Minutes - 1988 - City Council - 07/26/1988 - RegularEAGLE CITY COUNCIL MEETING JULY 26, 1988 The Eagle City Council met in regular session on July 26, 1988, at 7:30 p.m. President of Council MINOW presiding in Mayor GUERBER'S absence. Roll call showed the following members present: TOM MINOW, STEVE MATLOCK, STEVE HAMMONS. Absent: GARY WALKER. Moved by MATLOCK and seconded by HA/4MONS to approve the minutes of the July 12, 1988 meeting. ALL AYE: MOTION CARRIED. Moved by MATLOCK and seconded by HAMMONS to approve the minutes of the July 12, 1988 workshop meeting. ALL AYE: MOTION CARRIED. PUBLIC HEARINGS: Councilman MINOW stated that it was the time and place for the first public hearing, Ash-DeVer Conditional Use Permit for a Craft Shop on Eagle Rd. Representing the project was applicant, Kim Ash. Ms. Ash stated that there were at least 2 parking spaces, did not expect additional traffic to the neighborhood, and that the property has sewer and water. She indicated that the building was a retail store to begin with. She also wanted council to know that the neighbors support her efforts toward establishing a business there. Speaking in favor were: Fred Lowe: Mr. Lowe stated that retail store, should be retail adverse, would be nice. it used to be a rock shop, a again. He could see nothing Eleanor Bisel: It was her father's shop, was in operation until last year as a retail store. Thelma Taylor: It was a retail store until Sept. 1988, when they moved their mother from the premises. Katleen Hopkins: Owns a shop in a neighborhood district in Meridian, has no problems with traffic, would have just about as much traffic as this shop will. Doylene DeVer: She will be a partner in the business and believes that it would enhance the neighborhood. Councilman MINOW closed the public hearing and opened council discussion. City Council Meeting July 26, 1988 Page 2 Moved by MATLOCK and seconded by HAMMONS to approve the Conditional Use Permit as requested. ALL AYE~ MOTION CARRIED. Councilman MINOW declared that it was the time and the place for the second public hearing, Beggrow-Conditional Use Permit for a Day Care Center. Representing Dave Beggrow for the project was Dennis McCracken. Mr. McCracken advised the Council that he would appear before Planning and Zoning and Council again in August, at which time he would be more prepared for the hearing. Speaking in favor of the project were: Lori Bowles~ Asked for the same continuance in order to prepare figures and additional information requested by P&Z. There was no opposition. Moved by MATLOCK and seconded by HAMMONS to dispense with the rule requiring ordinances to be read on three different days and to consider Ordinance No. 139, a zoning ordinance immediately. ALL AYE: MOTION CARRIED. Moved by HAMMONS and seconded by MATLOCK to adopt Ordinance No. 139, An Ordinance Establishing The Zoning Classification of the Real Property Described as "A" or Agricultural, Amending the Zoning Map of the City of Eagle to Reflect said Change; and Providing a Date. (Quarter Circle DJ Ranch) ALL AYE, MOTION CARRIED. MAYOR'S REPORT~ By Councilman MINOW in Mayor GUERBER'S absence. BUDGET HEARING~ The City Council will meet in August on the 9th and 30th, skipping the 23rd, to provide for a public hearing on the budget. LETTER TO DESHAZO~ The City Clerk sent a letter to Robert DeShazo regarding the unsightly area at the entrance of Ranch Dr. Mr. DeShazo has not responded to the City's request to clean up the area. After the letter was sent there were more complaints, this time by the residents in Eagle Manor Apts. They would like to have Mr. DeShazo remove the trash in the adjoining field. There is a small 2 door building in the field, along with City Council Meeting July 26, 1988 Page 3 assorted cans, a door and miscellaneous debris. It was the directive of the council to have Mayor GUERBER phone Mr. DeShazo and advise him that both properties need to be cleaned up by August 19th. Council asked that he be advised that our Nuisance Abatement Ordinance would be acted upon after that time. BIDS: We have received two bids on the floor covering in the Senior/Community Center. Since both bids are initially the same amount, the council directed the City Clerk to establish dates for installation in accordance with the bid from "The Hitching Post", an Eagle business. BRICKS: Council was advised that the left over bricks from the building are disappearing at night. Council instructed the City Clerk to direct Mark McFall, the Parks Summer Trainer, to have his crew relocate the bricks inside the back enclosure to secure their safety. BUILDING COMPLETION: Councilmen MATLOCK and HAM_MONS toured the building and checked on the completion of projects due to be done. The Councilmen mentioned several areas not yet complete, including the back outside faucet. CLAIMS AGAINST THE CITY: Moved by HAMMONS MATLOCK to approve the claims as presented. CARRIED. and seconded by ALL AYE: MOTION Moved by MATLOCK and seconded by H/%MMONS to adjourn the meeting.
