Due to weight restrictions, heavy materials such as but not limited to sod, dirt or gravel are limited to one
cubic yard per container.
Due to DOT weight restrictions, contents are limited to eight tons. Overweight fines will be passod to the
customer.
Liquids, vehicle tires & batteries, oils, or hazardous waste such as but not limited to pesticides, chemicals,
paints and thinners. Large items that may cause damage to our trucks such as but not limited to tree stumps,
rock, concrete or asphalt are NOT allowed in commercial containers.
1 Coverage
This agreement shall include collection and disposal of trash and recycling generated
by the customer, excluding hazardous, contaminated, or otherwise prohibited
materials. The title to all solid waste. except hazardous and other prohibited matenals,
shall pass to the contractor when placed in the contractors collection vehicle.

6 Force Majeure
Neither the contractor nor the City of Eagle shall be liable for failure to perform

2 Access
The customer agrees to maintain convenient ingress and egress to solid waste

7 Changes in Service
Requests for changes in service (container size, frequency of collection, etc.)

3 Loss or Damage to Property
The customer acknowledges the care and custody of equipment owned by the
contractor and accepts responsibility for the equipment and its contents. except when
it is being physically handled by employees of the contractor. The customer agrees to
defend, indemnify, and hold harmless the contractor and/or municipality from and
against any and all claims for loss of or damage to property or injury to or death of e
person or persons resulting from or arising in any manner out of customers use,
operation or possession of equipment as furnished under this agreement
8 Exclusivity & Non•Payment
The contractor holds exclusive authority and privilege to collect, transport.

limits. Rates may be adjusted in full accordance with franchise agreement. The
contractor may stop service if non-payment extends beyond 90 days.
