Minutes - 1989 - City Council - 06/13/1989 - RegularEAGLE CITY COUNCIL MEETING JUNE 13, 1989 The Eagle City Council met in regular session on June 13, 1989 at 7..30 p.m. Councilman MINOW presiding in Mayor Guerber's absence. The following members were present.. TOM MINOW, STEVE HAMMONS, STEVE MATLOCK, GARY WALKER. Moved by MATLOCK and seconded by WALKER to approve the minutes of the May 23, 1989 meeting as presented. ALL AYE.. MOTION CARRIED. NEW BUSINESS .' WEST ONE BANK-Sign.' Moved by MATLOCK and seconded by HAMMONS to approve the application as presented by the Design Review Commission as it does not exceed the 25% illumination limitation, with the condition that the pylon design to be encased in wood. ALL AYE.. MOTION CARRIED. ADA COUNTY TRANSMITTAL 89-03-CU/CUSTER.. Private storage bldg. Moved by HAMMONS and seconded by MATLOCK to approve as presented. ALL AYE.. MOTION CARRIED. ADA COUNTY TRANSMITTAL 89-03-PR/MOCAW.' Request for private Rd. Moved by WALKER and seconded by MATLOCK to approve the transmittal as recommended by P&Z, that the road serve a single family dwelling and will not be acceptable to service a subdivision. ALL AYE: MOTION CARRIED. ADA COUNTY TRANSMITTAL 89-14-ZC/KUNKLER.' Request for private Rd. Moved by WALKER and seconded by HAMMONS to approve the transmittal as recommended by P&Z, that the road serve a single family dwelling and will not be acceptable to service a subdivision. AYE.' WALKER, MINOW, HAMMONS. ABSTAIN: MATLOCK. MOTION CARRIED. INDEMNIFICATION CONTRACT: Presentation by the City Attorney, Mona Mack, who requested the contract be reviewed by the Eagle Sewer District. Moved by MATLOCK and seconded by WALKER to enter into the contract and modify as needed. ALL AYE.' MOTION CARRIED. ADA PLANNING ASSOCIATION PRESENTATION.. Claire Bowman reviewed for Council the functions of APA, through the budgeting process, the governmental process, the Platting Committee, and the new data base now being set up to provide the addresses for each parcel, identifying the property owner, and residents. APA is now working to solve the county wide drainage problems (57 districts) HISTORICAL ORDINANCE: Moved by HAMMONS and seconded by MATLOCK to table. ALL AYE.. MOTION CARRIED. PROJECT LITERACY.' Presentation by Lynn Ball. Lynn informed the Council of a Literacy Rally for 1st and 2nd graders. Invitations have been sent out to Barbara Bush, Cecil Andrus and Mayor Kempthorne will speak at the rally. Moved by WALKER and seconded MINOW to adopt the Project Literacy. ALL AYE.. MOTION CARRIED. RIVERSTONE TOWNHOUSE/PUD The project was approved with conditions, the developer has been notified of those conditions. Moved by HAMMONS and seconded by WALKER to approve the subdivision with the conditions presented to date. ALL AYE: MOTION CARRIED. THE MAYOR IS NOW IN ATTENDANCE and will preside over the meeting as it continues. EAGLE METHODIST CHURCH: 3 month review. A letter has been received by Church officials indicating they will ask for an extension as they will not start construction until next year. RECREATION= Report presented by Kevin Eskelin regarding the program this summer. Kevin advised the Council that the recreation program involves the community. It is not just the youth that benefits, the programs are set up for adult classes and seniors too. There will be flyers later this week to identify those activates. ORDINANCE #154.. Moved by MINOW and seconded by MATLOCK to dispense with the 3 day reading rule and consider the ordinance immediately. ALL AYE.. MOTION CARRIED. Moved by MINOW and seconded by MATLOCK to approve Ordinance #154 adopting the 1988 Uniform Building Standards. ALL AYE: MOTION CARRIED. APPOINTMENT TO LIBRARY BOARD: Mayor GUERBER recommended Reverend Larry Martin as the new member of the Library Board. Moved by WALKER and seconded by MINOW. ALL AYE: MOTION CARRIED. The Mayor will appoint a new member of the Planning and Zoning at the next meeting. ATTORNEY'S REPORT: Mona Mack reported on the Water Rights (permit) adjudication, in order to determine if the City needs to file. One water right was filed in the name of Eagle Sewer and Water Dist. and one for the City, these need to be checked out and, if necessary, filed. HUMANE SOCIETY= Boise had no contract breakdown, but the contract is available for review. PUC.. Liability of Eagle Water Co. Information must be provided them by July 28, 1989. It would be necessary for the City to advise the City Attorney if it is the desire of Council to continue investigation into the matter. BLOCK BROS./PARK extension. We should be receiving the paperwork within a week. The open container ]aw was brought into discussion. The City Attorney advised Council that enforcement would be limited as the law enforcement officials do not enforce City ordinances without having a contract. The Mayor asked the City Attorney to check into a special bond for law enforcement. MAYOR'S REPORT.. EAGLE FUN DAYS: The Eagle Fun Days events were successful, however, discussion is underway to bring the one day event back to a family function with more activity for kids. The breakfast was larger and the nut feed a success. A special thanks to HAMMONS for the balloon event sponsored by the Centennial Commission. MATLOCK reported on the parks and will coordinate care of the City Hall grounds as well. ENGINEERS REPORT ON FUTURE GROWTH.. Larry Sale presented a study of annexation of 7 areas outside the City limits. Those areas include the golf course and surrounding areas, plus other areas already surrounded by the city. The study included the land use, and revenue. Mr. Sale recommended further study by the City Attorney for annexation as a whole and for further direction. Discussion took place regarding annexation of some of the locations now surrounded by the City. Moved by ~A~and seconded by M-~to instruct the City Clerk to notify the property owners of annexation proposal by letter. AYE.. MINOW, WALKER. NAY.. HAMMONS, MATLOCK. MAYOR.. NAY. MOTION FAILED.
