December 11 ,1990
The Eagle City Council met in regular session on December 11,
1990. Mayor GUERBER presiding.
The following members were present:
WALKER, RICK YZAGUIRRE, TOM MINOWo

Moved by YZAGUIRRE and seconded by HAMMONS to approve the minutes
of the November 27, 1990 meeting as presented. ALL AYE: MOTION
CARRIED.
CENTENNIAL PLAQUE awarded by Mayor GUERBER to STEVE HAMMONS for
his accomplishments as Centennial Chairman.
PUBLIC HEARING/Dee Ann's Hair Design/CUP:
Mayor GUERBER announced that this was the time and place set for
a public hearing on Dee Ann's Hair Design, a Conditional Use
Application.
Applicant: Dee Ann Geisler
Location: 1336 E. State St., Eagle
Proposal: CUP in a residential zone for a beauty shop. The
shop will be on Sewer, will be landscaped and provide adequate
parking.
Public Testimony: No opposition. Testimony in favor: Fred L.
Mosier, Dee Ann Geisler
Public hearing closed at 7:40 p.m.
Moved by WALKER and seconded by YZAGUIRRE to approve the CUP as
presented. ALL AYE: MOTION CARRIED.
PUBLIC HEARING/Pope/Aikens Rezone and Variance:
Mayor GUERBER announced that this was the time and place set for
a public hearing on the Pope/Aikens rezone and variance
application.
Applicant: Lyle Pope
Location: E. of First St., behind Eagle Foodtown
Proposal: rezone from R5 to R16 for the purpose of building 3
four plex units. The units will be one and two bedroom to total
11 units in all.
Public Testimony: No opposition.
Public hearing closed at 7:50 p.m.
Moved by WALKER and seconded by MINOW to approve the rezone and
variance application as presented. ALL AYE: MOTION CARRIED.
PUBLIC HEARING/Avante Annexation and Zoning (R5)
Mayor GUERBER announced that this was the time and place set for
a public hearing on the Avante annexation and zoning application.
Applicant: Tony Hickey, Donald Grandmason and David Smart
Location: Edgewood Lane, Patterson Sub. Lots 1,2,3,4, and 5
Proposal: to annex the property and zone it R5 for the purposes
of development. Net density is approximately 3.2 houses per
acre, a total of 40 acres. The first phase will be 7.19 acres,
with 26 building lots. Covenants will be in place.
Public Testimony: Opposition: Kurt Rockenhaus
Public hearing closed at 7:55 p.m.
Concerns: traffic, overcrowding of schools, sewer and water and
P&Z denial of the proposal.
At the request of the developer, Tony Hickey, a motion was
made by WALKER and seconded by YZAGUIRRE to continue the public
hearing until March 12, 1991 in order for the developer to solve
the water and sewer concerns he has encountered at this time. ALL
AYE: MOTION CARRIED.
MINOW addressed the density in the area and advised Mr. Hickey
that the City's overhaul plan is for a higher density in the
State Street area, the density of the proposal is appropriate for
the area. There is no city center growth plan.
EAGLE GREEN SUBDIVISION/Impact Area: 22 acres S. side of Beacon
Light Rd. Developer will be presenting a final plat for the
subdivision in the near future. The Ada County transmittal came
before Council on September 11, 1990 and was approved with the
condition that the road meet Ada County standards. Moved by
MINOW and seconded by WALKER to approve the signing of the final
plat when presented with that condition. AYE: MINOW, WALKER,
YZAGUIRRE. NAY: HAMMONS. MOTION CARRIED.
HOUSE SUBDIVISION: Request for final plat approval with a
nonbuildable clause. Presentation by Pat Tealey. By Central
District Health standards the lots are now nonbuildable as they
do not have water and sewer available. The only way building
can take place is to build on the same lot as the existing house
with no sewer or water facilities. The owner, Steve Kioukis,
wants to build a 40 ft building on the same lot. Tealey asked for
consideration of approval of the final plat without sewer and
water, understanding any future development would require sewer
and water facilities and would have to be endorsed by Central
District Health. Moved by MINOW and seconded by WALKER to
approve the final plat and allow construction of a building on
the same lot as the home, only with the permission of the health
department to hook up to the current system. It will be
allowable with the knowledge that if the site ever converts to a
manufacturing facility sewer and water hookup will be required.
ALL AYE: MOTION CARRIED.
BANBURY, PHASE 4 extension of time: Stan McHutchinson
represented BanBury. The final plat for phase 3 was recorded
February 6, 1990. Phase 4 needs to be recorded within a year of
that date. The developers are asking for an extension of time
from February 6, 1991 to February 6, 1992 to file a final plat on
phase 4. Moved by MINOW and seconded by YZAGUIRRE to grant the
extension as requested. ALL AYE: MOTION CARRIED.
COMPUTER PACKAGE: WALKER reported receiving several proposals
but recommends accepting the proposal by Quality Design, in
Eagle. The proposal includes the following:

color 300
backup 375
power out. 450
printer
Moved by WALKER and seconded by MINOW to approve the program as
listed above with the exception of the printer, up to a total of
$3,995. ALL AYE: MOTION CARRIED.
SHERIFF'S REPORT: 39 citations issued in October. There has
been a one officer increase in the area, he will be more
available to service the Eagle area.
EAGLE HORIZONS TASK FORCE APPOINTMENT will be postponed until the
next Council meeting.
LIQUOR, WINE AND BEER LICENSES:
Moved by HAMMONS and seconded by MINOW to approve all the beer
and wine licenses presented which includes: Eagle Beverage,
Circle K, Eagle Foodtown, Bank Club, Bob's Trolley House 11,
Eagle Uni Merc, and Baird Oil Co-Go Fer Mart, Regal Eagle and
Eagle Hills Golf Course. ALL AYE: MOTION CARRIED.
Moved by HAMMONS and seconded by MINOW to approve all the liquor
licenses presented which includes: The Bank Club, Regal Eagle
and Eagle Hills Golf Course. ALL AYE: MOTION CARRIED.
Ada County Transmittal 90-22-SP Middleton: 3.75 acres on Beacon
Light Rd for a temporary structure, renovation of a 2 story
Victorian structure. Moved by MINOW and seconded by YZAGUIRRE to
approve the transmittal as presented. ALL AYE: MOTION
CARRIED.
Ada County Amendment/Radio Towers: An amendment to Ada County
Title 8, modifying a conditional use standards. Moved by MINOW
and seconded by WALKER to approve the amendment as presented.
ALL AYE: MOTION CARRIED.
ORDINANCES-RESOLUTIONS:
Moved by HAMMONS and seconded by WALKER to consider the third and
final readinG of Ordinance 176 at this time, read by title only.
The Ordinance prohibits the use of streets within subdivisions by
certain vehicles. ALL AYE: MOTION CARRIED.
Moved by WALKER and seconded by HAMMONS to consider the third and
final reading of Ordinance 177. at this time, read by title only.
The Ordinance establishes a motor vehicle emissions control
program. ALL AYE: MOTION CARRIED.
JOINT POWERS AGREEMENT BETWEEN CITIES IN THE OPERATION OF AIR
QUALITY INSPECTION PROGRAM. Moved by MINOW and seconded by
YZAGUIRRE to accept the agreement as presented. ALL AYEs MOTION
CARRIED.
Resolution 8-90 adopting the joint powers agreement. Moved by
WALKER and seconded by MINOW to approve the resolution with the
inclusion of all the cities and counties within the resolution.
ALL AYE: MOTION CARRIED.
Attorney's report: none
Mayor's report: We need people interested in recreation
locations with in the City of Eagle. We have had people come
before us from the Little League, advising us their area will be
split, and Eagle and Star need a new location. We have been
approached by Babe Ruth League they need a field location too.
They will build a facility and maintain it. We have completed a
study two years ago on a swimming pool which might be included in
this location also.
Committee reports: Centennial/HAMMONS is still working on the
Eagle Design for City Hall, along with working on street lights
in Eagle. We have received a bid from Alloway Electric for $900.
Library/HAMMONS: The City of Boise and City of Eagle have
entered into a contract to oversee the operation of the Library.
The contract starts January 1, 1991. Redevelopment/MINOW,
YZAGUIRRE: Meeting has been established for tomorrow night.
The group is proceeding with the Engineering and Dept. of
Commerce studies. Greenbelt/YZAGUIRRE: Boise River Plan has
been approved by the City of Boise.
CLAIMS AGAINST THE CITY.' Moved by HAMMONS and seconded by WALKER
to approve the claims as presented. ALL AYE.' MOTION CARRIED.
There will be no second meeting of City Council in December.
