Special Meeting Minutes
• August 29, 2014 1:00 P.M.
1. CALL TO ORDER: Mayor Reynolds calls the meeting to order at 1:15 pm.
2. ROLL CALL: BUTLER, MCFARLAND, KUNZ, RIDGEWAY(via phone)
3. EXECUTIVE SESSION: 67-2345 (f). Lagerstrom v. City of Eagle; Laguna litigation - City v. Jade
Properties, Laguna Pointe HOA, and Premier Properties.
Executive sessions -- When authorized. (1) An executive session at which members of the
public are excluded may be held, but only for the purposes and only in the manner set forth
in this section. The motion to go into executive session shall identify the specific subsections
of this section that authorize the executive session. There shall be a roll call vote on the
motion and the vote shall be recorded in the minutes. An executive session shall be
authorized by a two-thirds (2/3) vote of the governing body. An executive session may be
held:
(f) To communicate with legal counsel for the public agency to discuss the legal
ramifications of and legal options for pending litigation, or controversies not yet being
litigated but imminently likely to be litigated. The mere presence of legal counsel at an
executive session does not satisfy this requirement;
McFarland moves to go into executive session Idaho Code 67-2345 (1) To communicate
with legal counsel for the public agency to discuss the legal ramifications of and legal
options for pending litigation. Seconded by Kunz.
Roll Call Vote: MCFARLAND AYE; BUTLER AYE; KUNZ AYE; RIDGEWAY AYE
(VIA PHONE)...MOTION CARRIES.
Council goes into Executive Session.
Council discusses litigation.
Council leaves Executive Session.
4. ADJOURNMENT:
Kunz moves to adjourn at 2:00 pm. Seconded by McFarland. ALL AYE...MOTION
CARRIES.
