AUGUST 16, 1988
The Eagle City Council met in regular session on August 16, 1988,
at 7:30 p.m. Mayor GUERBER presiding.
Roll call showed the following members present: TOM MINOW, STEVE
MATLOCK, GARY WALKER. Absent: STEVE HAMMONS.
Moved by MINOW and seconded by WALKER to approve the minutes of
the July 26, 1988 meeting. ALL AYE: MOTION CARRIED.
ORDINANCE #140: Moved by MINOW and seconded by MATLOCK to defer
consideration of the ordinance until the City Attorney arrived.
ALL AYE: MOTION CARRIED.
APPOINTMENTS: Moved by WALKER and seconded by MINOW to approve
the reappointment of LaRue Bevington and Marshall Carpenter for
another 2 year term to the Design Review Committee.
INSURANCE: Presentation by Allen Rendstram representing Stein
McMurray. Figures for liability, errors and omissions, building
and contents insurance for the city and library were given.
FINDINGS OF FACT AND CONCLUSIONS OF LAW: Quarter Circle D.J.
Ranch, moved by MATLOCK and seconded by MINOW to approve as
presented. ALL AYE~ MOTION CARRIED.
FINDINGS OF FACT AND CONCLUSIONS OF LAW: Ash/DeVer, moved by
MATLOCK and seconded by MINOW to approve as presented. ALL AYE:
MOTION CARRIED.
Moved by MINOW and seconded by MATLOCK to dispense with the rule
requiring ordinances to be read on three different days, and
consider Ordinance #140, an amending Ordinance, Chapter 3, Title
5, Eagle City Code, to prohibit parking of a motor vehicle at any
place where official traffic control devices prohibit parking.
ALL AYE: MOTION CARRIED.
Moved by WALKER and seconded by MINOW to adopt Ordinance #140 as
presented. ALL AYE: MOTION CARRIED.

Mayor GUERBER stated that it was the time and the place for a
public hearing regarding the Conditional Use Permit application
by Beggrow, for a Day Care Center in Eagle Hills West #1.
Representing the proposal for Beggrow was Dennis McCracken.
Speaking in opposition were:
Bud Debenham, President of the Eagle Hills Home Owners Assoc.:
Believes that the day care would not serve those home owners in
Eagle Hills, but would be serving people from other areas.
Doesn't want the center in this particular area.
John Meyers: There may be a need for additional day care
centers, but not in that location. Finds in exploring answers
from neighbors that it is almost unanimous disapproval. He
believes it would change the character of the neighborhood. The
golf course is an enhancement to moving there, a day care does
not fit in the scheme. It is a residential area and all have a
responsibility to keep it that way. He asked the question, if
the day care fails, a building will be there, designed for a
business. It will be there forever, it can't go back to grass
and trees.
Nell wilton: Approves of a day care but believes that there will
be additional traffic problems, noise, congestion. There should
be an alternative location.
Representative, Dennis McCracken: Stated that he does not
believe there will be more traffic problems generated from a day
care. There is a parking lot for the golf course, no traffic
problems from it. He feels that he has met all standards
required for a CUP.
Moved by MINOW and seconded by WALKER to deny the conditional use
permit based on the recommendation of Eagle Planning and Zoning,
and Section 8-7-3-2 (C,D,H), that there will be a substantial
change in character of the neighborhood. ALL AYE: MOTION
CARRIED.
RECREATION: Final report given by Cecilia Monda, this years
recreation coordinator.

ATTORNEY'S REPORTs Discussed the Senior Citizen Lease. They
have requested more changes in the insurance section, the general
liability. They also want the contents and building to be
covered by the city. A letter to Edna Stoner was distributed to
council, it will be sent to Ms. Stoner in Nevada.
MAYOR'S REPORT~ Discussed the possibility of a safe for City
Hall, will get bids. The Mayor advised Council of the condition
of the downtown area. The downtown has an unkept appearance. He
will be notifying the downtown merchants to take measures to
maintain the area. Mayor GUERBER told the council that he has
been in contact with Bob DeShazo regarding the properties
previously questioned in the previous meeting and has' found him
cooperative in cleaning up the two lots. Carlyle Briggs was
asked about the drainage problem in front of the new building.
He has been in contact with the irrigation district, repair of
the pipe will cost approximately $800.00. The Mayor will be seek
advisement from the City Attorney regarding the problem, the city
will be alternative bids.

to approve as presented. ALL AYE~ MOTION CARRIED.
