AUGUST 29, 1989
The Eagle City Council met in regular session on August 29, 1989.
Mayor GUERBER presiding.
The following members were present: TOM MINOW, GARY WALKER.
STEVE HAMMONS. Absent: STEVE MATLOCK. Moved by WALKER and
seconded by HAMMONS to approve the minutes of the August 8, 1989
meeting as presented. ALL AYE~ MOTION CARRIED.
Moved by WALKER and seconded by MINOW to approve the minutes of
the August 22, 1989 budget meeting. ALL AYE: MOTION CARRIED.
Moved by MINOW and seconded by WALKER to move the next line item,
a Public Hearing, later on the agenda to item 7. ALL AYE:
MOTION CARRIED.
NEW BUSINESS:
ATTORNEY CONTRACT AND RESOLUTION: Moved by MINOW to approve the
contract for legal services, motion seconded by WALKER. ALL AYE:
MOTION CARRIED.
Moved by WALKER and seconded by HAMMONS to approve Resolution 5-
89 for legal services. ALL AYE: MOTION CARRIED.
ISLAND INN-TRANSFER OF LIQUOR LICENSE: Presentation by Bob
Reitan, owner. Mr. Reiten advised the Council that they will
have parking area for 50 cars, Ada County has approved the
license pending approval of Central District Health, and that
they have secured the required State Liquor License. The area is
serviced on a septic system at this time. Moved by MINOW to
approve the application subject to Central District Health
design review and building inspection approval. Motion died for
lack of a second.
Moved by WALKER and seconded by HAMMONS to deny the application
until such time as Central District Health has issued to the City
documentation of approval. The application will be reviewed
again at that time. ALL AYE: MOTION CARRIED.
UNFINISHED BUSINESS:
LAW ENFORCEMENT: Response from Lt. Ted Bowers, Ada County
Sheriff's office on a petition submitted to Council on August 8,
1989. Lt. Bowers indicated that the response time was less than
reported, and that there is less criminal activity in the Eagle
area than indicated at the previous meeting and in print. Lt.
Bowers submitted a year to date statistic report on criminal
incidents in Eagle.

EAGLE PUBLIC LIBRARY: A request for approval for a $25.00 non-
resident fee in accordance with Ordinance 152 requiring Council
approval, by Ann Gallinger, Librarian. Moved by MINOW and
seconded by WALKER to approve the $25.00 fee increase. ALL AYE:
MOTION CARRIED.
EAGLE RIM SUBDIVISION/ Public Hearing: Application for Variances
on lots 8,9,10,15 and 24 of Eagle Rim Estates submitted for
public hearing by developer, Walt Wanner.

The City Council asked the City Engineer, Larry Sale, to examine
the site for drainage problems and to report to Council. Mr.
Sale returned to the Council meeting and reported that he saw no
problem with drainage, the land can drain to the N.W. corner,
after grading is completed, and out through a drainage swail to
Eagle Hills Way. No drainage should be allowed to flow toward
any adjoining property.
It was established that lot 24 has developed a problem in that
the dirt fill has been placed against the Barnes fence. Moved by
HAMMONS and seconded by WALKER to approve the variances, after
discussion the motion was amended to approve the variances as
requested with the assurance that there is an allowance for lot
24 to protect the existing home, some method of proper grading or
retaining wall to protect the Barnes fence. ALL AYE: MOTION
CARRIED.
ANNEXATION STUDY: Final report on Future Annexations submitted
to the Council, by the City Engineer. The report is tabled until
the next Council meeting in order for the Council to study it.
MAYOR'S REPORT: The Mayor briefly discussed the recreation
report submitted by the director, Kevin Eskelin, and asked the
Council to review the report.
Moved by MINOW and seconded by WALKER to approve the Claims as
presented. ALL AYE: MOTION CARRIED.
Moved by MINOW and seconded by WALKER to adjourn the meeting.
