Minutes - 2014 - City Council - 08/26/2014 - Special EAGLE CITY COUNCIL Special Meeting Minutes August 26,2014 INVOCATION: REGULAR COUNCIL AGENDA: 5:30 p.m. 1. CALL TO ORDER: Mayor Reynolds calls the meeting to order at 5:35 p.m. 2. ROLL CALL: MCFARLAND, BUTLER, KUNZ, RIDGEWAY. All present. A quorum is present. 3. PLEDGE OF ALLEGIANCE: Mayor Reynolds leads the Pledge of Allegiance. 4. ADDITIONS,DELETIONS OR MODIFICATIONS TO THE AGENDA: McFarland moves to add Item as#6N to the Consent Agenda the Regence Blue Shield contract for staff medical insurance. The savings over last year's contract amounts to$53,630 so hopefully since this a savings we can move this to the Consent,also Item#7B the Findings of Fact and Conclusions of Law for Personal Wireless Facility the applicant has requested this be continued to September 9, 2014 meeting, and when we get to 6:30 if we can look at where we are before the Public Hearings,I might entertain a motion from the Council to move anything that has not made it to the 6:30 point to move these items past the Public Hearings. PUBLIC COMMENT: This time is reserved for the public to address their elected officials regarding concerns or comments they would like to provide to the City Council regarding subjects not on the agenda. At times, the City Council may seek comments/opinions regarding specific City matters during this allotted time. This is not the time slot to give formal testimony on a public hearing matter, or comment on a pending application or proposal. Out of courtesy for all who wish to speak, the City Council requests each speaker limit their comments to three (3) minutes. Kathy Pennisi, I have some prepared comments I am going to share with you. Reads her comments into the record. I attended the ACHD Meeting where your decision to rescind the roundabout vote was discussed. What we need is courage and leadership from you, our elected representatives. I'm asking the Council to address transportation issue on a city-wide level, rather than the status quo piece-meal efforts. We need to develop a true vision of how to move people throughout our entire city. General discussion. 6. Ridgeway, I really just had a question for Mr. Aho. On the June 30th minutes there was an item there talking about the Lacrosse contract and it has been about 60 days and I'm wondering if we could get an update? Park/Rec Director Aho, I have similar contracts from other cities that I have been reviewing. I talked to Tom last week and updated him. It has been overwhelming with the closing of the summer programs. The very earliest for the Lacrosse would be the 3rd week in September. Ridgeway moves to accept the minutes of June 30, 2014. Seconded by McFarland. ALL AYES: MOTION CARRIES 6M. Parks, Recreation and Trails Master Plan Agreement—Authorization to enter into to an agreement with The Land Group, Inc. to complete a parks, recreation and trails master plan study for Eagle Parks and Recreation Department—Not to exceed $80,000. (MA) McFarland, I just wanted to go on the record that I am opposed to the expenditure of $80,000 for a Master Plan, I believe we could better utilize that money with full staff. Butler, I won't be voting for this either. $80,000 seems extreme. The Land Group is a fine company and I think they would do an excellent job. I think we should use our own staff or put the money toward staff. Ridgeway moves to approve the Parks,Recreation and Trails Master Plan. Seconded by Kunz. General discussion. City Attorney Buxton, you have an RFP and I would like you to table this to the September 9, 2014 meeting so I can review the RFP. Further discussion. Ordinance 722—Appropriation Ordinance for the City of Eagle for Fiscal Year 2015: An ordinance entitled the annual appropriation ordinance for the City of Eagle, Idaho, for the fiscal year 2015 commencing October 1, 2014, and ending September 30,2015, appropriating sums of money in the aggregate amount of$13,463,415.00 to defray all necessary expenses and liabilities of the City of Eagle for said fiscal year; specifying the object and purposes for which such appropriations are made and the amount appropriated for each object and purpose; authorizing the certification to the county commissioners of Ada County, Idaho, to levy and assess a sufficient tax upon the taxable property in the city; providing for the filing of a copy of this ordinance with the Office of the Idaho Secretary of State as provided by law; providing for publication; and providing an effective date. Findings of Fact and Conclusions of Law for CU-01-14 Personal Wireless Facility (Height-Over 35 Feet) Skyway Towers,LLC. Skyway Towers, LLC, represented by Shawn Nickel with SLN Planning, is requesting conditional use permit approval for a camouflaged cell tower (defined as "personal wireless facility height-over 35-feet" in Eagle City Code). The proposed 2,500-square foot lease area is located approximately 835-feet southwest of the intersection of North Eagle Hills Way and North Wingfoot Place at the southern boundary of Eagle Hills Golf Course within the area containing hole#2. This item was continued from the July 22, 2014 meeting. (WEV) Continued to the September 9,2014 by the above Motion. C. Staff update (Mike Aho Park & Recreations Director/Susan Lynne Mimura Conflict City Legal Counsel) regarding Eagle Superparks LLC/Eagle Sports Complex Concessions Agreement concerns being addressed by Mayor Reynolds. Mayor introduces the issue. Conflict Attorney Mimura provides Council an overview of the Concessions Agreement and the issues of non-compliance to the Agreement and the State Work Comp issues. General discussion. Ridgeway moves to send the 5 day letter and if we get the bond posted then we keep rolling, if we don't get that done then that is termination. Seconded by Butler. General discussion. Ridgeway discusses the utility bills and the concession fees that were to be paid to the City. General discussion. Kunz would ask that Councilman Ridgeway consider amending his motion to allow sending a letter to Mr. Neptune and his attorney of record insisting that the $15,000 reclamation bond be posted to the City no later than September 5th. Seconded by McFarland. Kunz: Mr. Ridgeway would have to amend his motion. General Discussion on Ridgeway amending his motion. Mayor if there is no further discussion let's have a roll call. McFarland: NAY; Butler: I'm not secure enough on 4.5 to vote on my second. I have to withdraw my second until I digest 4.5. Butler moves to postpone this until after the Public Hearings. THREE AYES: ONE NAY: MOTION CARRIES McFarland moves to move Item#7E Beacon Light Road Scenario to follow the public hearings or Nichoel has a synopsis that she is willing to give otherwise she has a 32 page power point that could take quite a while. Kunz, as Ms. Pennisi has indicated ACHD is inclined to continue widening to 5 lanes Eagle Road between Albertsons and old State. I would like to propose at least 4 steps. The first one, I think we need to identify the stakeholder group and that the group needs to be expanded to include stakeholders who may be adversely affected by the proposed alternative or solution. Step two would be to relative prioritize the criteria and if necessary to reprioritize the performance of each intersection alternative on each criteria. Step three would involve using both sets of prioritization to identify the preferred intersection alternative. Step four would involve conducting sensitivity analysis. That would be my proposed next step. E. Beacon Light Road Scenario 1 "2013 +Entitled" Modeling Results: (NBS) Mayor introduces the issue. Planner Baird-Spencer: presents a quick where we are at and the conclusions. Displays a power point of the Beacon Light Modeling and discusses the same. General discussion. 8. PUBLIC HEARINGS: Public Hearings are legally noticed hearings required by state law. The public may provide formal testimony regarding the application or issue before the City Council. This testimony will become part of the hearing record for that application or matter. A. CU-02-13/PPUD-04-13/PP-04-13 Alderwood Village No.2 Planned Unit Development—Tealey's Land Surveying: Tealey's Land Surveying represented by Pat Tealey, is requesting conditional use, preliminary development plan, and preliminary plat approvals for Alderwood Village No. 2 Planned Unit Development, an 18-lot (15- buildable, 3-common) residential subdivision. The 4.7–acre site is located at 947 W. State Street approximately 430-feet west of South Grandean Way. (WEV) Mayor introduces the issue. Mayor: Does anyone on Council have any exparte contact to declare? None Mayor: Does anyone on Council have any potential or actual conflict of interest? Defayette: I did have a conversation with someone in my neighborhood and when I found out it was on the agenda I asked her to come to the meeting say what she had to say. Pat Tealey, representing the applicant, provides an overview of the application for the Council. General discussion. Planner Williams provides Council an overview of the application. The PZ Commission has recommended approval. General discussion. Kurt MacClenny, Deputy Chief Fire Marshal for the Eagle Fire Department, discusses the Fire Department Letter and states that this does met the dimension in the 2012 International Fire Code for turning around there and it does need to be posted, the dimensions are there. We approved that layout. Further General Discussion. Mayor opens the Public Hearing Wayne Swanson, 985 W. State Street, of major concern is that I don't want that stuff on my side; I want private fencing on my property. One of the concerns is security and when that fence comes down there is no security. I asked for a 6' fence. Coming down the lane I have irrigation water and I would like to use that water to irrigate my property. Another concern is that the vacant lot gets full of cars and if I don't have a fence they will end up on my property. Discussion on access for the Fire Department. General discussion. Ridgeway: Mr. Swanson is a good friend of mine so I need to get some direction from the City Attorney. City Attorney Buxton: Do you have any bias in favor of Mr. Swanson so that you would vote the way he testified or will you be able to look at the application and apply the facts to the City Code fairly and impartially or would you be too swayed by him so that you would be unable to be impartial? Ridgeway: I think I can be impartial. City Attorney Buxton: you don't have any pecuniary interest or business dealings with Mr. Swanson that would cause you to have any unfair basis in his favor? Ridgeway: No. Kunz: I actually own a home that Mr. Swanson built years ago in a different subdivision. Is that in any way a pecuniary interest? City Attorney Buxton: Has Mr. Swanson's building construction caused you any bias in favor or against anything that he says here tonight? Kunz: I would safely say that it has not. McFarland: I talked to Mr. Swanson at Council for 30 seconds here in front of everybody but I think I can be impartial. Michelle Dell-Celli, 153 S. Grandean Way, I am on the Board of our HOA, it doesn't seem that Mr. Tealey gave the correct impression. We have met and have expressed our concerns. They have met with the HOA and the HOA voted not to allow them to become a part of the HOA. Displays pictures and discusses the same. If the fence wasn't up we would have to look at all of Mr. Swanson's farm equipment. He also burns and I wouldn't want to watch his burn. Rick Anderson, 191 S. Grandean Lane, I am the President of the HOA, the HOA met with Mr. Tealey on May 29`''of last year and we asked for compensation on removing the fence and we also asked them to increase the width of the alley and his response Page 6 K:\COUNCIL\MINUTES\Temporary Minutes Work Area\CC-08-26-14min.doe was "the City does not require that". We are opposed to progress at our expense. This year we invited the developer to meet with the HOA Board to resolve these issue and there has been no response. Displays pictures of the existing berm and discusses the same. Why is the new development not held to the same standard? A 4' berm is not going to hide State Street. Dave Yorgenson, representing the Applicant, I was the presenter to the Design Review Board and the 4' berm was allowed as you can not put a larger berm in the wetlands. Discusses the concerns about the alley and the fence. General discussion. Pat Tealey, representing the applicant, discusses the berm, fence and emergency access. I think the berm has been adequately answered by Mr. Yorgenson. Irrigation will be supplied to Mr. Swanson. We have the same parking issues as Alderwood has. There is no enhanced security that won't be replaced by our development. The security will be there as it is now. Discussion on a larger alley, we don't want to promote parking in the alley. Butler moves to approve CU-02-13/PPUD-04-13/PP-04-13 Alderwood Village with all the Site Specific Conditions of Approval recommended by the Planning and Zoning Commission, understanding that the 4' berm as recommended by the Design Review Board meets our Code because the cross-sectional details as stated to herein show that there is at least 10' from the center line of the road to the top of the berm, meeting the Code, and adding Condition No. 26 that the applicant work with Mr. Swanson and provide some sort of an agreement from Mr. Swanson that the irrigation water is going to be provided to his property in a manner equal to or exceeding, but at least equal to how it is being provided to his property now with that agreement being reviewed and approved by the City prior to providing final plat review; that along the West boundary of the property a three rail vinyl fence be put in to provide a semblance of crossing into private property. General discussion. Butler amends the motion to allow barrier wire on the fence if agreed to between the developer and the adjacent property owner, Mr. Swanson. McFarland I would make a similar motion that along South Stevenson Street is a 6' privacy fence similar to what will be removed; this is with Mr. Butler's conditions. Seconded by Butler. PP-06-12 - Spring Valley Subdivision No. 1 —M3 Companies,LLC: M3 Companies, LLC, is requesting preliminary plat approval for Spring Valley Subdivision No. 1, a 217-lot (190-buildable, 1-waste water treatment, 1-domestic well, 22-common, and 3-future phase) subdivision. The 346.77-acre site is generally located on the east side of State Highway 16 approximately 0.6-mile north of West Beacon Light Road. Mayor: Does anyone on Council have any exparte contact to declare? Butler we all have received emails. Mayor: Does anyone on Council have any potential or actual conflict of interest? None Mark Tate, M3 Companies, displays a power point of key items that have been heard over the last few years and discusses the same. We are not here tonight to discuss the whole project that has already been done. Joanne Butler, representing the applicant, this has been a process that has gone on for 8 years and we are here for the PUMP and the Preliminary Plat. The Planning and Zoning Commission has recommended approval. Discusses the sewer treatment plant. I know there has been a request for a site visit but until the application is done we really can not do that. Discusses the procedural due process and the Supreme Court decision. We meet the conditions of approval and the only condition that we have a problem with is No. 14. General discussion. City Attorney Buxton, I have provided you with a Memorandum this evening in regards to a Council site visit to the property; discusses the Memo. This site visit would need to be recorded as you have to have a record that can be transcribed. Planner Baird-Spencer, we are going to have a tag team presentation, I have been the project manager for M3. Provides Council an overview of the PUMP application. Staff does recommend approval of the PUMP. Planner Williams, the Planning and Zoning Commission did recommend approval of the Preliminary Plat. Some of my comments come out of being an expert. Council discussion on the signup sheet. I submitted written comments to you last week. There haven't been any changes and what I said I believe in. Discussion on where he disagrees with staff. Discusses the HOA, the Master Street Plan, the PUMP, and the reused water. The original vision seems to have shifted. Discusses the financial forecast for the project and the City providing public services. General discussion. Logan Schirmer, 4430 N. Bella, I heard their attorney tonight threaten the City if you do not approve this tonight. Brownlee knows that I was a strong supporter of this project until November 2013 when I first heard about where the sewer was going to be located. This area was supposed to be an equestrian center. I meet with Lynn Moser with the Sewer Department and they said the City owned 1,000 acres around this area and he also told me that the City Council can tell them where to put the sewer. Discusses the access to the property, the speed limit and the traffic. Also discusses the water and the sewer plant. Linda Hamilton, 4210 Double S. Lane, I have several continuing concerns. I am concerned about the water situation and the water rights which were turned over to the City. Discusses having trouble with her well. I'm also concerned with ingress and egress. Displays a photo of a fire that burned 3,000 acres. I think an evacuation plan should be in place. Discusses ingress and egress and the sewer plant. Kent Hamilton, 4210 Double S Lane, we sent a letter in that had 4-5 major concerns. Discusses the water and the ingress/egress. General discussion. Jaylene Groeninger, 2537 N. Big Sky Place, I'm going to read a letter on behalf of the Friends of Beacon Light Road/Friends of Eagle. Kunz: this is already in the record I would ask that we limit this to 3 minutes and choose the most important points. Jaylene discusses the highlights. We feel you are setting the procedure of future development and we feel you need to have someone who is overseeing this vision from beginning to end. Discussion on the arterial road that will run to Willow Creek. We need to have input in the future decisions that the City is going to make. Doris Schirmer, 4430 N. Double S Lane, and Matt Schirmer, 3608 S. Brandford Way, I do pray that you give careful consideration before you make your decision tonight. Chief Winkle, when this initially came through we were in a Joint Powers Agreement with Star Fire District. At that time period we had written a letter on the initial access and we were asking for a secondary access with an all-weather surface. Later the letter came through and our Joint Powers Agreement and our management at Star terminated. So there is a little bit of gray area. For us we do agree there needs to be a secondary access for this development. I don't know if we agree that an all-weather surface is a gravel road. We deem an all-weather surface to be something that is paved, concrete or asphalt. There is a secondary access and so long as it is improved this is as far as we can go with it not being within our Fire District and not having jurisdictional authority. General discussion. My recommendation is an addendum to the contract. I have had a telephonic conference with the Knox McMillian as well as his client. In order to get the performance bond he has to have the plan approved and it is currently pending with the City staff waiting for him to submit new plans. It is my understanding after speaking with Mike Davis and Vern that the minimum amount of time for the City to review and approve the plan is 10 days. In order for him to be bonded he needs to have a plan. The original startup date for this Contract was going to be prior to Thanksgiving of 2013; this was signed October 9th so had he been able to get all of this ducks in a row and be opened before Thanksgiving he would have been well within the performance bond time and would have had his permitting by then. Mr. Knox also said as to the Worker's Comp they are arguing over a couple of days of non-coverage with the Department. He wants the Council to know that one of the issues is there may have been a lapse, however, it has been cured. General discussion on amending the contract and the performance bond. During that discussion commissioner Jim Hansen made some very enlightening comments. If you remember, Commissioner Hansen voted against the motion for the roundabout that was ultimately passed. Why? Because it didn't go far enough in aligning with the City's request for Eagle Road. He wanted to accommodate Eagle by removing preservation of 5 lanes on Eagle road from the CIP. In other words, Eagle provides the vision, ACHD acts on that vision. He gets it! Now what we need is courage and leadership from you, our elected representatives. Leadership - to embrace and engage the community that wants to participate in creating that vision and proposing solutions for moving people around our City. Courage — to hold fast to that community vision and insist on preservation of our quality of life, no matter how intense the pressure. What I am asking the Council for tonight, is to address transportation issues on a city- wide level, rather than the status quo piece -meal efforts we have seen to date. All these transportation issues are connected. Perhaps it is time we join forces as a community and develop a true vision of how to move people throughout our entire city. We don't have to recreate the wheel either. Other communities have tackled these same issues. We can partner with groups such as Idaho Smart Growth to organize a working committee that can provide Council with a vision and policy recommendations that can be vetted in the public arena. Yes this will take time, but by combining efforts and getting public buy in from the start, we can avoid the roundabout -type drama that tears us apart and create a vision we can all rally behind. Twenty-five lives were lost and more than 3,000 structures were destroyed by a wildland-urban interface fire in one of the most heavily populated metropolitan areas of the North American continent. The fire completely over- whelmed the firefighting forces of the area, consuming everything in its path, and was only stopped when the Diablo wind conditions abated. By comparing it with the map on page 3 the reader will be able to identify the Hiller Highlands, the Parkwood Apartments, Lake Temescal, the Claremont Hotel, and major roads. A similar photograph, taken after the fire, appears on page 64. The grasslands would contain the lowest fuel loading of the natural fuels through the area. However, the extended drought may have caused unusual amounts of dead fuel to accumulate before the fire. The brushland would probably make up a large portion of the available fuel, particularly in the northeastern portion of the fire area. Drier sites would contain such things as silver lupin, California sage, and bush monkey flower. Site visits are not prohibited but must be carried out with caution in order to protect the public's due process rights. The Idaho Supreme Court recently found a violation of the Open Meetings Act during a site visit by a Board of County Commissioners. Noble v. Kootenai County, 148 Idaho 937, 231 P.3d 1034 (2010). The Court held that the Act does not require an agency to allow for public comments but that details should be provided prior to the hearing being conducted and an opportunity to hear what is being said. Id. at 1040. There are clear reasons why it may be preferable not to allow comments or the submission of evidence during a site visit, but the interested public must be provided with notice of the scope of the visit and, at a minimum, must be given the opportunity to accompany the hearing body, close enough to hear what is being said. Id. If the Council decides to conduct a site visit, the notice must be sufficient for the public to be able to locate where the meeting will be conducted as well as an opportunity to hear any testimony being provided by the applicant, city staff or consultants, or anyone else the City requests information during the site visit. We do not recommend allowing open public testimony due to the difficulty of keeping a "record" of such testimony. Rather, we suggest that the public preserve their testimony and to provide it at a subsequent public hearing at City Hall where the City had adequate recording devices to keep a clear record. All modeling will look at both the state and local roadway networks. Establish an executive committee to select/review scenarios and model runs. Results of the scenario process will be presented to the public and City Council at an open house/public comment session during a regular council meeting. 8/26/2014 1 CITY COUNCIL DIRECTION • June 24, 2014: Model the 1s1 scenario (2013 + Entitled) through COMPASS. IF the model showed Beacon Light Road as requiring 5 lanes all info should be brought back to the City Council for their specific direction and a potential change to the scope of work. IF the model showed Beacon Light Road as functioning at 3 lanes under scenario 1 (2013 + Entitled) a special committee will be convened to review and draft a 6'h modelling scenario which will be sent to COMPASS for Modeling with the remaining 4 scenarios from the executive committee. SCENARIO NO. 1: 2013 + ENTITLED • No new growth/development is allowed in any of the transportation analysis zones (TAZ) along Beacon Light Road and into the Foothills. • All TAZ(s) are kept at the 2013 levels (population, households and job) except those with existing entitlements. • Build -out of all existing entitlements (approved subdivisions and development agreements). Committee Rationale: This scenario is the most accurate illustration of what has been approved to date. 8/26/2014 2 MODEbIIdG ASSUMPTIONS Please note: These assumptions apply to all model runs AREAS REVIEWED & MODIFIED [1 Active Subdivisions City Limits 8/26/2014 3 ASSUMPTION NO. 1 All scenarios will reflect the complete build out of the Transportation Analysis Zones (TAZ) adjacent to Beacon Light Road and within the foothills regardless of the horizon year.
