Minutes - 1990 - City Council - 07/24/1990 - WorkshopEAGLE CITY COUNCIL I~O~ETING JULY 24, 1990 The Eagle City Council met in workshop session regarding the 1990-91 budget. The following members were presents HAMMONS, MINOW, YZAGUIRRE. Moved by YZAGUIRRE and seconded by MINOW to approve the preliminary budget as presented tonight and set the budget for public hearing. ALL AYEs MOTION CARRIED. The special meeting adjourned at 7~20 p.m. The Eagle City Council met in regular session on July 24, 1990. Mayor GUERBER presiding. The following members were present= STEVE HAMMONS, RICK YZAGUIRRE, TOM MINOW. Absents GARY WALKER. Moved by HAMMONS and seconded by YZAGUIRRE to approve the minutes of the July 24, 1990 meeting as presented. ALL AYE= MOTION CARRIED. PUBLIC HEARING/RIVERSTONEs Mayor GUERBER announced that this was the time and place set for a public hearing on Riverstone Townhouses/PUD-Ez. Applicant.. Location.. Proposals Robert DeShazo and Rowland Jones E. of Eagle Rd., N. and S. of Ranch Dr. Resubdivision of lot 12, block 1, and lot 1, block 3 of ER Sub #1, increase density for additional units (from 6 units to 9 units.) Public Testimony: Opposed.' John Kurtz, Denny and Kathy Freburg, Phil and Dewit Eartman, Jeff and Donna Weintraub, Henry Krewer. Public hearing closed at 7:57 p.m. Moved by HAMMONS and seconded by MINOW to approve the PUD/Rezone as R9 with the same conditions previously outlined in the 1989 PUD application. (attached) ALL AYE.. MOTION CARRIED. UNFINISHED BUSINESS.. Findings of Fact and Conclusions of Law/Eagle Ranch #5. Moved by HAMMONS and seconded by YZAGUIRRE to approve the findings and conclusions as presented. ALL AYE: MOTION CARRIED. MENDIOLA/EMPTY BUILDING DISCUSSION: Mr. Mendiola has asked for an extension of time on the city request to remove or bring the building up to code. Kay Francis, from the Department of Commerce spoke about the possibility of grant aid to remove the building and upgrade the downtown area. Ms. Francis spoke about the possibility of a LID to accompany the grant. The money would provide for upgrading of curbs, sidewalks, etc, and the LID would provide for the facelifting of the downtown area. The Council agreed to have Mayor GUERBER begin the LID process. The City Attorney will review the liability factors in giving Mr. Mendiola an extension of time after having declared the building a safety hazard. Moved by MINOW and seconded by HAMMONS to approve the requested extension subject to the determining the liability factor by the City Attorney, provided the owner will execute an indemnification of liability. AYE: HAMMONS, MINOW. NA¥~ YZAGUIRRE. MOTION CARRIED. PARK BID: The City has received a bid for the landscaping for Orval Krasen Park in the amount of $3,900. Moved by YZAGUIRRE and seconded by HAMMONS to table the discussion until the next meeting in order to get other bids. ALL AYE: MOTION CARRIED. Council asked the City Attorney to explore the lease agreement procedures and sale procedures on a small portion of Orval Krasen Park that a homeowner would like to maintain themselves. The City Attorney will present the findings at the next meeting. Larry Sale, the City Engineer, will survey Orval Krasen Park to establish boundaries for the landscaping later. A discussion regarding a storage building in back of City Hall was discussed. The results of the discussion was a motion made by MINOW and seconded by YZAGUIRRE to purchase a wood building kit, 8X12 for $569.00 and to place it on the back western portion of property. EAGLE RIDGE SUBDIVISION: Presentation by Dave Collins, Engineer for the project regarding road vacation of Eagle Ridge and variances needed to complete the project. ADA COUNTY TRANSMITTAL 90-38-PDR/30V: Christensen Subdivision: Moved by HAMMONS and seconded by YZAGUIRRE to approve the transmittal as presented. ALL AYE: MOTION CARRIED. ESCO/DESIGN REVIEW COMMITTEE: Presentation by LaRue Bevington, Design Review Committee member regarding the Esco project resulted in a motion by MINOW, seconded by YZAGUIRRE to approve the application with the conditions placed on the project by the Design Review. Those conditions are as follows: 1. submit accurate plans showing Phase 11 and phase 111, parking and access to State Street. 2. landscaping to be a continuation of existing, show on plans. 3. suggest 2 handicap parking spaces, marked. ALL AYE.. MOTION CARRIED. FABCO DISCUSSION.. discussion resulted in a motion made by MINOW and seconded by YZAGUIRRE to assign the Design Review Committee to review Fabco for landscaping and signage on an informal review basis. ALL AYE: MOTION CARRIED. ORDINANCE 166.. Electrical contractor/inspector Ordinance Moved by MINOW and seconded by YZAGUIRRE full reading and read by title only for Ordinance 166. ALL AYE: MOTIQN CARRIED. to dispense with the the first reading of ORDINANCE 167.. Plumbing contractor/inspector Moved by MINOW and seconded by HAMMONS to dispense with the full reading and read by title only for the first reading of Ordinance 167. ALL AYE.. MOTION CARRIED. APPOINTMENTS: Moved by MINOW and seconded by HAMMONS to appoint Bob Overfield as the City of Eagle electrical inspector, and for the Mayor to execute the contract. ALL AYE: MOTION CARRIED. Moved by MINOW and seconded by YZAGUIRRE to appoint Lynd Hoover as the City of Eagle plumbing inspector, and for the Mayor to execute the contract. ALL AYE.. MOTION CARRIED. ATTORNEY'S REPORT.. 1.
