Minutes - 1990 - City Council - 07/10/1990 - RegularEAGLE CITY COUNCIL MEETING JULY 10, 1990 The Eagle City Council met in regular session on June 10, 1990. Mayor GUERBER presiding. The following members were present: STEVE HAMMONS, RICK YZAGUIRRE, TOM MINOW. Absent: GARY WALKER. Moved by YZAGUIRRE and seconde'd by MINOW to approve the minutes of the June 10, 1990 meeting as presented. ALL AYE: MOTION CARRIED. PUBLIC HEARING/Eagle Ranch #5: Mayor GUERBER announced that this was the time and place set for a public hearing on Eagle Ranch #5, a subdivision application. Applicant: Location: Proposal: Rowland Jones/Robert DeShazo S. side of Ranch Dr., between Cedar and Evergreen To subdivide lot 2, block 3 of Eagle Ranch #2 into 4 lots and create Eagle Ranch %5 Public Testimony: IN FAVOR: Robert DeShazo Rowland Jones Glenn Hoff (written) OPPOSED: Mike Roach Public hearing closed at 7:50 p.m. DISCUSSION: A continuance of the problem dealt with in the subdivision application in 1989 has not yet been resolved. The problem in the 1989 public hearing was a dispute regarding ownership of the property. Council indicated, in 1989, that the problem needed to be resolved within a limited amount of time. The land has remained undeveloped for 11 years and it is the desire of the Council to see a development or playground. The Council will not settle the dispute between homowners and the developer. Moved by MINOW and seconded by HAMMONS to approve the application as presented with the condition that an indemnification agreement be established absolving the City of any cause as a results of the Cities acceptance to the proposal of the applic~ ~. ALL AYE: MOTION CARRIED. The City Attorney will draw up a indemnification agreement. It was also agreed that covenants with restrictions will be presented to the City by the Developer. UNFINISHED BUSINESS: Findings of Fact and Conclusions of Law/Empire Estates. Moved by YZAGUIRRE and seconded by MINOW to approve the findings and conclusions as presented. ALL AYE: MOTION CARRIED. Findings of Fact and Conclusions of Law/Auto Body Shop/Cullen. Moved by MINOW and seconded by YZAGUIRRE to approve the findings and conclusions as presented. ALL AYE: MOTION CARRIED. MAYOR'S REPORT: Mayor GUERBER' commented on the AIC report which commended the quick action of HAMMONS and wife as a team at an emergency situation at the Pocatello conference. ATTORNEY,S REPORT: The City Attorney has written Louis Mendiola regarding the empty, building at the corner Street. The possibility of ~ -~- of E~gle Rd. and State checked out by EPA authorities.
