JANUARY 10, 1989
The Eagle City Council met in regular session on January 10, 1989
at 7:30 p.m. Mayor GUERBER presiding.
Roll call showed the following members present: TOM MINOW, STEVE
MATLOCK, GARY WALKER, STEVE HAMMONS.
Moved by HAMMONS and seconded by WALKER to approve the minutes of
the December 13, 1988 meeting as presented. ALL AYE: MOTION
CARRIED.
Mayor GUERBER announced that the presentation by Pauline Hineman
is rescheduled for the next council meeting and will not be
presented at this time.
BANBURY/PHASE 3 FINAL PLAT: Larry Sale, Engineer for Briggs
Inc., representing BanBury. Mr. Sale advised council that
construction would resume this summer and requests council
approve the final plat to allow recording to take place. He
stated that a surety bond with ACHD was in place.
Moved by MATLOCK and seconded by MINOW to approve the final plat,
phase 3 of BanBury at this time. ALL AYE: MOTION CARRIED.
EAGLE RIM SUBDIVISION/Extension of time: Presentation by Don
Minegar, developer of the project. Mr. Minegar stated that he
does have financing, that water has been a hold-up of the
project. Mr. Minegar stated that he is aware of a water drainage
problem, which will be taken care of after the extension. He
said that the developers did not want to spend any more money
until the development was underway, the drainage problem will be
satisfied at that time. (letter for record attached).
Moved by WALKER and seconded by MINOW to allow a 6 month
extension for Eagle Rim. AYE: MINOW, MATLOCK, WALKER. ABSTAIN:
HAMMONS. MOTION CARRIED.
TREASURE VALLEY MOBILE HOME PARK: A reminder to council that the
extension of time previously given expires in February.
PARKING PROHIBITED ON STATE ST.: Presentation by WALKER. WALKER
reviewed the problems and dangers to the audience regarding
speeding, parking, and crosswalks. He suggested solutions may be
found in no parking, flashing lights, or reduced speed. He
stated that this is a community problem that needs a solution,
but at the same time we need to find a solution that does not
hamper business in downtown Eagle. WALKER stated he would like
to see restricted parking in some areas, and believes that the
problem will be relieved upon the completion of the bypass but
that will be in 3-4 years.

Testimony was heard by Dr. Everett Whitzel, who suggests a police
car stationed at strategic points in town additional traffic
lights, and restricted hours in downtown parking.
A1 Courtial: Suggests a 4 way stop sign at 2nd St.
Patricia Kraus.' (Barber Shop) Rotate Police Officers at peak
hours and give traffic citations.
Jim Heath.' Asked what the state regulations are and what we can
do? Can Eagle have a police force by means of property tax
increases?
Dave Selinski: (ACHD) All signs on State St. are under the
Jurisdiction of the State Dept. of Transp. There are 5 areas of
criteria that must be met in order to establish a 4 way stop,
Eagle does not meet them. Blinking lights are restricted to
school crossings, so they are not possible either. In order to
obtain additional traffic signals in the City of Eagle, there
would need to be an out-cry by the citizens themselves in order
to get action.
Dee Pfifer.' (Ada County Sheriff's Office) Since State St. is a
major highway, and leads downtown Eagle too, it is a major and
unique problem. While he believes that part of the enforcement
problem is a manpower shortage in the Sheriff's office, the
available personnel to patrol the area, he stated that he
believes that law enforcement is the key to solving the problem.
In order to enforce the law they would need to work in
conjunction with the State Police and saturate the area. At the
suggestion of MINOW regarding citizen arrest, Mr. Pfifer stated
that in order to make such an arrest stand up in court that you
need to know the identity of the driver of the vehicle, the
license plate number and a witness to the actions of the driver.
Officer pfifer believes that the speed enforcement by an officer
of the law is the first thing to try in order aid the problem.

Mike Horkley (Farmers Insurance) while the police are in the area
going over reports, make themselves visible, and sit on State
St.
Gary Earl: (Eagle Post) Against ordinance. The Chamber of
Commerce voted today against the ordinance. He believes the
ordinance impacts the business community.
The discussion closed with WALKER suggesting that public
awareness needs to be brought to the attention of the public
officials. He would like to see letters from the citizens
brought forth so that public sentiment can be heard and in future
meetings be able to call on the public for comments in order to
resolve the problem.
FIREARMS ORDINANCE PROPOSAL: Discussion regarding ordinance
suggested modifying the ordinance to establish that firearms will
be restricted in the city limits with the exception of "A"
Agricultural areas and within 150 yards of homes. Ordinance will
be considered at the next council meeting.
HOPE LUTHERAN CHURCH/Finding of Facts and Conclusions of Law:
Moved by HAMMONS and seconded by MATLOCK to approve the findings
as submitted. ALL AYE: MOTION CARRIED. MINOW advised the
representatives of the church that according to the two proposed
locations of the bypass that both routes transverse the property
and suggests that they visit with Idaho State transportation
Dept.

ORDINANCE 147/Rezone Hope Lutheran Church: Moved by MINOW and
seconded by WALKER to adopted the Ordinance rezoning the parcel
from R5 to Cl. ALL AYE: MOTION CARRIED.
ORDINANCE 148/Prohibiting parking on State St. Moved by MINOW
and seconded by WALKER to table this ordinance and refer to the
Transportation Committee in order to come up with some
recommendations and incorporate some of the things heard at the
council meeting tonight and a plan of action as to how this may
be concluded. ALL AYE: MOTION CARRIED.

COMPREHENSIVE PLAN: Discussion regarding amendments to the plan
for 1989. MINOW advised the council of P&Z action in amending
the plan. From the council's point of view the plan is to be
modified lifting some of the restrictions guidelines as to
construction, definitions, those things that can be better ruled
by ordinances and zoning. One of the major changes is the city
center concept changed to city limits, limiting some of the
~onstruction restrictions and limiting those areas to zoning
ordinances rather than the comprehensive plan.
MAYOR'S REPORT: Advised the council of the resignation of Fred
Wilson, Chairman of P&Z. Advised council that we are taking
applications for a Building Inspector.
ATTORNEY'S REPORT: Reminded the council of the drainage problem
and threatened litigation.
GRANT: Carlyle Briggs reminded council of upcoming application
for a grant to complete necessary requirements of Dept. of
Commerce. It is necessary to meet local contributions for the
matched grant. A meeting needs to take place with the Building
Association prior to January 24th. The association now has
$12,000 toward that effort.
