Box 1520 Eagle, Idaho 83616 For Recording Purposes Do Not Write Above This Line DEVELOPMENT AGREEMENT MODIFICATION This Development Agreement Modification, made and entered into on the date as indicated herein, by and between the City of Eagle, a municipal corporation in the State of Idaho ("Eagle"), by and through its Mayor, Judy Nicola, and K and H Construction, LLC, ("Applicant"). WHEREAS, the Applicant is the owner of the following parcels: (i) 223 East Riversedge Drive, Lot 17, Block 1, Coast To Coast Subdivision, Parcel #R1485770300 (K and H Construction): and (ii) 230 East Laguna Shore Drive, Lot 16, Block 1, Coast To Coast Subdivision, Parcel #1485770290 (Judy Nicola). The combined acres of the two (2) parcels consist of approximately 1.86 acres. The Applicant's properties are collectively referred to hereinafter as the "Applicant's Property" and are legally described on Exhibit A, and depicted on Exhibit B (the "Revised Concept Plan") attached hereto; and WHEREAS, the proposed development agreement modification includes properties within an area currently zoned MU-DA (Mixed Use with a development agreement; and WHEREAS, a Development Agreement was executed by the then Mayor of Eagle on February 13, 2006 and recorded April 13, 2006, as Instrument No. 106057133, records Ada County, Idaho, and is hereinafter referred to as the "Development Agreement"; and WHEREAS, the original property subject of the Development Agreement consisted of approximately 117.51 acres (the "Original Property") permitted commercial uses to be located on the Applicant's Property; and WHEREAS, Coast 2 Coast, LLC, the original applicant in the Development Agreement, originally intended to develop the subject property with mixed use/commercial uses; and Page 1 of 6 K:\Planning Dept\Eagle Applications\RZ&A\2003'RZ-02-03 MOD2 da cc flu ver.doc WHEREAS, the Applicant is requesting to allow for single-family dwellings to be constructed on the Applicant's Property, but recognize that in order to do so further modifications to the Development Agreement are in order; and WHEREAS, there is approximately 115.65-acres of the remaining acreage of the Development Agreement, Instrument No. 106057133, records Ada County, Idaho, which area as generally shown on Exhibit D are collectively referred to as the "Non-Applicant Parcels"; and WHEREAS, the intent of this Modification is to protect the rights of the Applicant and the owners of the Non-Applicant Parcels, while at the same time limiting any adverse impacts on neighboring properties and insuring that the Applicant's Property is developed in a manner consistent with the Development Agreement as modified by this Development Agreement Modification; and WHEREAS, all provisions of the Development Agreement, are and shall remain in full force and effect other than as modified hereunder; WHEREAS, Applicant has provided Eagle with an affidavit agreeing to submit the Applicant's Property to a development agreement pursuant to Eagle City Code Section 8-10- 1(C)(1) Exhibits Cl (Nicola) and C2 (K and H Construction); and WHEREFORE, the Applicant and the City of Eagle desire to resolve the issues and concerns that have arisen and for and in consideration of the mutual covenants contained in the Development Agreement recorded under Instrument No. 106057133, records of Ada County, Idaho, this modification is agreed to as follows: ARTICLE I MODIFIED CONDITIONS OF DEVELOPMENT (Strike through text shall be deleted and underline text shall be added to the Conditions of Development pursuant to the Development Agreement recorded under Instrument No. 106057133, records of Ada County, Idaho) 2.6 The land zoned Mixed Use, herein referred to as "Mixed Use Area" includes an office site adjacent to Eagle Road located on Lot 49, Block 1, and . - . - . -'. - . site adjacent to the internal lake single-family residential uses located on Lots 16 and 17, Block 1 (Exhibit B) and shall be permitted with the following: 2.6.1 The office site shall be permitted a maximum of 12,000 square feet of Office- Medical/Dental/Professional building area limited to single story construction; 2.6.2 The restaurant/specialty shop site shall be permitted a maximum of 12,000 square feet for a two story building for a restaurant with bar/lounge. The floor area for these uses shall be adjacent to the two story building and shall be limited to single story.
