RESOLUTION No. 14-15
A RESOLUTION OF THE EAGLE CITY COUNCIL TO VACATE THE PUBLIC UTILITY,
DRAINAGE, AND IRRIGATION EASEMENTS LOCATED ADJACENT TO THE COMMON SIDE
LOT LINES OF LOT 2-7, BLOCK 6 AND LOT 16-21, BLOCK 7, OF LONESOME DOVE
SUBDIVISION AS SHOWN ON THE ATTACHMENTS HERETO; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, Taunton Properties, LLC, requested a vacation to the final plat of Lonesome Dove
Subdivision to vacate the public utility, drainage, and irrigation easements located adjacent to the common
side lot lines of Lot 2-7, Block 6 and Lot 16-21, Block 7 (Lonesome Dove Subdivision); and
WHEREAS, On May 5, 2014, the Commission recommended approval of the vacation(VAC-04-
14), with conditions, to the Council; and
WHEREAS, Legal notice of the City Council hearing on the vacation was published in the Valley
Times on May 12, 2014, and May 19, 2014; and
WHEREAS, On May 27, 2014, the City Council held a public hearing on the proposed vacation
(VAC-04-14), and voted to approve the vacation with conditions; and
WHEREAS, The City Council hereby finds that the proposed vacation complies with the
provisions of Section 50-1306A of the Idaho Code, "Vacation of Plats - Procedure", and Section 9-6-2 of
Eagle City Code, "Vacations and Dedications."
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF
EAGLE, IDAHO.
The Eagle City Council hereby vacates the public utility, drainage, and irrigation easements
located adjacent to the common side lot lines of Lot 2-7, Block 6 and Lot 16-21, Block 7, of the final plat
of Lonesome Dove Subdivision, as considered, heard, and approved by the Council at its May 27, 2014,
public hearing for application number VAC-04-14, and as shown on the attachments hereto(Exhibit A).
This Resolution shall be in full force and effect immediately upon its adoption and approval.
ADOPTED by the Council of the City of Eagle, Idaho,this 26th day of August, 2014.
