OCTOBER 23 ~1990
The Eagle City Council met in regular session on October 23,
1990. Mayor GUERBER presiding.
The following members were present: GARY WALKER, RICK
YZAGUIRRE, TOM MINOW. Absent: STEVE HAMMONS.
Moved by YZAGUIRRE and seconded by WALKER to approve the minutes
of the October 9, 1990 meeting as presented. ALL AYE: MOTION
CARRIED.
PUBLIC HEARING/Eagle United Methodist Church/CUP.
Mayor GUERBER announced that this was the time and place set for
a public hearing on an application for a CUP by Eagle United
Methodist Church.
Applicant: Don Love, church representative
Location~ N of Eagle Elementary School, W side at top of hill
Proposal~ A church in a R-5 district
Public Testimony: no opposition
Public hearing closed at 7:55 p.m.
Moved by WALKER and seconded by MINOW to approve the
as presented but to recommend that measures be taken to
adequate fire protection with a fire hydrant. ALL AYE:
CARRIED.

ORDiNANCES-RESOLUTIONS:
ordinance #1765 Restricting certain commercial vehicles in a
subdivision. City attorney, Mona Mack, recommended talking to
ACHD regarding policy. Moved by MINOW and seconded by YZAGUIRRE
approve the first reading of the ordinance by title only, the
second reading will be subject to a conference with ACHD, and a
policy resolution to reduce the pounds to 15,000 rather than the
26,000 as the code reads now. NO MOTION Moved by WALKER and
seconded by YZAGUIRRE to have the first reading of Ordinance at
this time and contact ACHD. ALL AYE: MOTION CARRIED.
APPOINTMENTS: Mayor GUERBER will make the appointments to the
Library Board, Design Review Committee and the Redevelopment
Committee at the next council session.
NEW BUSINESS:
HIT INDUSTRIES: The proposal for a computer package was
discussed, but the bid was complicated enough to need
clarification. WALKER requested a call from the representatives
of HIT in order to clarify. He will report to council at the
next meeting.
IMPACT AREA AGREEMENT: Discussion took place regarding the
impact area, the procedures and the signing of the final plats
within the area by the Eagle City Clerk. The City Attorney, Mona
Mack and Dave Abo, Ada County Planning Director have asked for a
legal opinion from the county and report to council.
Resolution 7-90: Appointing a deputy clerk to perform certain
duties in the absence of the .city clerk. Moved by WALKER and
seconded by MINOW to approve the resolution with the addition
that the authorization is given in writing by the mayor or city
clerk. ALL AYE: MOTION CARRIED.
UNFINISHED BUSINESS:
A reminder was given to council regarding the meeting of the
Sewer District on November 12. Tom Minow and the mayor will
attend the meeting.
MAYOR'S REPORT: A petition has been received by property owners
regarding the impact on Eagle Rd. and State St. due to the
opening of the Eagle Interchange. The mayor will write ITD
expressing concerns regarding speeding, safety concerns and the
bypass. The letter will be signed by members of the council and
will include the petition.
ATTORNEY'S REPORT: the attorney reported on the letter that was
initiated to Eagle Land Co. regarding the manufacturing area.
CLAIMS AGAINST THE CITY'. Moved by WALKER and seconded by MINOW to
approve the claims as presented. ALL AYE: MOTION CARRIED.
There being no further business the meeting adjourned at 9:45
