MARCH 27, 1990
The Eagle City Council met in regular session on March 27,
1990. Mayor GUERBER presiding.
The following members were present: GARY WALKER, RICK
YZAGUIRRE, TOM MINOW. ABSENTs STEVE HAMMONS.
Moved by WALKER and seconded by YZAGUIRRE to approve the minutes
of the March 13, 1990 meeting as presented. ALL AYEs MOTION
CARRIED.
PUBLIC HEARING/City of Eagle Annexations:
Public hearing opened with a request from Mayor Guerber for a
presentation by Erv Sinclair, Chairman of the Eagle Planning and
Zoning Commission on the zoning recommendations for the City
annexations.
Mr. Sinclair indicated that Areas 5, 4 iA, 2, 6, 7 and 8
recommended zoning to be unchanged from what Council proposed and
was advertised. Area 3, the N. end, recommended zoning R1, the
remainder A. Area 1, the golf course, recommended is C-l, as it
is commercial in nature. The balance of area 1 would remain as
previously recommended, Eagle Hills East, R-5 and Evans
Subdivision R-1. Area 6 recommended frontage be zoned C-2 through
the back portion of Evans Lumber Company and Fabco, the balance
A. 6A is recommended the same the frontage, to 350 feet, to be
zoned C-2, the remainder zoned A. 7A, Randall Acres, the first
lots along State Street to be zoned C~2 and the remainder R-5.
There was public testimony by Victor Johnson. Mr. Johnson's
concern is the property behind the Trolley. The proposal was to
zone the area R-5 in order to permit a development. Now he
understands that P&Z has recommended a commercial zone.
There was no testimony in opposition.
The public hearing closed and opened to discussion by Council.
Moved by MINOW to annex properties as advertised, with the
exception of Eagle Hills Golf Course, which will be annexed
unzoned. Area 7 (the area behind the Trolley Restaurant) to be
zoned R-5 as previously advertised. Motion seconded by WALKER.
ALL AYE: MOTION CARRIED.
Discussion by Council, City Attorney, and the City Engineer on
procedure resulted in clarification that the property known as
Eagle Hills Golf Course would have to return to Eagle Planning
and Zoning and be re-advertised. Council recommendation to P&Z
is to zone the property R-5.
Moved by WALKER that Area 1, Eagle Hills Golf course, be zoned R-
5, not C-l, to re-publish and refer back to Eagle Planning and
Zoning Commission. Motion seconded by YZAGUIRRE. MOTION
WITHDRAWN.

Moved by MINOW and seconded by WALKER to annex areas 1-5 as
previously recommended. ALL AYE: MOTION CARRIED.
PUBLIC HEARING/MCCALLUM ANNEXATION AND ZONING
Mayor GUERBER opened the public hearing.
Mayor GUERBER called on Chairman Sinclair for Planning and Zoning
recommendations. Mr. Sinclair advised the Council that the lots
should be at least 1.6 and have sewer requirements, also they
would like to recommend 5 acre lots in an AR zone.
Testimony was heard by:
Richard Meirs-opposed to the project
Larry Sale, project representative-in favor
Mr. Sale advised the Council that the smallest lots would be 2-3
acres. The houses will be set away from streams and individual
wells and septic tanks proposed.
Mayor GUERBER closed the public hearing and opened discussion to
Council.
Moved by MINOW and seconded by YZAGUIRRE to annex the property
and zone it as R-1. The area is to be designated as an "area of
critical concern". ALL AYE: MOTION CARRIED. (reference Eagle

ADA COUNTY CIVIL DEFENSE: A transmittal was presented for a
proposed contribution of $814. for the coming year from the City
of Eagle.
AIR QUALITY BOARD: The current program expires April 1, 1990.
The request from the Board is to pass an extension of the
program. The Mayor recommended passing and extension to
12/31/90. Moved by MINOW and seconded by WALKER to extend the
Air Quality program as recommended. ALL AYE: MOTION CARRIED.
ADA COUNTY TRANSMITTAL 90-06-PDC/CROSLIN: Moved by YZAGUIRRE
and seconded by WALKER to approve the transmittal as recommended
by the Eagle Planning and Zoning Commission. ALL AYE.. MOTION
CARRIED.
FINDINGS OF FACT AND CONCLUSIONS OF LAW/ 1990 Eagle
Comprehensive Plan Amendments.. Moved by MINOW and seconded by
WALKER to approve the findings as presented. ALL AYE.. MOTION
CARRIED.
RESOLUTION 2-90/AMENDMENTS TO THE 1990 EAGLE COMPREHENSIVE PLAN..
Moved by MINOW and seconded by WALKER to approve the resolution
as presented. ALL AYE.. MOTION CARRIED.
MAYOR'S REPORT~ Mayor GUERBER advised the Council of a PUC
meeting to be held in the Eagle City Hall Council Chambers
regarding the Eagle Water Co. and encouraged everyone to attend.
City Hall has concluded the fire safety inspection. The
recommendation was to place a dead-bolt on the Senior side of
the hallway, this is not an exit so the exit sign was removed.
Also the combustible items in the storage room were removed.
Ada County approved 7 lots for Nahas subdivision, we recommended
9. The hall property was approved for construction next to the
Eagle United Methodist Church property.
PARKS.. Still planning for summer mowing and watering schedule
The committee to locate a doctor will be Chaired by Mayor GUERBER
and members included Gerry Mattison, Rick Yzaguirre and Tom
Minow.
Moved by MINOW and seconded by YZAGUIRRE to approve the Claims
against the City. ALL AYE.. MOTION CARRIED.
Moved by MINOW and seconded by YZAGUIRRE to adjourn the meeting.
