Minutes
CALL TO ORDER: Meeting called to order at 6:03 P.M.
City Planner, Mike Williams, introduces to the Commission IT Staff, John Gonzales, and City
Attorney, Joe Borton.
ROLL CALL: Present: WRIGHT, GUERBER, JOHNSON, MCLAUGHLIN, and SMITH. A
quorum is present.
ALL CONSENT AGENDA ITEMS ARE ACTION ITEMS. CONSENT AGENDA:
♦ Consent Agenda items are considered to be routine and are acted on with one motion. There
will be no separate discussion on these items unless the Chairman, a Commissioner, member
of City Staff, or a citizen requests an item to be removed from the Consent Agenda for
discussion. Items removed from the Consent Agenda will be placed on the Regular Agenda in
a sequence determined by the Rules of Order.
♦ Any item on the Consent Agenda that contains written recommendations from the City of Eagle
shall be adopted as part of the Planning & Zoning Commission's Consent Agenda approval
motion unless specifically stated otherwise.
A. Minutes of June 1, 2020.
B. Findings of Fact and Conclusions of Law for the Approval of CU-09-19/PPUD-06-19/PP-
09-19 — Sno ualmie Falls Subdivision No. 15 — Red Butte. LLC: Red Butte, LLC,
represented by David Sterling, P.E., with T -O Engineers, is requesting conditional use permit,
preliminary development plan, and preliminary plat approvals for Snoqualmie Falls
Subdivision No. 15, a 94 -lot (77 -buildable, 17 -common) residential planned unit development.
A portion of the site (approximately 33 -acres) is located at the southeast corner of North Palmer
Lane and West Floating Feather Road. The remaining portion of the site (approximately 9.85 -
acres) is located on the north side of West Floating Feather Road approximately 790 -feet west
of the intersection of North Arena Avenue and West Floating Feather Road.
C. Findin s of Fact and Conclusions of Law for the Approval of CU -01-20 — Chane of
Nonconforming Use — Jeremy and Wendy Clvne: Jeremy and Wendy Clyne are requesting
conditional use permit approval for a change of nonconforming use to allow a home addition
to encroach into the required side yard setback. The .24 -acre site is located on the west side of
North Torrey Pines Avenue approximately 50 -feet south of the intersection of East Cypress
Point Way and North Torrey Pines Avenue at 1151 North Torrey Pines Avenue.
D. Findin s of Fact and Conclusions of Law for the Approval of A-01-20/RZ-01-20 & PP -
01 -20 — Annexation and Rezone (with a development agreement) from RUT to R -3 -DA
and Preliminary Plat for Monticello Estates Subdivision — Monticello Estates LLC:
Monticello Estates, LLC — Nathan Cutler, represented by Penelope Constantikes, with Riley
Planning Services, LLC, is requesting annexation, rezone from RUT (Residential -Urban
Transition — Ada County designation) to R -3 -DA (Residential with a development agreement),
and preliminary plat approvals for Monticello Estates Subdivision, a 12 -lot (10 -buildable, 2 -
common) residential subdivision. The 4.07 -acre site is located at the southeast corner of North
Park Lane and West Floating Feather Road at 1232 North Park Lane.
Johnson inquires about item 3B.
City Planner, Mike Williams, responds to Commissioner Johnson's inquiry.
Johnson moves to approve the consent agenda with the exception of item B for further

discussion. Seconded by McLaughlin. ALL AYES... MOTION CARRIES.
Discussion regarding item 3B.
City Planner, Mike Williams, provides language for additional motion: "Add an additional
condition to address the motion that was made as part of the recommendation of approval
that states: `Provide a revised preliminary plat and development plan showing three
buildable lots removed from the area north of West Floating Feather road between Dry Creek
Canal and the east property line. The revised preliminary plat and development plan shall be
submitted prior to submittal of final plat and final development plan applications."'
Guerber: So moved.
Seconded by Johnson. ALL AYES... MOTION CARRIES.
4. UNFINISHED BUSINESS: NONE.
PUBLIC HEARINGS:
A. ACTION ITEM: A-06-19/RZ-12-19/CU-08-19/PPUD-05-19/PP-08-19 — Rene Place
Planned Unit Development — MCG -Sterling, LLC: MCG -Sterling, LLC, represented by
Becky McKay, with Engineering Solutions, LLP, is requesting annexation, rezone from R-3
(Residential) and RUT (Rural -Urban Transition — Ada County designation) to R -5 -DA -P
(Residential with a development agreement — PUD), conditional use permit, preliminary
development plan, and preliminary plat approvals for Rene Place Subdivision, a 89 -lot (80-
buildalble, 7 -common, 2 -non -buildable) residential planned unit development. The 18.51 -acre
site is located at the northeast corner of North Dicky Drive and North Rene Place at 500 North
Rene Place. (MJW)
Becky McKay, Engineering Solutions, 1029 North Rosario Street, Meridian, Idaho. The applicant's
representative provides an overview of the application.
McKay responds to questions from the Commission.
City Planner, Mike Williams, provides a detailed overview of the application.
Williams responds to questions from the Commission.

Chairman Wright resumes the meeting at 7:52PM
Chairman Wright opens the Public Hearing.
David Jakious (via WebEx), 2577 East Mariposa Drive. Jakious opposes the application, explains
his history in the area, discusses maximizing profits versus focusing on the good of the
neighborhood, states that the applicant's representative "cherry picked" homes in the area to show,
feels density will negatively impact the neighborhood as a result of traffic issues that will arise as
a result of this development. Discusses impact on local schools.
Eric Shaver (via WebEx), 2528 East Snocreek Drive. Shaver states his opposition to the proposed
plan, states that he agrees with previously expressed concerns, explains concerns related to traffic,
insufficient traffic -calming devices and pedestrian safety.
Sheridan Hodson, 1740 East State Street. Hodson explains his real estate background and finance
background, states his support for the project.
Steve Deckers, 2249 East Dickey Circle. Deckers states that he is part of the Evans Subdivision
HOA, states appreciation for certain aspects of the design, expresses concerns about drainage and
the effect of the development on Evans Subdivision. States opposition to the small lots with two -

story homes along the golf -course, density of the proposal and the fact that this more -dense
neighborhood will have to travel through surrounding less -dense neighborhoods, compact -
residential change of this area in the 2017 Comprehensive Plan.
Mark Butler, 1675 East Bishop Way. Butler states that he is not testifying either in favor or against
the application, but rather, to provide information regarding the history of the City's
Comprehensive Plan, zoning ordinances, and minimum lot sizes.
Butler responds to comments from the Commission.
Mike Louie, 9601 West State Street. Louie explains his history in the area and discusses changes
in Eagle over time. He discusses less-expensive housing options, and states his support for this
application based on this concept.
McKay, the applicant's representative, provides rebuttal and addresses concerns raised during the
Public Hearing.
Jim Zubiaga, 185 McKenzie Creek Road, Whitebird, Idaho. The applicant provides information
regarding home pricing and provides an explanation regarding single -story vs. two-story houses.
Zubiaga responds to questions from the Commission.
McKay responds to questions and comments from the Commission.
City Planner, Mike Williams, responds to questions from the Commission.
Chairman Wright closes the Public Hearing.
General discussion amongst the Commission.
City Planner, Mike Williams, states that the applicant's representative would be open to having the
application continued to the July 20' meeting to allow the applicant to work with City Staff to try
to redesign the plan to better align with the feedback expressed by the Commission.
McLaughlin moves to continue Rene Place Planned Unit Development A-06-19/RZ-12-
19/CU-08-19/PPUD-05-19/PP-08-19 to our July 20th meeting so that the applicant can
reconsider the subdivision with the comments that we've made tonight. Seconded by Johnson.
ALL AYES... MOTION CARRIES.

B. ACTION ITEM: A-02-20 & RZ-02-20 —Annexation and Rezone from RUT to R -4 -DA for
a Senior Living Facilitv and Height Exception Request — Cameron General Contractors.
Inc.: Cameron General Contractors, Inc., represented by Charles Baverman, III, with Dinsmore
& Shohl, LLP is requesting annexation and rezone from RUT (Rural -Urban Transition — Ada
County designation) to R -4 -DA (Residential with a development agreement [in lieu of a
conditional use permit]) for a 130 -unit senior living facility. The 10.44 -acre site is located on
the east side of North Linder Road approximately 90 -feet south of the intersection of West
Temple Drive and North Linder Road at 6910 and 6940 North Linder Road. (MJW)
Charles Baverman, National Development Council for Cameron General Contractors. The
applicant's representative provides an overview of the application.
Bob Lewis, Director of Development for Cameron General Contractors, 7101 S. 82nd Street,
Lincoln, Nebraska. Lewis provides an overview of the application.

John Kreidel (via WebEx), 6987 North Cathedral Way. Kreidel states that he lives adjacent to the
subject property, states that he supports the use, expresses concerns about the building height,
requests mature landscaping to soften the height along the eastern border, concerns about traffic
and signalization, and the location of the trash bins, and suggests relocating them closer to the Fred
Meyer site.
Marilyn Morton, 7305 Ribier Drive. Morton expresses concerns about the location of trash
receptacles, site lighting, the proposed building heights, and requests that the building be limited to
two -stories.
Lewis provides rebuttal and addresses concerns raised during the Public Hearing.
Chairman Wright closes the Public Hearing.
Discussion amongst the Commission.
Johnson moves to recommend for approval item 5B A-02-20 & RZ-02-20 Annexation and
Rezone from RUT to R -4 -DA for a Senior Living Facility and Height Exception Request for
Cameron General Contractors with the site specific conditions of approval and the standard
conditions of approval as recommended by Staff.
Seconded by Guerber.
City Planner, Mike Williams, requests clarification regarding the motion.
Johnson amends the motion: "I would like to revise my motion to delete the part about
standard conditions."
Seconded by Guerber. ALL AYES... MOTION CARRIES.
C. ACTION ITEM: ZOA-01-20 — Zoning Ordinance Amendment — Dylan and Erika
Schneider, represented by Mark L. Butler with Land Consultants Inc.: An ordinance of
the City of Eagle, Ada County Idaho, amending Title 8 "Zoning", Chapter 1, Section 2, Chapter
2, Sections 1, 3, and 4; providing a severability clause; and providing an effective date. The
proposed amendment includes a new definition and setback requirements for "Dwelling,
Single -Family Attached" within the R-6 to R-10 zoning districts and establishes the use as a
conditional use in the R Residential zoning district. (WEV)
