Minutes - 1982 - City Council - 12/14/1982 - Regular51 CITY OF EAGLE COUNCIL MINUTES DECEMBER 14, 1982 The council met in regular session on Tuesday, December 14, 1982. Mayor Jerry Deckard Presiding. Roll call showed the following members present: HALEY, STOPPELLO, WALKER. Moved by HALEY seconded by WALKER to approve the minutes of November 9, 1982 as printed. Motion resulted as follows: AYE: STOPPELLO, HALEY, WALKER. Motion carried. Roy Butler from Messuri, Bates & Gibbons, presented the annual audit report for the fiscal year 1980-81 to the council. Councilwoman HALEY reported that the Library board would like to post a "No Smoking" sign in the library and have it enforced. Councilman STOPPELLO reported on the progress that the Planning and Zoning commission had made on the com- prehensive plan and the recommendations that they wish to make on the proposed Subdivision ordinance. Judy Knight, manager of the Eagle Bank Club was present to ask the council to renew the beer and wine license for the Bank Club. Ron Marshall asked the council if the patrons of the Eagle Bank Club could be more respon- sible for cleaning up the area. Ms. Knight reported to the council that she would make every effort to see that the problems of parking and clean up around the Bank Club would be taken care of. Moved by STOPPELLO and seconded by HALEY to renew the beer and wine license for 1983 to Bar, Ink, Inc. dba The Eagle Bank Club, with the stipulation that the problems of parking and clean up be taken care of. Motion resulted as follows: AYE: HALEY, STOPPELLO, WALKER. Motion carried. Moved by HALEY and Seconded by STOPPELLO to have the City attorney notify the Farmers & Merchants Bank that their Conditional Use Permit had expired and that they had sixty (60) days to move their mobile unit. Moved by HALEY and seconded by WALKER that in accordance with Idaho Code 5902 we dispense with the rule requiring an ordinance be read on three different days, one reading in full, on Ordinance No. 83. Roll call on the motion resulted as follows: AYE: HALEY, STOPPELLO, WALKER. Moved~ by HALEY and seconded by WALKER to adopt Ordinance No. 83 AN ORDINANCE AMENDING ANNEX "B" TO ORDINANCE NO. 55 AS AMENDED BY ORDINANCE NO. 74; DELETING AREAS "A" AND "B" OF THE DESIGN REVIEW OVERLAY DISTRICT AND SUBSTITUTING THEREFOR 52 A SINGLE DESIGN REVIEW OVERLAY DISTRICT: PROVIDING GENERAL GUIDELINGS FOR THE CONSTRUCTION, ERECTION AND MAINTENANCE OF SIGNS WITHIN THE DESIGN REVIEW OVERLAY DISTRICT; PROVIDING STANDARDS FOR ADVERTISING BRAND NAME PRODUCTS ON SIGNS AND FOR THE TOTAL PERIMETER AREA OF SIGNS; PROVIDING FOR A FORMULA FOR DETERMINING PERIMETER AREA OF SIGNS; PROVIDING FOR A FORMULA FOR DETERMINING TOTAL PERIMETER AREA OF IN- DIVIDUAL LETTER SIGNS; REPEALING CERTAIN PROVISIONS RELATING TO INDIVIDUAL BUSINESS SIGNS; PROVIDING STANDARDS FOR PYLON DETACHED STREET SIGNS AND POLE SIGNS; PROVIDING FOR THE EXTERNAL LIGHTING OF SIGNS WITHIN THE DESIGN REVIEW OVERLAY DISTRICT, PROVIDING FOR SUBMISSION OF A MASTER SIGN PLAN BY DEVELOPERS OF SHOPPING CENTERS, MINI-MALLS AND SIMILAR PROJECTS TO THE DESIGN REVIEW BOARD; PROVIDING FOR THE REMOVAL OF NON-CONFORM- ING SIGNS; PROVIDING FOR COMPLIANCE WITH THIS ORDINANCE UPON ANY MATERIAL CHANGE TO A NON-CONFORMING SIGN; PROVIDING FOR EXEMPTIONS FROM THIS ORDINANCE FOR BUSINESSES OF LOCAL HISTOR- ICAL SIGNIFICANCE; ADDING A SEVERABILITY CLAUSE AND PROVIDING AN EFFECTIVE DATE. Moved by HALEY and seconded by STOPPELLO that in accordance with Idaho Code 5902 we dispense with the rule requiring an ordinance be read on three different days, one reading in full, and adopt the Floodplain ordinance #82 AN ORDINANCE FOR THE CITY OF EAGLE, ADA COUNTY, IDAHO, REPEALING ARTICLE VIII, FLOODPLAIN OVERLAY DISTRICT (FP) OF ORDINANCE NO. 40, ZONING ORDINANCE: AMENDING ARTICLE I, SECTION B, MEANING OF TERMS OR WORDS, OF ORDINANCE NO. 40; SETTING FORTH FINDINGS OF FACT STATEMENT OF PURPOSE, METHODS OF REDUCING FLOOD LOSSES, AND DEFINITIONS; SETTING FORTH GENERAL PROVISIONS; CREATING A FLOODWAY DISTRICT AND ESTABLISHING BOUNDARIES THEREOF; PROVIDING FOR OFFICIAL MAPS; PROVIDING FOR COMPLIANCE AND FOR ABROGATION AND GREATER RESTRICTIONS, INTERPRETATION, AND WARNING AND DISCLAIMER OF LIABILITY; ESTABLISHING A DEVELOPMENT PERMIT; DESIGNATING A ZONING ADMINISTRATOR AND HIS DUTIES; PROVIDING FOR APPROVAL OF DEVELOPMENT PERMIT APPLICATIONS BY PLANNING AND ZONING COMMISSION AND CITY COUNCIL; PROVIDING FOR APPEALS TO THE DISTRICT COURT; PROVIDING FOR VARIANCES; ESTABLISHING PROVISIONS FOR FLOOD HAZARD REDUCTION, SPECIFIC STANDARDS AND FLOODWAYS; PROVIDING FOR ENFORCEMENT AND PENALTIES, CONTENT OF APPLICATIONS, APPROVAL OF AND EXPIRATION OF DEVELOPMENT PERMITS; PROVIDING FOR A SCHEDULE OF FEES; AND PROVIDING FOR AN EFFECTIVE DATE. Roll call on the motion resulted as follows: AYE: HALEY, WALKER, STOPPELLO. Motion carried. Mayor Deckard read a letter from Green Acre Properties asking for annexation of 64.55 acres. The Mayor directed that a letter be sent to them asking if they have contacted the water and sewer districts inquiring about service to the area. A proposal from Sterling Codifier's Inc. was reviewed. Interest was high but there was no decision made at this time. 53 There was discussion about the old copier and the clerk was instructad to ask Orval Krasen if he would like to purchase it for $250.00. A Design Review application by Baird Oil Co. was presented by Ron Marshall along with recommendations from the Design Review Committee. The Mayor declared a recess at 9:10 p.m. to enable the City attorney to study a point of law concerning the Design Review. Mayor Deckard reconvened the meeting at 9:15 p.m. and called for an attorneys opinion. City attorney Pat Riceci reported that anytime a building falls within the Design Review, all the criteria is applicable. HALEY, STOPPELLO, WALKER. Motion carried. Moved by HALEY and seconded by WALKER to extend for one year the Conditional Use Permit to Clifford Stevenson for a Mobile Home Park at 821 State Stree. The motion resulted as follows: AYE: HALEY, WALKER, STOPPELLO. Motion carried. The bill from Ada Planning & Zoning was reviewed and discussion was tabled on the subject until Councilman Decker could be at the meeting. The bill from Ada-Data will be reviewed at the next joint meeting of the Council and Planning and Zoning Committee. Moved by HALEY and seconded by WALKER to approve the Design Review application #7-82 of Ron Marshall's to remodel the feed store. The motion resulted as follows: AYE: HALEY, STOPPELLO, WALKER. Motion carried. Moved by HALEY and seconded by WALKER to pay the claims against the City. Motion resulted as follows: AYE: HALEY, STOPPELLO, WALKER. Motion carried.
