Ordinance - 2020 - 831 - Amend Liquor Control, Hours Of Sale - 05/12/2020 ORDINANCE NO. 831 AN ORDNANCE AMENDING EAGLE CITY CODE TITLE 3 BUSINESS AND LICENSE REGULATIONS, CHAPTER 2 LIQUOR CONTROL, ARTICLE C LIQUOR BY THE DRINK, SECTION 10 HOURS OF SALE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A CODIFICATION CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Eagle is a municipal corporation operating under the laws of the state of Idaho; and WHEREAS, Idaho Code, Title 23 authorizes cities to regulate by ordinance the hours of sale of liquor; and WHEREAS, Idaho Code, Title 23 authorizes cities to regulate, by ordinance, the days of sale of liquor; and WHEREAS, the Mayor and City Council of the City of Eagle deem it to be in the public interest to amend its ordinance governing the hours and days of the sale of liquor. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF EAGLE, IDAHO as follows: Section 1: That Eagle City Code Title 3, Chapter 2C, Section 10 Hours of Sale, is hereby amended, as follows: A.No liquor shall be sold, offered for sale, or given away upon any licensed premises, and all liquor not in sealed bottles must be locked in a separate room or cabinet, during the following hours between two o'clock (2:00) A.M. and ten o'clock (10:00) A.M.: n f�ti,. +„ �;, +, t (').fl( A >\a « j �. .�. to ton o'clock (10:00) thc,• foll8wing R On any other day 1-ct.veert two o'clock (1:00) A.M. and o'clock(10:00) A M 1� v tii +.. ,. � + V 1 ten o'clock 1 V v i �,a B Liquor may be sold. offered for sale, or liven away upon any licensed premises any day of the year including Sundays, Memorial Day and Thanksgiving subject to the time restrictions provided for above. G Any patron present on the licensed premises after the sale of liquor has stopped as provided above shall have a reasonable time, not to exceed thirty (30) minutes, to consume any beverages already served. Any person who consumes or intentionally permits the consumption of any alcoholic beverage upon licensed premises after the time provided for above shall be guilty of a misdemeanor. 1 It shall be the duty of every person who is employed at or upon a licensed premises or who owns or manages a licensed premises and is present upon the licensed premises during the hours and at the time set forth in this section to lock up and keep locked up in a locked room or locked cabinet all unsealed containers of liquor during the hours and at the times set forth in this section, and any such person who fails to perform the duty provided herein shall be guilty of a misdemeanor Severability: If any provision of this section shall be held to be invalid by a court of competent jurisdiction, then such provision shall be considered separately and apart from the remaining provisions of this section. which shall remain in full force and effect.. Section 3: The City Clerk is instructed to immediately forward this ordinance to the codifier of the official municipal code for proper revision of the code. Section 4: That this Ordinance, or a summary thereof in compliance with Section 50- 901A, Idaho Code, shall be published once in the official newspaper of the City, and shall take effect immediately upon its passage, approval, and publication.
