Minutes - 1988 - City Council - 09/27/1988 - RegularEAGLE CITY COUNCIL MEETING SEPTEMBER 27, 1988 The Eagle City Council met in regular session on September 27, 1988 at 7.'30 p.m. Mayor GUERBER presiding. Roll call showed the following members present: TOM MINOW, STEVE MATLOCK, GARY WALKER, STEVE HAMMONS. Moved by MATLOCK and seconded by HAMMONS to approve the minutes of the August 30, 1988 with a correction on page 1, paragraph 4. MINOW seconded the motion, correction from HAMMONS aR the minutes reflect. ALL AYE: MOTION CARRIED. Mayor GUERBER declared that it was the time and the place for the first public hearing of the evening, BanBury Subdivision. The request is for a vacation a of pedestrian easement. Representative for BanBury, Larry Sale, spoke for the request to vacate a note on the plat by way of the County Recorder. In turn they have prepared a Declaration of Easement. Mr. Sale requests that the City Clerk prepare a similar document to be recorded at the same time. There was no testimony in favor or opposed to the request. Moved by MATLOCK and seconded by MINOW to approve the vacation request as presented. ALL AYE.' MOTION CARRIED. Mayor GUERBER declared it was the time and the place for the second public hearing, requested by Lloyd Gerber, a rezone application from R-5 to C-2. The business suggested is a sprinkler business, landscaping with some displays. It would also include small engine repair, such as lawn mowers. Moved by MINOW to rezone the property from R-5 to C-2, seconded by WALKER. ALL AYE: MOTION CARRIED. Mayor GUERBER declared it was the time and the place for the third public hearing, a request by Bill Renauld, representative of Treasure Valley Mobile Home Park, for phasing of the Mobile Home Park. Mr. Renauld testified that the financing institutions are requesting phasing rather than full funding at one time. There was no testimony in favor or opposed. Mr. Renauld stated that phase 1 would include all the amenities, the club house, pools, spas, archery range, and tennis courts. It would include 2 sides of the fencing, those that are parallel or adjacent to Floating Feather Rd., and along Highway 55. The EAGLE CITY COUNCIL MEETING SEPTEMBER 27, 1988 PAGE 2 landscaping would be included in phase 1, and the entrance way. Phase 1 would be largely in the S. E. corner of the property, and will center around the club house. The water storage facility would'be included in phase one also. They will drill wells in the valley rather than near Sage acres. City Attorney, Mona Mack, advised that since the development should have been completed, as indicated in the Eagle City Code, in a one year period, the phasing should be completed one phase at a time. Council has chosen to modify the existing conditional use permit, therefore, each phase should be completed, one at a time, and addressed by the council., prior to further development. Moved by MINOW and seconded WALKER to extend the conditional use prmit for a period of '6 months and allow the developer the opportunity to begin phase 1.. Upon completion of tht phase to come back and address the council on additional phases. AYE: MINOW, HAMMONS, WALKER. ABSTAIN: MATLOCK. MOTION CARRIED. FINDINGS OF FACTS/CONCLUSIONS OF LAW/BEGGROW: seconded by HAMMONS to approve as presented. CARRIED. Moved by MINOW and ALL AYE: MOTION ADA COUNTY TRANSMITTAL 88-62-CU: Wolfgram, for private storage. Moved by MATLOCK and seconded by WALKER to approve as presented. ALL AYE~ MOTION CARRIED. ADA COUNTY AMENDMENTS TO THE CODE/SERVICE STATION-EXTENSION OF TIME: Moved by MINOW and seconded by MATLOCK. ALL AYE: MOTION CARRIED. EAGLE UNITED METHODIST CHURCH/ Extension of time: Reverend Martin, pastor of the church represented the project. Reverend Martin believes that they will be ready to start construction this spring and may not need further extension. Reverend Martin requests another years extension. Moved by WALKER and seconded by HAMMONS to grant a one year extension. ALL AYE: MOTION CARRIED. SEWER GRANT: Jim Heath approached council regarding a grant originally attempted with Ada County, but denied. The Sewer District has been advised to approach the City to sponsor the grant. The grant would serve down to and including Roundy's Taller Court plus 170 units. The county has not given support in order to obtain the grant. The sewer department cannot apply for a grant alone, it must be sponsored. It is advisable to have the city sponsor it. The grant is for $555,700, 75% of the EAGLE CITY COUNCIL MEETING SEPTEMBER 27, 1988 PAGE 3 interceptor has been donated toward the project. The administration of the grant would be taken care of by the sewer department, however, the checks and filtering the money must go through by the city. Moved by MINOW and seconded by MATLOCK to grant the request of the sewer department, for the city to agree to sponsor a grant request for the Sewer District. ALL AYE.' MOTION CARRIED. ADDITION TO THE AGENDA: Mayor GUERBER requested a motion to add to the agenda a resolution regarding equal housing requirements. This is a request by the Dept. of Commerce. Moved by WALKER and seconded by MINOW to add Resolution 4-88 to the agenda. ALL AYE: MOTION CARRIED. Moved by WALKER and seconded by MINOW to approve Resolution 4-88, a Fair Housing Resolution. ALL AYE: MOTION CARRIED.. Moved by MINOW and seconded by WALKER to table the appointment to the Library Board until the next council meeting. ALL AYE: MOTION CARRIED. ORDINANCE #142: Official Newspaper. Moved by MINOW and seconded by WALKER to table this ordinance for review. ALL AYE: MOTION CARRIED. MAYOR'S REPORT: Lease agreement has been received with modifications and the seniors have started using the facility. Mayor GURRBER plans to place the lease on the next agenda, after everyone has had an opportunity to review the lease. Moved by MATLOCK and seconded by WALKER to approve the Claims Against the City as presented. ALL AYE: MOTION CARRIED.
