PRE-COUNCIL AGENDA: 5:00 p.m. - 6:30 p.m.
1. Beacon Light Road Scenario 1 "2013 +Entitled" Modeling Results. (NBS)
Planner Baird-Spencer displays a power point and provides an overview of the Beacon
Light modeling. General discussion. Council concurs to bring this back at the 1st
meeting in October for public comment.
2. Economic Study Report by the Building Contractors Association of Southwest Idaho.
Butler: when we get to amendments to the Agenda I will request that this be put on as
#9B.
3. Code Enforcement Officer's Report: Request for code additions and amendments to
clarify and better facilitate procedure for enforcement of city code.
Shawn Thomas provides Council an overview and discusses the Code Enforcement issues
he is working on. General discussion. Discussion on Draft Ordinance No. 724 which
would amend parking requirements, penalties and enforcement. General discussion. The
draft ordinances will be on the next City Council agenda.

1. CALL TO ORDER: Mayor Reynolds calls the meeting to order at 6: 45 p.m.
2. ROLL CALL: MCFARLAND, BUTLER, KUNZ, RIDGEWAY. All present. A
quorum is present.
3. PLEDGE OF ALLEGIANCE: Mayor Reynolds leads the Pledge of Allegiance.
4. ADDITIONS, DELETIONS OR MODIFICATIONS TO THE AGENDA:
McFarland: Susie Mimura has asked that we move Item #7D to the next meeting,
Concession Agreement with Superparks as she has not had time to confer to their
attorney. Seconded by Kunz. Ridgeway, I would ask that the Parks Master Plan be
moved to the next meeting. McFarland amends the motion to continue Item #7C
and #7D to the next Council meeting. Seconded by Kunz. THREE AYES: ONE

Butler moves to amend the agenda so that Pre-Council Agenda #2, Economic Study

5. PUBLIC COMMENT:
This time is reserved for the public to address their elected officials regarding
concerns or comments they would like to provide to the City Council regarding
subjects not on the agenda. At times, the City Council may seek comments/opinions
regarding specific City matters during this allotted time. This is not the time slot to
give formal testimony on a public hearing matter, or comment on a pending
application or proposal. Out of courtesy for all who wish to speak, the City Council
requests each speaker limit their comments to three (3) minutes.
Lisa Marie: I want to give you an update on the program to put homeless children to
work doing flower bundles; provides Council an overview of the program.
Tom Ferch, ACHD, the bridge on Eagle Road that crosses Dry Creek will be replaced in
2017 and the public can make comments on the ACHD website.
Theresa Johnson expresses her concern about the Council's approval of M3. Discusses
the issues of fire standards and the transportation issues that should have been addressed.
Also discusses rude comments that have been made by the Mayor and Council Members
at the meetings.
Cheryl Bloom, I live in the area of Eagle impact, discusses comments made by Mayor
Reynolds at the last City Council meeting about the residents of the impact area that do
not pay taxes to the City of Eagle.
Pat Minkiewicz, people of the area of impact don't pay your salaries but we are glad you
are up there. Discusses the M3 presentation by Mark Tate at that the last meeting. City
Attorney Buxton reads into the record an email that she sent to the City Council in
response to an email from Patricia Minkiewicz. General discussion.
6. CONSENT AGENDA:
♦ Consent Agenda items are considered to be routine and are acted on with one
motion. There will be no separate discussion on these items unless the Mayor,
a Councilmember, member of City Staff, or a citizen requests an item to be
removed from the Consent Agenda for discussion. Items removed from the
Consent Agenda will be placed on the Regular Agenda in a sequence
determined by the City Council.

♦ N. Appointment to the Historic Preservation Commission: Mayor
Reynolds is requesting the appointment of Mike Olsen to the Commission to
fill a vacated term. Mr. Olsen will expire in May 2015. (JDR)
♦ O. Re-appointment to the Planning and Zoning Commission: Mayor
Reynolds is requesting the appointment of Derek Smith to the Commission.
Mr. Smith's term will expire in September 2017. (JDR)
♦ P. Parks and Pathways Development Commission: Mayor Reynolds is
requesting the appointment of Lynn Moser to fulfill a vacated term. Mr.
Moser's term will expire in March 2015. (JDR)
♦ Q. Resolution 14- 17: Declaration of surplus property. (SKB)
Kunz I would like to pull Consent Agenda Item #6F Findings of Fact and
Conclusions of Law for CU-02-13/PPUD-04-13/PP-04-13 Alderwood Village No.2.,
seconded by McFarland; Ridgeway removes Item #M Minutes of August 26, 2014
from the Consent Agenda, seconded by McFarland; Ridgeway removes Items #6N,
O and P from the Consent Agenda, seconded by Kunz. ALL AYES: MOTIONS

Kunz moves to approve the Amended Consent Agenda, Items #A, B, C, D, E, G, H,
I,J, K, L and #Q but before moving on I would please note that respect to Item #6B
the Animal Control Contract with Idaho Humane Society for FY 2015 the amount
reflected should be $52,264 as indicated in the updated document and I would also
note that there has already been some amendments to the minutes of August 26,

Kunz the reason I requested that this be pulled is that in reviewing the draft Findings of
Fact with respect to the irrigation water and the 6' fence that is currently being taken
down there were some findings of fact that we added or approved that I have some
concerns about so I am wondering if Administrator Vaughan can put up those two. They
have since been rewritten to correct some of the concerns I have shared with them but I
just wanted to make sure the rest of Council is aware of how they have been restated.
PZ Administrator Vaughan displays the amended Findings and provides the Council an
overview of the two changes. General discussion.
Kunz: with the amended #27 reading "the applicant shall construct a 6' high solid
vinyl fence to be located adjacent to the western side of South Stephenson Way.

6M. Minutes of August 26, 2014.

General discussion on the minutes and the change of inserting the word"equal" into
Councilman Butler's Motion for Item #8A.

6N. Appointment to the Historic Preservation Commission: Mayor Reynolds is
requesting the appointment of Mike Olsen to the Commission to fill a vacated term. Mr.

60. Re-appointment to the Planning and Zoning Commission: Mayor Reynolds is

Ridgeway I pulled these items as we are working on the policy for appointments to
Boards and Commission and this will be on our next agenda. I would like to delay these
for a couple of weeks or do a temporary appointment so the entire Council can look at the
new language and approve it. General discussion.
Shawn Nickel, Chairman of the Historic Preservation Commission, we have been
operating with 3-4 members for the last several months and we would like to get this
position filled before our meeting tomorrow night as this does have a negative impact on
us. General discussion.

A. Discussion on crafting public participation language to be utilized on agendas
(SEB)
Mayor introduces the issue.
General discussion on an example of Public Comment Language submitted to the Council
for review By City Attorney Buxton. City Attorney Buxton will make the revisions
discussed tonight and bring this back on a future agenda.
B. Findings of Fact and Conclusions of Law for CU-01-14 Personal Wireless
Facility (Height-Over 35 Feet) Skyway Towers, LLC.: Skyway Towers, LLC,
represented by Shawn Nickel with SLN Planning, is requesting conditional use permit
approval for a camouflaged cell tower(defined as "personal wireless facility height-over
35-feet" in Eagle City Code). The proposed 2,500-square foot lease area is located
approximately 835-feet southwest of the intersection of North Eagle Hills Way and North
Wingfoot Place at the southern boundary of Eagle Hills Golf Course within the area
containing hole #2. This item was continued from the August 26, 2014 meeting.
Shawn Nickel as the representative for Skyway Towers we are requesting that we enter
mediation with the Council regarding this application. I did submitted a letter today to
Mr. Vaughan to request that request
City Attorney Buxton discusses the mediation process.
McFarland my motion would be that we agree to go into mediation and we agree
amongst ourselves which two of the Council Members would be involved in that
mediation. General discussion. Ridgeway,would you consider making the motion
to enter into mediation as required by 67-6510? McFarland concurs. Seconded by

General discussion on which Council Members will attend the mediation. Council
concurs that Council Member McFarland and Kunz will be attending.
Publication on the notice of the mediation will be a press release, putting the notification
on the website, notify everyone who provided input and notice to the HOA's that are
involved. McFarland and Kunz will work with the Clerk's Office on notification.

into to an agreement with The Land Group, Inc. to complete a parks, recreation and trails
master plan study for Eagle Parks and Recreation Department—Not to exceed $80,000.

Public Hearings are legally noticed hearings required by state law. The public
may provide formal testimony regarding the application or issue before the City
Council. This testimony will become part of the hearing record for that
application or matter.
A. CU-03 -14 - Storage (Enclosed Building)—Boardman 55 LLC: Boardman 55,
LLC, represented by Ron Ramza, is requesting conditional use permit approval for a
storage facility (enclosed building). The 8.4-acre site is generally located on the west side
of North Horseshoe Bend Road approximately 725-feet south of West Hill Road. (WEV)

Mayor: Does anyone on Council have any potential or actual conflict of interest?None
Eric Anderson, representing the applicant, provides the Council an overview of the
application.
PZ Administrator Vaughan displays a site map, a site plan and a copy of the elevation and
provides the Council an overview of the application. The Planning and Zoning
Commission recommended approval and this application will go through Design Review.

McFarland. Discussion. Butler: Condition #13 shall be added that says "Cross
Access between the parcels as specifically recommended by ACHD shall not be

A. FPUD-07-14—Final Development Plan for Chateau des Fleurs (also known as
Camille Beckman Commercial Industrial Planned Unit Development—Phase II)—
SAF, LLC.: SAF, LLC, represented by Dana Kauffman/Joe Bruce with Insight
Architects, is requesting final development plan approval for Chateau des Fleurs (also
known as Camille Beckman Commercial Industrial Planned Unit Development—Phase
II). The approximately 22.5-acre Phase II site is generally located south of West Lilac
Lane in proximity to the southeast corner of State Highway 44 and Old Valley Road.

Kunz: I know the Roghanis quite well and I have not had any ex parte communication
with the Roghanis on this matter and I do not have any financial interest in it whatsoever
so I am presuming that I have no conflict of interest even though I know the Roghanis.
City Attorney Buxton: You would not be too biased in favor of them that you would
ignore the City Code? Kunz response: No.

presentations and discusses the same. General discussion.
10. EXECUTIVE SESSION: Pending & Threatened Litigation 67-2345 (f) (MLB)
67-2345. Executive sessions -- When authorized. (1) An executive session at
which members of the public are excluded may be held, but only for the
purposes and only in the manner set forth in this section. The motion to go
into executive session shall identify the specific subsections of this section
that authorize the executive session. There shall be a roll call vote on the
motion and the vote shall be recorded in the minutes. An executive session
shall be authorized by a two-thirds (2/3) vote of the governing body. An
executive session may be held:
67-2345 (a) To consider hiring a public officer, employee, staff member or
individual agent, wherein the respective qualities of individuals are to be

evaluated in order to fill a particular vacancy or need. This paragraph does not
apply to filling a vacancy in an elective office or deliberations about staffing

67-2345 (f) To communicate with legal counsel for the public agency to
discuss the legal ramifications of and legal options for pending litigation,
or controversies not yet being litigated but imminently likely to be
litigated. The mere presence of legal counsel at an executive session does
not satisfy this requirement;

Butler moves to authorize the Mayor to sign the Settlement Agreement between the
City of Eagle and Laguna Pointe Home Owners Association; that we authorize the
Mayor to sign the License Agreement between the City of Eagle and Laguna Pointe
Home Owners Association; that we authorize the Mayor to sign the Agreement
between the City of Eagle and Lagerstrom, the Settlement Agreement,when Susan

Dear Eagle City Council members and mayor,
I attended the August 26 CCouncil meeting and was surprised to learn the Star fire department has
jurisdiction of Spring Valley Phase One in the Eagle foothills. Hopefully, Star will do a good job for
the Phase One home buyers.
FYI, recently I received the following Email report from an attendee of that meeting, concerning
official agency sign -offs of Phase One, particularly the fire protection aspect. I would think Star
would want to follow code and need a fire apparatus access road (see report, below).
The Email message/report I received from the attendee regarding M3Co-Phase One Spring Valley
August 26 Agenda item:
"There is grave concern over the fire safety of the development. Both the Eagle Fire Captain and
Eagle District Fire Marshall were in attendance at the special meeting and told our City Council they
would not sign off on the development without a second paved road in/out of the development. As it
stands there is only one way in and out of the community that violates the standards set by 2012
International Fire Code/fire apparatus access roads for developments of over 30 homes. Our own
Mark Butler asked specifically of our City Attorney, "so are we going to accept the letter from the
Star Fire Chief signing off on this?" Susan [Buxton] responded with a nod of approval. No one bothered
to take a look at the undated letter from the Star Fire Chief attached to the ACHD memo of April 23,
2014. Is this even a valid letter?"
Can Council verify that an emergency paved road will be put in by M3Co either before or during
Phase One construction? Mark Butler's question was apt; however, the city attorney's mere nod
needed clarification on August 26. A spoken professional response on the Record, with some detail,
would have been a better legal response to a question of correct procedure, don't you think? As it is,
it now looks like adherence to correct procedure and transparency continue to be a challenge in City
Hall and continue to undermine public Trust in Eagle's elected officials and city attorney. Many
Eagle community residents have witnessed/read about this unfortunate transformation since the
new Council and mayor took office in 2012. One would think the city attorney would want to help
turn around the perception, rather than add to it.
Someone or I might bring up the M3 Phase One "fire apparatus access road" issue during Public
Comments at the next Council meeting, so that Council will have an opportunity to
address the procedural concern for the Record.

As we have been discussing the Skyway Cell Tower application currently pending before
the City of Eagle, Idaho, I put together a short memo outlining some procedural options for you
and your clients to consider. I remain open to discussion of this matter but since the public
hearing and the record are closed, these statutory measures limit the options available for the City
to be able to consider changes to the project. The memo is meant to provide general guidance.

Mediation Process --IC 67-6510
The City of Eagle ("City") has conducted several mediation sessions based on requests from land use
applicants and affected persons as allowed under the authority of IC 67-6510.
1. Mediation may occur at any point during the decision-making process. Since the Skyway
application has had its public hearing and an oral decision, the City is in the process of drafting
their written findings on the application. Once those findings are presented to the City Council
in a public meeting, approved, and signed by the Mayor, the decision would be considered to be
final. Until that occurs, mediation would be considered if a request is received by the City. If
mediation occurs after a final decision, any resolution attained during mediation would be
subject to another public hearing by the City.
2. If the mediation is requested by the City Council, the Applicant and any other affected persons
objecting to the application "shall" participate in at least one mediation session. The City has
undertaken this step on previous occasions but I do not believe they would take this step in this
application.
3. The City "shall" select and pay the expense of the mediator for the first meeting of the
"interested parties." Eagle has interpreted "interested parties" to include the applicant,
affected persons and the City. Compensation of the mediator beyond that first meeting is
required to be established at the outset of mediation. Various arrangements have been made
for this in the past. Often, the City Attorney and legal counsel for the applicants (and interested
parties if they have counsel) agree to informal mediation with the City Attorney presiding. This
keeps the costs down and has proven to be effective.
4. Statutes of limitation and other time limits are tolled during mediation. See 67-6510(3).
5. The City has used the following Informal Mediation Ground Rules in the past when no mediator
is utilized as described in item 3 above.
a. The participants are assigned meeting rooms at City Hall and all present at any
mediation session is required to sign in and out.
b. Mediation sessions are not recorded as they are not part of the official record for the
application being mediated. See 67-6510(5).
c. The City Attorney or its designee has the duty to preserve a sufficient record of the
discussion to disclose ex parte communications with any City Council members present
at the mediation. The identity and content of the ex parte discussion shall be
memorialized for the purpose of providing such information in the public hearing, if one
is held, if there is a resolution resulting from the mediation that is presented for a final
decision before the City Council.
d. The mediation will not result in an "agreement" as no participant would be required to
pledge to support or oppose the application. City Council participants are specifically
not required nor allowed to support or oppose any compromise during the course of
mediation. As such, the City Council participants must disclose their ex parte
communications in the subsequent public meeting addressing the application.

e. City Council participants must disclose any conflicts of interest as described in IC 67-
6506. If a conflict of interest exists, that City Council member may not participate in a
decision on the application and the resolution that was a result of the mediation.
f. Interpretation of the City Code and applicable laws related to the application is quasi-
judicial.
g. Communication with the media is discouraged during the mediation process to avoid
chilling participation of the participants. Statements to the press be limited to reporting
the status of the application made solely through the City Attorney or their designee.
h. All participants may have reasonable and convenient access to the public record
compiled for the application. Such access shall be arranged through the City's planning
department.
i. A written summary of the mediation shall be compiled by the City Attorney or its
designee that fairly captures the substantive issues explored by the participants without
unnecessarily disclosing the internal dynamics of the debate. The written summary shall
be a public record and will include the names of the participants but will not be part of
the record of the application. Such summary may be used to present the resolution
presented at the public hearing held pursuant to IC 67-6510(1) but will not be part of
the record.
Reconsideration Rectuired Prior to Judicial Review -- IC 67-6535
Any applicant or affected person seeking judicial review of decisions of the City related to the Local Land
Use Planning Act (Title 67, chapter 65, Idaho Code) must first seek reconsideration of the final written
decision of the City within fourteen (14) days. A written request for reconsideration "must identify
specific deficiencies in the decision for which reconsideration is sought." IC 67-6535(b).
A reconsideration request will be conducted in a duly noticed public meeting before the City Council. If
the decision is reversed or modified, it would be subject to a public hearing at a later public meeting of
the City Council.
The decision may be affirmed, reversed or modified and a written decision must be made within 60 days
from receipt of the reconsideration request. The 28 day time frame for seeking judicial review is tolled
until the date the written reconsideration decision is issued "or the expiration of the 60 day
reconsideration period, whichever occurs first." Id.

C. Definitions:
1. Fire Lane. A Fire Lane shall be
an area adjacent to a business on
private property or which is clearly
marked with a red curb with
appropriate signs located at each end
of the curb or at one hundred foot

and designating the area to be a fire
lane.

of the vehicle.
Enforcement and Penalties

1. It shall be the duty of the sheriff, deputy sheriff, code
enforcement officer, fire marshal, or any other
individual designated by the city council, upon
observing a motor vehicle or motor vehicle and trailer,
parked, standing, or stopped in violation of the
provisions of this Section, to leave upon such vehicle a
separate parking ticket as frequently as every hour that
such vehicle has been parked, standing, or stopped in
violation of the provisions of this Sections.
Enforcement and Penalties
2. In addition to the issuance of a citation as provided
herein , any vehicle found parked in violation of this
Section or is otherwise Mocking the emergency apparatus
access route such owner or operator shall be liable for the
expense incurred by the City for towing or otherwise
removing said vehicle and all other reasonable expenses for
storage charged by the company removing said vehicle and
causing said vehicle to be stored.
3. Violation of this chapter shall be an infraction pursuant
to Idaho Code Section 18-113A and punishable by a fine of
one hundred ($ioo) dollars.

Growth Assumptions
2013 with Entitled Growth Only: Under this scenario. no new growth/development is allowed in any of the transportation analysis zones
(TAZ) along Beacon Light Road and into the Foothills. All TAZ(s) are kept at the 2013 levels (population, households and jobs) except
those with existing entitlements. The model will show build -out of all existing entitlements (approved subdivisions and development
agreements).

% Chanae to ?040 (Dpdv. Peak and Peak Directional) - Comparison to the 2013 + Entitled Model Run 1 which is bosed on the ACRD
Draft Northwest Foothills Plan and the COMPASS 2040 funded network in Communities in Motion.
ACHD LOS Pass/Fail - Applies ACHD LOS Standards from the March 6, 2013. ACHD 2012 Capital Improvement Program (CIP) for Minor
Arterials. Collector standards were applied as 550 vehicles/hour/single direction travel lane. The trigger for pass/fail was the threshold
for LOS E. If a road performed better than LOS E. it is classified as a pass; if worse than an LOS E, it is classified as a fail.
