Minutes - 2020 - City Council - 04/28/2020 - Regular EAGLE CITY COUNCIL MINUTES April 28,2020 1. CALL TO ORDER: Mayor Pierce calls the meeting to order at 5:30 p.m. 2. ROLL CALL: Present: PIKE, GOLD, PITTMAN, BAUN. All present. A quorum is present. 3. PLEDGE OF ALLEGIANCE: Mayor Pierce leads the Pledge of Allegiance 4. REPORTS: A. Mayor and Council Reports: Mayor Pierce briefly discusses the Governor's Stay At Home Order that is ending on the 30th and the 4-phase re-opening plan. Discussion regarding Eagle's approach to the re-opening. Chief Clifford discusses recent interactions with the public regarding social distancing concerns. The Police intend to move forward with the educational approach in hopes of continued self-monitoring for the individuals. They will continue to approach things on a case by case basis as the need arises. Discussion regarding messaging to the Eagle business community and residents. A special meeting will be held on Friday at 12:30 to appoint the COVID-19 Business Task Force Members. B. City Hall Department Supervisor Reports: Chief Clifford states that his deputies have PPE for their staff. Discusses the light call load that has resulted from the stay at home order. C. City Attorney Report: None 5. VIRTUAL PUBLIC COMMENT: The Eagle City Council is taking remote public comment via Webex. This time is reserved for the public to address their elected officials regarding concerns or comments they would like to provide to the City Council regarding subjects not on the agenda. At times,the City Council may seek comments/opinions regarding specific City matters during this allotted time. This is not the time slot to give formal testimony on a public hearing matter, land use application, or comment on a pending application or proposal. Out of courtesy for all who wish to speak, the City Council requests each speaker limit their comments to three(3)minutes. QVC- denotes virtual comment. Mayor discusses the roll out of the Virtual Public Comment technology that is being tested tonight. IT Director Goodman provides additional clarification. VC: Mary Ann and Harry Baker 124 S. Independent Contractor Agreement: An agreement between the City of Eagle and Fred Fritchman to retain his services to develop interpretive labels and exhibitory shop drawings for use at the Eagle Historical Museum. The cost shall not exceed $2,770.00, and the completion date shall be no later than September 20, 2020. (AD) D. EXT-01-20 — Preliminary Plat Extension of Time for Hollyhock Estates Subdivision (PP-07-18) — Kyle Enzler: Kyle Enzler, is requesting a one (1) year extension of time for the preliminary plat approval for Hollyhock Estates Subdivision, an 8-lot (7-buildable, 1-common) residential subdivision. The 6.72-acre site is located on the east side of North Lanewood Road approximately 770-feet north of the intersection of West Floating Feather Road and North Lanewood Road at 2220 North Lanewood Road. (MJW) E. Findings of Fact and Conclusions of Law for the Approval of FPUD-10-19 & FP-15-19 — Final Development Plan and Final Plat for Snoqualmie River Subdivision No. 4 — Red Butte, LLC: Red Butte, LLC, represented by David Sterling, P.E., is requesting final development plan and final plat approvals for Snoqualmie River Subdivision No. 4, a 66-lot (58-buildable, 7-common, 1 owned and maintained by developer) residential planned unit development. The 37.57-acre site is located at the northwest corner of the intersection of West Decathlon Street and North Palmer Lane. (MJW) F. Crime Victims' Rights Week Proclamation: A proclamation declaring April 19-25, 2020 as Crime Victims' Rights Week in the City of Eagle. (JP) G. Facility Use Agreement between Eagle United Methodist Church and the City of Eagle: A request for City Council to authorize an agreement with Eagle United Methodist Church located at 651 N. Eagle Rd., Eagle, Idaho 83616 for Eagle Parks and Recreation to conduct classes and activities and not to exceed $25.00 per hour per room. (BJ) Pittman requests the removal of item G. Facility Use Agreement between Eagle United Methodist Church and the City of Eagle: A request for City Council to authorize an agreement with Eagle United Methodist Church located at 651 N. Eagle Rd., Eagle, Idaho 83616 for Eagle Parks and Recreation to conduct classes and activities and not to exceed $25.00 per hour per room. (BJ) Pittman inquires as to the need for the use of this facility. Mayor Pierce states that The Landing will continue to be used, but if there is a conflict or it is unavailable for use, then the agreement would be in place and there would not be a delay in use. Staff is attempting to get things in place and prepared for the eventual reopening of all activities so there will not be scrambling when the time does come. ACTION ITEM: Eagle Island State Park Greenbelt Connection Contract: ,A request to authorize the Mayor to sign a contract supplement with JUB Engineers, Inc. to proceed with the steps that will result in the easements required to build a pathway into the State Park. Contract amount; $27,430.00 which will cover the costs of making two lot-line adjustments — one on a parcel in Eagle, one on a parcel in Ada County, completion of a land surveys and disclaimer process to the benefit of the Idaho Department of Lands and the Donald Newman family, and five (5) legal descriptions that the City will use to obtain easements from the Idaho Department of Lands. (STN) Mayor Pierce introduces the item. City Staff, Steve Noyes reviews a PowerPoint and provides the history of the project. Baun moves to approve the Mayor to sign a contract in the amount to not exceed $27,430.00 with JUB Engineers. Seconded by Pike. Discussion. Baun amends the motion to have Noyes work with the City Clerk to confirm where the funding will be obtained from within the budget. Second concurs. PIKE AYE; GOLD AYE, PITTMAN AYE; BAUN AYE. ACTION ITEM: Donation request from Idaho Suicide Prevention Hotline—John Reusser, Director: The Idaho Suicide Prevention Hotline saved the city of Eagle over $371,356 in direct costs and $27 million in indirect costs in 2019. Idaho Suicide Prevention Hotline is requesting a donation in an amount between $10,000 and $20,000. In addition, they are requesting an annual appropriation to the Hotline. (JP) Mayor Pierce introduces the item. General discussion regarding the cost savings to Eagle that were presented by the Idaho Suicide Prevention Hotline and the services provided. Pike moves to donate $10,000 to the Idaho Suicide Prevention Hotline, any additional funding would need to be addressed during the budgeting process. ACTION ITEM.' City of Eagle Summer Event Plans: A request for the Eagle City Council to provide direction to staff whether to hold, cancel, or modify Eagle Summer Events in light of the ongoing COVID-19 Pandemic. (JP) Mayor Pierce introduces the item. There are several City sponsored events and he would like Council to weigh in on, i.e. Eagle Fun Days, Saturday Market, splash pads, and Eagle Field of Honor are events/activities directly impacted by the COVID-19 emergency. Discussion amongst the Council regarding options for City sponsored events this summer in light of the COVID-19 state of emergency. Discussion regarding tabling the decision, moving forward and options for the same. Recreation Coordinator, Paige Martin and Public Works Director Eric Ziegenfuss provide clarification regarding the City's coordination of public events and the planning and staffing for the same. Seconded by Gold. Discussion. ALL AYE...MOTION CARRIES. Discussion regarding the location to launch fireworks. Pittman moves to direct staff to move forward to try and conduct fireworks at Eagle Island State Park and begin to work on the permitting process. Seconded by Baun. ALL AYE...MOTION CARRIES. Public Works Director Ziegenfuss gives an update on the status of the Merrill Park Splash Pad. It is still on schedule to be completed by Memorial weekend. Discussion of different water systems and treatments in the parks. Staff is looking for direction regarding opening dates for the splash pads. Average attendance at Guerber Park during the hot summer months can be up to 700 people, and with the update to Merrill Park it could experience the same attendance. General discussion. Staff will move forward with the preparation, but the item will be revisited as the state begins phasing in the re-opening. D. ACTION ITEMResolution 20-12 — Farming lease for Westpark Property: A resolution of the City Council of the City of Eagle, Idaho relating to the lease of real property; authorizing the Mayor to sign a farm lease agreement; and providing an effective date. (JP& EZ) Mayor Pierce introduces the item. Director Ziegen fuss states that the City was approached by a farmer wishing to farm the property this summer. Ziegenfuss states that there are no plans to move forward with construction on the property this summer and it does require expenditures for maintenance to knock down the weeds. City Attorney Villegas provides information regarding Idaho State Code requirements pertaining to entering a lease. Discussion amongst the Council. Baun moves to approve Resolution 20-12 a resolution of the City Council of the City of Eagle, Idaho relating to the lease of real property; authorizing the Mayor to sign a farm lease agreement; and providing an effective date and notify surrounding residents that the property will be farmed. E. *ACTION ITEM: City of Eagle Public Hearing and Board and Commission Meeting Discussion: A request for the City Council to discuss how and when to restart public hearings and board and commission meetings. Public hearings and board and commission meetings were suspended due to COVID-19 by declaration local disaster emergency orders 2020-01 and 2020- 03. Mayor Pierce introduces the item. Discussion amongst the Council. Pittman moves to direct the Mayor to go ahead and get the public hearing and Board and Commission meetings restarted. The motion to go into executive session shall identify the specific subsections of this section that authorize the executive session. There shall be a roll call vote on the motion and the vote shall be recorded in the minutes. An executive session shall be authorized by a two- thirds(2/3) vote of the governing body. An executive session may be held: A. 74-206(0 To communicate with legal counsel for the public agency to discuss the legal ramifications of and legal options for pending litigation, or controversies not yet being litigated but imminently likely to be litigated. The mere presence of legal counsel at an executive session does not satisfy this requirement. Mayor Pierce introduces the item. Pittman moves pursuant to I.C. 74-206(1)(f) that the City of Eagle convene an Executive Session for the purpose of: ) To communicate with legal counsel for the public agency to discuss the legal ramifications of and legal options for pending litigation, or controversies not yet being litigated but imminently likely to be litigated. Please see below for a few ideas: Eagle Saturday Market: Currently Parks and Recreation staff has begun Shop the Vendors on the City of Eagle website: httu://www.citvofeaLde.ore/i695/Shoo-the-Vendors. Additionally, The Eagle Saturday Market will not open Saturday, May 2 and a Social Distancing map has been created. Follow recommendations from the Idaho Farmers Market Association. See below: htip," wvvtiv.idahofma.orecoronavirus-advisory It is important that Markets keep the public informed regarding the steps taken during this time. Markets are encouraged to use their newsletters, websites, local and social media to communicate changes, updates, instructions and more to officials, community partners and potential customers and to promote the daily practice of everyday preventative actions as outlined by the CDC. Strategies for Markets choosing to operate Streamline Farmers Market Operations: • Limit vendors to those selling agricultural, food and personal care products. Page 1 of 3 • Use signage to communicate instructions and changes to "business as usual" to visitors. • Rearrange market layout, giving ten feet of space or more between booths in all directions. • If possible, rope off the market area, as much as possible, so that there are only one to two entrances/exits. Clearly mark these. • Have staff or volunteers at entrances/exits to monitor and manage the number of people in the market; set thresholds. • Consider implementing a set "traffic pattern" through the market and marking this with signage, chalk or tape. Increase Social Distance at Farmers Markets: • Cancel events such as music, demos, performances, youth programming, etc. • If possible, remove seating areas or discourage lingering or eating in the market space. • Eliminate sampling, tasting, and customer handling of products. • Consider marking a "do not cross" chalk or tape line 6 feet in front of each booth. • Post signs and hand out information giving instructions on the new temporary protocols Enhance cleaning and sanitation: • Clean and disinfect all "high-touch" surfaces such as tabletops. scales, cash registers, EBT or other handheld devices frequently. • Provide fully stocked mobile hand washing stations throughout the market. • If they can be found, have extra gloves, sanitizer and possibly masks on hand • Establish a procedure for handling money and tokens that includes wearing gloves. Advice for vendors: • Vendors in high risk categories or living with someone in this category should stay home. • Vendors who are sick, or who have been in contact with anyone testing positive for Covid-19 should stay home. • Post signage for indicating where customers wait to get an order taken and where they wait to pay. • If possible, have two people at the booth: one to handle product and the other to handle money and delivery. Page 2 of 3 • Don't allow customers to handle product. • Pre-bag and weigh items if possible. • Wear gloves and change them often. • Have hand sanitizer (if available) and a hand washing at your booth. • Clean & sanitize surfaces and objects frequently. • Let customers know of alternate ways for to access your products. Gazebo Concert Series: Work with scheduled bands to play Facebook Live concert on the our already scheduled dates in June and July. Eagle Fun Days: Virtual Eagle Fun Days Ideas • Build your own mini float (post photos of float on FB for all to see) • Virtual fireworks show (kiddos submit drawings of fireworks and we create a slideshow to music and post the video on FB for all to see) • Virtual Race (Jess) o This would involve Eagle fun day run participants running a 5K on their own and self-reporting their time and they would receive a medal from the City of Eagle. • Virtual Car show (have people post photos of their cars on FB for all to see) • EFD vendors page to support the vendors? • Oyster feed recipe • Brainstorming a virtual cornhole tournament Yappy Hour: No alternatives yet Page 3 of 3
