APRIL 11, 1989
The Eagle City Council met in regular session on April 11, 1989
at 7:30 p.m. Council President TOM MINOW presiding in Mayor
GUERBER'S absence.
The following members were present: TOM MINOW, STEVE HAMMONS,
STEVE MATLOCK, GARY WALKER.
Moved by MATLOCK and seconded by HAMMONS to approve the minutes
of the March 14, 1989 meeting. ALL AYE: MOTION CARRIED.
Moved by MATLOCK and seconded by HAMMONS to move the item "Eagle
Landscape Nursery" up on the agenda and to discuss at this time.
ALL AYE: MOTION CARRIED.
EAGLE LANDSCAPE NURSERY: Presentation by Pete Cintorino. Mr.
Cintorino advised the council that he would like to establish a
landscaping/nursery business in the Eagle impact area,
specifically the N.W. corner of State St. and Highway 55.
Directive of Council was to advise Ada County Development, by
letter, indicating a sincere interest in the project.
Chairman MINOW announced that it was the time and place for the
public hearing.
PUBLIC HEARING: EAGLE RANCH SUBDIVISION #5: Presentation by
Robert DeShazo for consideration of a 3 lot development of 1 1/3
acres within Eagle Ranch Subdivision. The area has been
designated on the original plat as PLAYGROUND.

Moved by WALKER and seconded by HAMMONS to continue this hearing
until the next scheduled meeting, April 25, 1989 in order to
investigate some of the legal questions that have been raised and
to review public testimony. ALL AYE: MOTION CARRIED.
AUDIT REPORT: Presented by Jo Bolen, Messuri, Bates and Gibbons.
(Audit report on file). MovedbyWALKER and seconded by MATLOCK
to approve the audit as presented. ALL AYE: MOTION CARRIED.
TRANSPORTATION TASK FORCE REPORT: Presented by WALKER,
preliminary reports and recommendations of the task force sent to
APA to be presented to the State Highway Dept. Suggests
additional meetings in order to get public opinion in order for
Council to make a recommendation based on the collective desires
of the public.

It is the directive of the Council to hold a public meeting on
May 9, 1989 at 7:30, regarding the bypass, along with the
regularly scheduled council meeting in order to make an official
recommendation to APA to submit at the next public hearing held
through the State Highway Dept in June, 1989. It is asked that
the Eagle Chamber of Commerce place the bypass route on their
agenda of May 9, 1989 in order to submit the Chamber's
recommendations to the Council. WALKER and MINOW will obtain the
information on cutbacks, speed limits, accesses, setbacks,
counts, all ramifications from the State Highway Dept.
The City Clerk is directed by Council to study the possibility of
a Jaywalking Ordinance within the City.
EAGLE RIM SUBDIVISION: No testimony given on the review of the
subdivision. The extension of time expires in July.

RIVERSTONE SUBDIVISION: Presentation by Robert DeShazo. Mr.
DeShazo has submitted letters indicating financing of the project
and requests a 6 months extension of time in order prepare for
construction. Moved by MATLOCK seconded by HAMMONS to grant a 6
months extension of time. ALL AYE: MOTION CARRIED.
FINDINGS OF FACT/CONCLUSIONS OF LAW: TOWNE PROPERTIES: Moved by
WALKER and seconded by MATLOCK to approve the findings as
presented. ALL AYE: MOTION CARRIED.
PROCLAMATION-HUMAN RIGHTS WEEK: Moved by MATLOCK and seconded by
WALKER to approve and proclaim this proclamation. ALL AYEs
MOTION CARRIED.
PROCLAMATION-NATIONAL CONSUMERS WEEK. Move by MATLOCK and
seconded by HAMMONS to adopt this proclamation with the amendment
that the date is changed to read the week starting the 23rd of
May. ALL AYEs MOTION CARRIED.
ORDINANCE #152: Moved by MATLOCK and seconded by WALKER to
enforce the dispensing rule. ALL AYE: MOTION CARRIED.
ORDINANCE #152: Moved by MATLOCK and seconded by HAMMONS to
adopt the ordinance, AN ORDINANCE CHANGING THE ZONING
CLASSIFICATION OF THE REAL PROPERTY DESCRIBED HEREIN FROM A
AGRICULTURE TO C-2 AREA BUSINESS DISTRICT; AMENDING THE ZONING
MAP OF THE CITY OF EAGLE TO REFLECT SAID CHANGE; AND PROVIDING
EFFECTIVE DATE. ALL AYE: MOTION CARRIED.
