Commission.
Jeremy Rausch, 1576 West Kenai Court. Rausch states support for the application, states his
appreciation for the design, the applicant's intent to limit construction traffic impact to the
neighborhood, explains that he feels the proposed setbacks are sufficient and that he does not
believe traffic will be a concern.
Rausch responds to questions from the Commission.
Hatch, the applicant's representative, provides rebuttal and responds to comments made during the
Public Hearing.
Martin, the applicant, provides rebuttal and responds to comments made during the Public Hearing.
Martin responds to questions from the Commission.
Hatch briefly recaps the applicant's request.
Chairman Wright closes the Public Hearing.
General discussion amongst the Commission.
Williams responds to questions regarding clarification of site specific conditions.
Smith moves to recommend for approval item 513 RZ-08-20 Rezone from A -R (Agricultural -
Residential) to MU -DA (Mixed Use with a development agreement) by Hatch Design
Architecture with the changes that have been discussed and recommended by Mr. Williams,
site specific condition 3.13, and also to recommend for approval the request for the setback
adjustments made by the applicant. Seconded by Guerber.
Williams requests clarification regarding the motion: "On item 3.5, based on your motion, this is
what is going to reflect in the Findings: on the interior side, it will state `interior sides'; I will cross
out the word `west', and then strike out the remaining portions that have anything to do with interior
side, so you'll just have front, rear, interior sides, street side, and maximum lot coverage."
Smith: Correct.
Guerber: Yes.

C. ACTION ITEM. A-06-20/RZ-09-20 & PP -04-20 — Annexation and Rezone with a
development a reement from RUT to R -2 -DA and Preliminary Plat for Brush Creek
Subdivision — Tyler Frazier: Tyler Frazier, represented by Lance Daniels with The FCI
Group, Inc., is requesting an annexation, rezone from RUT (Residential -Urban Transition —
Ada County designation) to R -2 -DA (Residential with a development agreement) and
preliminary plat approvals for Brush Creek Subdivision, a 20 -lot (16 -buildable, 4 -common)
residential subdivision. The 10 -acre site is located on the west side of North Park Lane
approximately one-half mile north of West Floating Feather Road at 2055 North Park Lane.

an overview of the application.

development agreement) from RUT to R -2 -DA and Preliminary Plat for Brush Creek
Subdivision. Seconded by Smith. ALL AYES... MOTION CARRIES.
6. NEW BUSINESS: NONE.
7. REPORTS:
A. Commission: Commissioner Smith states that he may be absent from the September 21St
meeting.
B. City Attorney: None.
C. Staff. Administrative Clerk, Kristl Caron, reminds the Commission that the next meeting will
be held on August 31St in place of the first regularly scheduled meeting in September.
