Minutes - 1990 - City Council - 08/28/1990 - RegularEAGLE CITY COUNCIL MEETING AUGUST 28 ,1990 The Eagle City Council met in regular session on August 28, 1990. Mayor GUERBER presiding. The following members were present: STEVE HAMMONS, RICK YZAGUIRRE, TOM MINOW. GARY WALKER: ABSENT. Moved by HAMMONS and seconded ~y MINOW to approve the minutes of the August 14, 1990 meeting as presented. ALL AYE.. MOTION CARRIED. PUBLIC HEARING/ 1990-91 Budget: Mayor GUERBER announced that this was the time and place set for a public hearing on the annual appropriation budget for the City of Eagle. Public Testimony: Nancy Amell, Mike Covalt Public hearing closed at 7:45 p.m. Motion to approve the budget will be included in the motion to approve the appropriation ordinance later in the agenda. PUBLIC HEARING/EAGLE POINT SUBDIVISION: Applicant.' Max A. Boesinger Location: SW corner of Floating Feather and Edgewood Ln. Proposal.. to rezone from A to R-4 for a single family subdivision for 125 lots. Subdivision to be 4 phases, 30 lots in the first and second phases, larger phases last. will connect to central water and sewer. Testimony: In favor.. Max Boesinger Larry Sale Opposed: Nancy Amell James Mumford (written and oral) Bud Debenham Concern was expressed regarding water, school room availability, drainage, and control through phases by leaving the agricultural usage until the time of development. Public hearing closed at 8:20 p.m. Moved by MINOW and seconded by YZAGUIRRE to approve a rezone from A to R-4 and the preliminary plat with the following stipulations, prior to final plat approval: 1. address the street drainage problem 2. access onto Pebblebeach 3. street lights 4. elevation differences ALL AYE: MOTION CARRIED. Moved by MINOW and seconded by YZAGUIRRE to consider Ordinance 168 at this time as HAMMONS must leave the meeting. ALL AYE: MOTION CARRIED. ORDINANCES: Moved by HAMMONS to have unanimous consent to waive the 3 reading rule. ALL AYE: Moved by MINOW and seconded by YZAGUIRRE to approve the budget, Ordinance #168 the Annual Appropriation Ordinance for 1990-91. ALL AYEs MOTION CARRIED. PUBLIC HEARING/HI VALLEY R.V. PARK-CUP: Applicants Wayne F. Freedman Location: Highway 55, formerly A.B. West property included in the annexations of 1990. Proposal: Conditional Use Permit to establish a R.V. Park and storage, 200 sites total, possibly a year-round park. Sewer will be accomplished by extending the sewer line established by Treasure Valley Village. No phasing proposed, want to have complete by summer 1991. Testimony: In favor: Wayne Freedman Carlyle Briggs Concern was expressed onto Highway 55. Public hearing/Title 8 Amendments: Mayor GUERBER announced that this was the time and place ~set for a publc hearing on the title 8 amendments to incorporate all of the design review area into both commercial and manufacturing zones within the city limits, and to amend the impact area terminology dealing with specific dates in the code. There was no public testimony and the public hearing closed. ORDINANCE #169/Amendment to Eagle City Code, Section 8-8-3 to provide for the application of certain Comprehensive Plan Amendments to the Eagle Area of City Impact. Moved by MINOW and seconded bY YZAGUIRRE to dispense with the three day ruling and consider the amendment at this time. ALL AYE: MOTION CARRIED. ORDINANCE 169: Moved by MINOW and seconded by YZAGUIRRE to adopt the ordinance as presented. ALL AYE: MOTION CARRIED. ORDINANCE 170/Repealing Section 8-2A-3, Eagle City Code, to include all business and manufacturing districts in the Design Review Overlay District. Moved by YZAGUIRRE and seconded by MINOW to dispense with the three day ruling and consider the repealing ordinance at this time. ALL AYE: MOTION CARRIED. ORDINANCE 170: Moved by MINOW and seconded by HAMMONS to adopt the ordinance as presented. ALL AYE: MOTION CARRIED. ORDINANCE 166: ELECTRICAL ORDINANCE, ORDINANCE 167: PLUMBING ORDINANCE: HAMMONS was excused at 9:00 p.m. Testimony given by: Gary L. Malmen and Joe Meyer, from the Dept. of labor and industrial Services, Joan Lyons, Lyons Plumbing, Dennis Butterfield, a Plumber from Nampa and Daunt Whitman, Building Inspector from Eagle. Proposals included exploring other city ordinances regarding electrical and plumbing inspections and permits. Council asked that more research be.done regarding the ordinances and then return to council for review when there is a quorum. Ada County Transmittals/Joplin and Breashers: The Council agreed to recommend approval on an informal basis of both transmittals to the county. ATTORNEY'S REPORT: The Boise City/Eagle Library contract is in the first draft stage, discussed the two amendments to Title 8, the definition of bars and definition of driveways. It was the general opinion .of the council that the definition of a bar should include the wording "on premises" and "off" premises and include restaurants that serve any kind of alcohol. CLAIMS AGAINST THE CITY.' The claims were reviewed by a quorum prior to HAMMONS absence, and were approved by general consent.
