RESOLUTION No. 14-13
A RESOLUTION OF THE EAGLE CITY COUNCIL TO VACATE THE UTILITY, DRAINAGE, AND
IRRIGATION EASEMENTS FROM THE INTERIOR LOT LINES OF LOTS 1 AND 2, BLOCK 1
(DRY CREEK ESTATES SUBDIVISION) AS SHOWN ON THE ATTACHMENTS HERETO; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, Mark and Deborah Wald, requested a vacation to the final plat of Dry Creek Estates
Subdivision to vacate the 6-foot wide utility, drainage, and irrigation easements from the interior lot lines
of Lots 1 and 2,Block 1 (Dry Creek Estates Subdivision); and
WHEREAS, On March 17, 2014, the Planning and Zoning Commission recommended approval
of the vacation(VAC-03-14),with conditions,to the City Council; and
WHEREAS,Legal notice of the City Council hearing on the vacation was published in the Valley
Times on March 24, 2014, and March 31, 2014; and
WHEREAS, On April 8, 2014, the City Council held a public hearing on the proposed vacation
(VAC-03-14), and voted to approve the vacation with conditions; and
WHEREAS, The City Council hereby finds that the proposed vacation complies with the
provisions of Section 50-1306A of the Idaho Code, "Vacation of Plats - Procedure", and Section 9-6-2 of
Eagle City Code, "Vacations and Dedications."
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF
EAGLE,IDAHO.
The Eagle City Council hereby vacates the utility, drainage, and irrigation easements from the
interior lot lines of Lots 1 and 2,Block 1, of the final plat of Dry Creek Estates Subdivision, as considered,
heard; and approved by the Council at its April 8, 2014, public hearing for application number VAC-03-
14, and as shown on the attachments hereto(Exhibit A).
This Resolution shall be in full force and effect immediately upon its adoption and approval.
ADOPTED by the Council of the City of Eagle,Idaho,this 24th day of June, 2014.
