MARCH 13, 1990
The Eagle City Council met in regular session on March 13,
1990. Mayor GUERBER presiding.
The following members were present: GARY WALKER, STEVE
HAMMONS RICH YZAGUIRRE. ABSENT5 TOM MINOW.
Moved by WALKER and seconded by YZAGUIRRE to approve the minutes
of the February 27, 1990 meeting as presented. ALL AYE5 MOTION
CARRIED.

1990 Comprehensive Plan
by the Eagle Planning and Zoning are as
1. Page 25 (2) delete "and other more severe areas".
2. Page 115 (4) delete "flood Plains", insert "floodway", delete
"provided however, industrial use shall be allowed in a limited
area as specified by the Industrial Policies of the Land Use
section of this Plan".
3. Page 14: (5) delete all.
4. Page 205 (3) delete the word "large" in the first sentence
and change the paragraph to read: ~. "All new subdivision,
PUD'S, commercial/industrial developments with densities of more
than three single family dwelling units per five acres shall b~
required to: (A) be connected to a central sewer system, defined
as a system that connects all units to a central treatment plant
in a subdivision and prohibits all septic tanks. All sewer
systems must meet Central District Health standardsf (B) a
central water facility which is defined as a water system
approved by the Central District Health and the Eagle City
Standards and meets the requirements of fire protection provided
in the Uniform Fire Code as adopted by the City of Eagle".
Public hearing closed without public comment.
Moved by WALKER and seconded YZAGUIRRE to adopt the amendments
to the plan as recommended by Eagle Planning and Zoning with the
following change: 4. Page 20 (3) "All new subdivisions and
PUD's with densities of more than three single family dwelling
units per five acres, and all commercial/industrial developments
shall be required tos(A) be connected to a central sewer system,
defined as a system that connects all units to a central
treatment plant in a subdivision and prohibits all septic tanks.
Ail sewer systems must meet Central District Health standards.
ALL AYE.. MOTION CARRIED.
2010 TRANSPORTATION PLAN/APA.. Moved by HAMMONS and seconded
WALKER to adopt the plan as presented. ALL AYE.. MOTION CARRIED.
ADA COUNTY AMENDMENT/Planned Community.. Presentation by
YZAGUIRRE. YZAGUIRRE, Council man, and GERBER and TEWKSBURY,
from Eagle Planning and Zoning, attended the March 8th Ada County
Planning and Zoning meeting regarding the planned community
hearings. The Eagle Planning and Zoning voted to oppose the
amendment at the Eagle Planning and Zoning meeting of March 12,
1990. There are more meetings planned on this amendment,
YZAGUIRRE will try to attend the next meeting and report to
Council.
MEDICAL CENTER: Two written reports were received regarding the
Mountain States Health Corp. and Professional Practice
Management submitted written answers . Joan Sullivan,
Professional Practice worked with the Eagle Medical Center. She
indicated support for the clinic, adding the center would be self
supporting with proper management. Jim Trounson from Medical
Management gave a oral presentation to Council regarding a
medical center highlighting the following criteria on a public
funded medical center:
A medical center is justified for the population in Eagle
The center should not be subsidized by the City.
It would be doubtful that a vote of the residents would be
in favor.
Doctors need to take their own risks with financial
management.
Both Challis and Vale, Ore. failed with this concept
The concept would impede a long term solution
The opportunity exists now to look at private ways to
bringing a doctor or physician assistant, or satellite
clinic or an urgent care center, or another medical group
with a rotating doctor system
Private enterprise is really the only long term solution
It was established that a search committee will be formed in
conjunction with the Eagle Chamber of Commerce to locate medical
personnel to staff the center· The search committee will
.include YZAGUIRRE, WALKER AND MiNOW.
FINDINGS OF FACT AND CONCLUSIONS OF LAW/Lobdell Rezone.' Moved by
HAMMONS and seconded by WALKER to adopt the findings as
presented. ALL AYE: MOTION CARRIED.
FINDINGS OF FACT AND CONCLUSIONS OF LAW/Swanson Rezone.' Moved by
WALKER and seconded by HAMMONS to adopt the findings as
presented. ALL AYE.. MOTION CARRIED.
FINDINGS OF FACT AND CONCLUSIONS OF LAW/Edgewood Subdivision:
Moved by HAMMONS and seconded by WALKER to adopt the findings as
presented. ALL AYE~ MOTION CARRIED.
ORDINANCE #160: Swanson Rezone from R-5 to R-12. Moved by WALKER
and seconded by YZAGUIRRE to intact the dispensing rule and
consider Ordinance #160 at this time. ALL AYE~ MOTION CARRIED.
ORDINANCE #160: Moved by WALKER and seconded by YZAGUIRRE to
adopt the Ordinance as presented. ALL AYE~ MOTION CARRIED.
ORDINANCE #161~ Edgewood annexation and zoning. Moved by
HAMMONS and seconded by WALKER. to intact the dispensing rule and
consider Ordinance #161 at this time. ALL AYE~ MOTION CARRIED.
ORDINANCE #161: Moved by HAMMONS and seconded by YZAGUIRRE to
adopt Ordinance #161 as presented. ALL AYE: MOTION CARRIED.
EDGEWOOD SUBDIVISION: Dave Roylance, Engineer for the project,
approached the Council regarding some changes in the development
plan. Mr. Roylance advised the Council that the sewer proposal
is not viable to the development. Mr. Roylance asked the Council
to consider dividing and developing only a portion of the area.
If this concept is possible ACHD may not require some of the
curb, gutter, and sidewalk restrictions in that area. The
developers asked assistance from the Council with ACHD regarding
the problem. Moved by WALKER and seconded by YZAGUIRRE to
request of ACHD consideration to the development and not require
development of Edgewood in that particular area. ALL AYE=
MOTION CARRIED.
ATTORNEY REPORT: Mona Mack, Eagle City Attorney, advised
Council that a letter regarding a CUP requirement on the land
proposed for annexation for Eagle Land Co., has been received
inquiring about the need for a CUP. Discussion established that
a CUP was not thought to be automatically granted, but must meet
the criteria of the Code. The Council agreed that a M-3 zone
would meet the needs of the area in question, in which case, no
CUP would be required. Moved by WALKER and seconded by YZAGUIRRE
to recommend to the Eagle Planning and Zoning Commission to zone
that property and the Dowdy land M-3. ALL AYE: MOTION CARRIED.
GREENBELT COMMITTEE= YZAGUIRRE- the committee will be meeting
within the next two weeks.
LIBRARY: HAMMONS- reported that the Library has sewer problems,
they may have to revamp the sewer system. The Library may have
to be closed while Ann Gallinger is on vacation as there is no
back-up to keep it open while she is gone.
CENTENNIAL COMMITTEE: Trees have been donated and more requested
from the state. The committee is still working on fireworks.
PARKS: WALKER- We have received a $250. donation from the Eagle
Ranch Homeowners Association for tree trimming on the island on
Ranch Dr.
MAYOR'S REPORT: Mayor GUERBER reported on the progress of
legislation revenue to the cities and the medical facility
funding.
CLAIMS AGAINST THE CITY: Moved by WALKER and seconded by
YZAGUIRRE to accept the claims as presented. ALL AYE: MOTION
CARRIED.
Moved by WALKER and seconded by YZAGUIRRE to adjourn. The time
