Minutes - 1982 - City Council - 08/31/1982 - Regular35 CITY OF EAGLE COUNCIL MINUTES AUGUST 31, 1982 The council met in regular session on Tuesday, August 31, Mayor Jerry Deckard presiding. 1982. Roll call showed the following members present: DECKER, STOPPELLO, WALKER. Moved by STOPPELLO and seconded by DECKER to amend the minutes of the previous meeting as follows: Page 31, paragraph 4, add: It was the the concensus of the council that we follow the legislative process for amending the comprehensive plan. Motion resulted as follows: AYE: DECKER, STOPPELLO, WALKER. Motion carried. Moved by STOPPELLO as amended. Motion resulted as Motion carried. and seconded by WALKER to accept the minutes follows: AYE: DECKER, STOPPELLO, WALKER. Moved by DECKER and seconded by STOPPELLO to ask unanimous council approval to place Resolution 6-82 on the agenda. Motion resulted as follows: AYE: DECKER, STOPPELLO, WALKER. Motion carried. Moved by DECKER and seconded by WALKER to adopt Resolution 6-82 A RESOLUTION ESTABLISHING THE SUPPORT OF THE MUSCULAR DYSTROPHY ASSOCIATION, SUPPORTING THE LABOR DAY TELETHON FOR 36 THE MUSCULAR DYSTROPHY ASSOCIATION AND ENCOURAGE THE RESIDENTS OF THE CITY OF EAGLE TO SUPPORT ELIZABETH ADAMS AND LORI GALLOWAY IN THEIR CRUSADE AGAINST MUSCULAR DYSTROPHY. Roll call on the motion resulted as follows: AYE: DECKER, STOPPELLO, WALKER. Motion carried. Moved by DECKER and seconded by STOPPELLO that in accordance with Idaho Code 5902 we dispense with the rule requiring an ordinance be read on three different days, one reading in full, and adopt the public hearing ordinance for the City of Eagle and assign Ordinance No. 80 to it. AN ORDINANCE OF THE CITY OF EAGLE, ADA COUNTY, IDAHO, PROVIDING PROCEDURES FOR THE CONDUCT OF PUBLIC HEARINGS; ESTABLISHING REQUIREMENTS FOR WRITTEN TESTIMONY; ESTABLISHING REQUIREMENTS FOR ORAL TESTIMONY; ESTABLISHING STANDARDS OF CONDUCT FOR PARTICIPANTS IN THE PUBLIC HEARING PROCEDURE; AND PROVIDING AN EFFECTIVE DATE. Roll call on the motion resulted as follows: AYE: DECKER, STOPPELLO, WALKER. Motion carried. Moved by WALKER and seconded by DECKER to override the decision of the building inspector and allow Baird Oil Company to operate four video games in a loft area 12' X 28' at the Sun Ray Dairy with one restroom as long as they continue to provide facilities for either sex. Roll call on the motion resulted as follows: AYE: DECKER, STOPPELLO, WALKER. Motion carried. Moved by DECKER and seconded by STOPPELLO to accept the recommend- ation of the Design Review Commission and approve Design Review #3-82, Ron Marshall for 124 E. State Street. 37 Roll call on the motion resulted as follows: STOPPELLO, WALKER. Motion carried. AYE: DECKER, Moved by DECKER and off premise beer and wine license Motion resulted as follows: AYE: Motion carried. seconded by STOPPELLO to approve an on and for the Way Station Pizza Parlor. DECKER, STOPPELLO, WALKER. Moved by DECKER and seconded by WALKER that the Eagle City recommend approval of zoning transmittal 82-21-CU - Ronald Young for a heliport to be located approximately 1/4 mile west of Ballantine Road on the north side of Beacon Road provided., A. That the business not be able to be expanded beyond what is proposed without future recommendations of the Eagle City Council. B. That the helicopters to be serviced not operate inside Eagle's Air Space between the hours of 10:00 P. M. and 6:00 A. M. except in emergency involving the savings of lives. Motion resulted as follows: AYE: DECKER, WALKER. NAY: STOPPELLO. Motion carried. Mayor Deckard announced that this was the time and the place for a public hearing on the 1982-83 budget. There being no testimony to come before the council, the public hearing was declared closed. 38 Moved by DECKER and seconded by WALKER that in accordance with Idaho Code 5902 we dispense with the rule requiring an ordinance be read on three different days, one reading in full, and adopt the annual appropriation ordinance for the City of Eagle for 1982-83 certifying an amount of $28,990 to the county for taxes and assign Ordinance No. 81 to it. AN ORDINANCE MAKING AN APPROPRIATION OF MONEY FOR ALL THE NECESSARY EXPENSES AND LIABILITIES OF THE CITY OF EAGLE, ADA COUNTY, IDAHO FOR THE FISCAL YEAR COMMENCING THE FIRST DAY OF OCTOBER, 1982, AND ENDING THE THIRTIETH DAY OF SEPTEMBER, 1983. THIS ORDINANCE BEING KNOWN AS THE ANNUAL APPROPRIATION BILL, AND DECLARING AN EMERGENCY. Roll call on the motion resulted as follows: AYE: DECKER, WALKER, STOPPELLO. Motion carried. A letter of resignation was read from Judy Mendiola submitting her resignation as City Clerk/Treasurer for the City of Eagle effective November 30, 1982.
