Minutes - 1990 - City Council - 11/13/1990 - RegularEAGLE CITY COUNCIL MEETING NOVEMBER 13 ~ 1990 The Eagle City 1990. Mayor GUERBER presiding. The following members were present: WALKER, RICK YZAGUIRRE, TOM MINOW. Moved by WALKER and seconded by YZAGUIRRE of the November 23, CARRIED. Council met in regular session on November 13, STEVE HAMMONS, GARY to approve the minutes 1990 meeting as presented. ALL AYE: MOTION PUBLIC HEARING/HIGGINS-CUP: Mayor GUERBER announced that this was the time and place for a public hearing on Patricia Higgins/CUP. Applicant: Patricia Higgins Location: 2382 Syringa St., Lot 2, Randall Subdivision Proposal: to place a mobile home on a single family dwelling lot for a relative. Public Testimony: no opposition Public hearing closed at 7:35 p.m. Moved by MINOW and seconded by YZAGUIRRE to approve the application subject to sewer hook up. Motion was amended to include the use of a septic system for a 90 day period only, subject to approval by Central District Health. ALL AYE: MOTION CARRIED. PUBLIC HEARING/POPE/AIKENS REZONE-VARIANCE: Mayor GUERBER announced that this was the time and place public hearing on a Rezone-variance application. for a Applicant: Lyle Pope Location: E. of First St., behind Eagle Foodtown Proposal: rezone from R5 to R16 for the purpose of building 3 four plex units and a request of a variance on lot 5 to 10 ft., from the normal 20 ft. set back, at the east end, for more parking area. The west lot needs a 7 1/2 set back rather than a 20 ft. (alley). Public Testimony: IN FAVOR: Lyle Pope OPPOSED: L.A. Parks Rowena Parks Betty Fisher Public hearing closed at 7:55 Discussion: Parking area will serve 21, (requirement by ordinance 1 1/2 parking spaces per unit = 18). Questions were raised regarding traffic, congestion, layout and landscaping. The E. end of Aikens is a problem in that it is a 30 ft. road which will not meet ACHD standards. ACHD does maintain the road now, but the road can not be a dedicated road because of the width. Moved by MINOW and seconded by HAMMONS to defer this application until more definitive information has been submitted by the developer. That information should include a site plan that includes landscaping, parking lot configuration, sidewalks, traffic flow and other amenities associated with this kind of development. ALL AYE: MOTION CARRIED. ACHD PRESENTATION/Pat Dobie: Mr. Dobie requested the Council formulate a long range plan for N. Eagle Rd. The Eagle United Methodist Church presented ACHD a plan which did not meet some of the standards required, including curb and sidewalks. Mr. Dobie asked direction of council. Moved by MINOW and seconded by WALKER that until further development makes it necessary there is no need for curb and sidewalks in connection with the church at this time. ALL AYE: MOTION CARRIED. Council directed that a letter be sent to Erv Olen, APA to develop a transportation model of a long range plan for Eagle Rd. INLAND PLASTICS/DESIGN REVIEW APPLICATION: Presentation by Dave williams, representative. Inland Plastics will manufacture plastic pipe, and will be a wholesale and retail establishment. The building will be a 60 X 180 pole building. The manufacturing process is a clean process and all storage will be contained inside the building. The rear acreage will be fenced off and remain pasture. There will be no asphalt in the parking lot but the approach will be paved. The grounds will have a sprinkler system. Documentation has been received from Sewer, water and fire departments indicating no problems. Conditions were noted from the Design Review Committee. Moved by MINOW and seconded by YZAGUIRRE to approve the application as presented. ALL AYE: MOTION CARRIED. ORDINANCES-RESOLUTIONS: ORDINANCE #176: Restricting certain commercial vehicles in a residential district. Second reading by title only. A letter will be written to ACHD for an opinion on the ordinance. ORDINANCE #177: Air Quality Board representative, Ron Marshall gave a presentation to council regarding a new ordinance enforcing emission control throughout Ada County. The ordinance needs to have a resolution and a Joint power agreement between the county and city. First reading of the ordinance was given by title only. EAGLE RIDGE : Presentation by David Collins, Engineer for Eagle Ridge, requesting a lot line adjustment. The adjustment will be on the N. property lot lines, W. of Palmetto to the N. 25 ft and the S. 15 ft, creating a 40 ft. right of way, which will be deeded to ACHD. Moved by MINOW and seconded by WALKER to approve the lot line adjustment as presented. ALL AYE: MOTION CARRIED. LINDSAY EAGLE POINT SUBDIVISION, PHASE 1: Presentation by Stan McHutchinson from Briggs Engineering for approval of final plat, phase 1, of the subdivision. Moved by MINOW and seconded by WALKER to approve the final plat of this subdivision, phase 1. ALL AYE: MOTION CARRIED. RIVERSTONE TOWNHOUSES: Presentation by Robert DeShazo for a final plat approval for phase 2 of the project. Moved by MINOW and seconded by YZAGUIRRE to approve the plat as presented. ALL AYE: MOTION CARRIED. HIT COMPUTER PACKAGE: The proposal was reviewed and it was moved by MINOW and seconded by WALKER to approve the purchase of the software from HIT, but to explore other outlets for the hardware. ROLL CALL ON THE MOTION RESULTED AS FOLLOWS: AYE: HAMMONS, MINOW, WALKER, YZAGUIRRE. MOTION CARRIED. BOISE/EAGLE LIBRARY AGREEMENT: Moved by MINOW and seconded by WALKER to execute the agreement as presented. ALL AYE: MOTION CARRIED. APPOINTMENTS: Mayor GUERBER presented the appointment of Elizabeth Horn to the Eagle Library Board, and Jerry Mattison to the Design Review Committee for Council consideration. Moved by MINOW and seconded by YZAGUIRRE that approval be given to the appointment of Elizabeth Horn. ALL AYE: MOTION CARRIED. Moved by MINOW and seconded by WALKER to approve the appointment of Jerry Mattison. ALL AYE: MOTION CARRIED. UNFINISHED BUSINESS: Findings of Fact and Conclusions of Law/ EAGLE UNITED METHODIST CHURCH: Moved by WALKER and seconded by YZAGUIRRE to approve the findings and conclusions as presented. ALL AYE: MOTION CARRIED. MAYOR'S REPORT: A flood plain encroachment study, prepared by ITD in coordination with FEMA, regarding the Eagle Alternate Route, project F-3271 (33) was presented to council. The city attorney and engineer determined that this was a preliminary review and conformed with the Eagle Flood Plain study and could be executed at this time in order to establish a public hearing necessary for the project. Moved by WALKER and seconded by MINOW to execute, the document at this time. ALL AYE: MOTION CARRIED. Sheriff's report was given, there were no incidents in the Eagle area this month. ATTORNEY'S REPORT: an application on the downtown redevelopment, Mendiola property was briefly discussed. COMMITTEE REPORTS: Senior Citizens: The lease was reviewed by the Senior board, no changes were made. WALKER asked the City Clerk to write a letter to the board regarding the exchange of use of the senior side and council chambers for meetings. Parks: the new addition plus regular maintenance amounted to $7,500 for completion. Centennial: November 27, 1990 is the designated date for burying the time capsule, any additional items to go in the capsule would be appreciated. CLAIMS AGAINST THE CITY: Moved by HAMMONS and seconded by WALKER to approve the claims as presented. ALL AYE: MOTION CARRIED. Moved by MINOW and seconded by WALKER to go into executive session regarding acquisition of property.
