Minutes - 1990 - City Council - 09/11/1990 - RegularEAGLE CITY COUNCIL MEETING SEPTEMBER 11 t 1990 The Eagle City Council met in regular session on August 28, 1990. Council president HAMMONS presiding in Mayor GUERBER'S absence. The following members were present: STEVE HAMMONS, RICK YZAGUIRRE, TOM MINOW, GARY WALKER. Moved by MINOW and seconded by YZAGUIRRE to approve the minutes of the August 28, 1990 meeting as presented. ALL AYE: MOTION CARRIED. PUBLIC HEARING/EAGLE RIDGE SUBDIVISION/Variances: Applicant: GREG JOHNSON Location: N. of Dry Creek canal between Stierman and E.H.W. #4 Proposal: Rear yard set back of 15 feet, variance from 25 feet on the following: Lots 1 & 2 of block 9, Lots 26-32 of Block 4 and Lots 1 & 2 of Block 10, all front and street side set backs to 15 feet. The plat was recorded in 1980. Testimony: Larry Sale, City Engineer Daunt Whitman, City Building Inspector Concern was expressed regarding front set back request from the curb rather than the sidewalk past the curb. Also a concern was expressed regarding the streets and completion of Palmetto. Public hearing closed at 8:10 p.m. Moved by MINOW and seconded by WALKER to approve the request for variances on Eagle Ridge Subdivision with a 10 foot set back from property line on the front portion of the lots, 15 foot set back on the rear portion, on the side of the N. boundary, and the developer must complete the road. (Palmetto to Monarch) ALL AYE: MOTION CARRIED. NEW BUSINESS: Pre-Annexation request by Don Hubble, Engineer from Hubble Engineering representing the property owners in Patterson Subdivision. The homeowners, headed by Tony Hickey are requesting annexation of 5 parcels and zoning R-4. The Council indicated interest in the proposal and invited them to apply for formal annexation and zoning. CEDAR WEST/Building Dept. complaint: Representatives from Cedar West did not appear. Daunt Whitman, City Building Inspector advised the Council that Cedar West was double charged for a building permit for a roof on the Eagle Primary School. Daunt contacted the Meridian School District and advised them that the extra charge should be assumed by the builder and not the school. Work was proceeding without the permit in place. Ada County Transmittals: 90-45-PDR-Wood: Moved by WALKER and seconded by MINOW to approve the Ada County Transmittal subject to the roads being built to ACHD standards and specifications and to encourage central water and sewer. ALL AYE~ MOTION CARRIED. 90-47-PDR-Camerson: Moved by MINOW and seconded by YZAGUIRRE to approve the Ada County Transmittal subject to the roads being built to ACHD standards and specifications and to encourage central water and sewer when it becomes available. ALL AYE: MOTION CARRIED. 90-49-PDR-Ellison: Moved by MINOW and seconded by YZAGUIRRE to approve the Ada County Transmittal subject to the roads being built to ACHD standards and specifications and to encourage central water and sewer when it becomes available. ALL AYE: MOTION CARRIED. Moved by WALKER to reconsider the previous motion regarding Ellison. Motion seconded by HAMMONS. ALL AYEz MOTION CARRIED. Moved by MINOW and seconded by YZAGUIRRE to include in the motion that the City of Eagle considers the road to be a driveway, as it serves one lot, rather than a private road. ADA COUNTY AMENDMENTS/PLANNED COMMUNITIES AMENDMENT TO ADA COUNTY ZONING ORDINANCE. Moved by MINOW and seconded by WALKER to approve the amendments. ALL AYEz MOTION CARRIED. UNFINISHED BUSINESS: ORDINANCES: Moved by MINOW and seconded by YZAGUIRRE to waive the 3 reading rule and consider Ordinance 174, a zoning ordinance, zoning property from A Agriculture to R-4 Residential, at this time. ALL AYE: CARRIED. seconded by WALKER to adopt Ordinance 174, a with a property description change as City Engineer, Larry Sale. ALL AYE~ MOTION Moved by MINOW and zoning ordinance recommended by the CARRIED. Moved by YZAGUIRRE and seconded by WALKER to waive the 3 reading rule and consider Ordinance 175, a zoning ordinance, zoning property from R Residential R-5 to R-9 Residential, at this time. ALL AYE: CARRIED. Moved by MINOW and seconded by WALKER to adopt Ordinance 175, a zoning ordinance as presented. ALL AYE: MOTION CARRIED. Findings of Fact and Conclusions of Law/ Eagle Point. Moved by MINOW and seconded by WALKER to approve the findings and conclusions as presented. ALL AYE: MOTION CARRIED. Findings of Fact and Conclusions of Law/ Hi Valley R.V. Park. Moved by MINOW and seconded by WALKER to approve the findings and conclusions as presented. ALL AYE: MOTION CARRIED. Findings of Fact and Con.clusions of Law/ Riverstone Townhouses/PUD-Rezone: Moved by MINOW and seconded by YZAGUIRRE to approve the findings and conclusions as presented. ALL AYE: MOTION CARRIED. Findings of Fact and Conclusions of Law/ City of Eagle Annexations~ Moved by MINOW and seconded by WALKER to continue the findings until the next meeting. All AYE.' MOTION CARRIED. MAYOR'S REPORT: Report given by Lt. Pat Cowles, Ada County Sheriff's Office. Three bids have been received for refinishing the senior hardwood floor. Moved by WALKER and seconded by MINOW to accept the bid from R&R Hardwood Floors, as the lowest bid at $850.00. ALL AYE: MOTION CARRIED. ATTORNEY'S REPORT: There are continued efforts to finalize the contract regarding the library with the Boise Library and Eagle Library Board. COMMITTEE REPORTS: None CLAIMS AGAINST THE CITY: Moved by WALKER and seconded by MINOW to approve the claims as presented. ALL AYE'. MOTION CARRIED.
