A RESOLUTION OF THE EAGLE CITY COUNCIL TO VACATE THE 14-FOOT WIDE
PERMANENT UTILITIES, DRAINAGE AND IRRIGATION EASEMENT LOCATED ON LOT 54,
BLOCK 7, ON LAKEMOOR SUBDIVISION NO. 1 AS SHOWN ON THE ATTACHMENTS
HERETO; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, DMB Development, LLC, requested a vacation to the final plat of Lakemoor
Subdivision No.1 to plat note number 6 that references all lots contain a 14-foot wide permanent utility,
drainage, and irrigation easement common to a public right-of-way and private roads by providing
additional language indicating that the three (3) exterior boundaries of Lot 54, Block 7, contains a twelve
foot(12')wide permanent utilities, drainage, and irrigation easement; and
WHEREAS, On June 17, 2013, the Planning and Zoning Commission recommended approval of
the vacation (VAC-03-13), with conditions,to the Council; and
WHEREAS,Legal notice of the City Council hearing on the vacation was published in the Valley
Times on July 8, 2013, and July 15, 2013; and
WHEREAS, On July 23, 2013, the City Council held a public hearing on the proposed vacation
(VAC-03-13), and voted to approve the vacation with conditions; and
WHEREAS, The City Council hereby finds that the proposed vacation complies with the
provisions of Section 50-1306A of the Idaho Code, "Vacation of Plats-Procedure", and Section 9-6-2 of
Eagle City Code, "Vacations and Dedications."
NOW THEREFORE,BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF
EAGLE, IDAHO.
The Eagle City Council hereby vacates a section plat note number 6 that references all lots
common to a public right-of-way or private roads have a 14-foot wide permanent utilities, drainage, and
irrigation easement, by providing additional language indicating that the three (3) exterior boundaries of
Lot 54, Block 7, contains a twelve foot(12')wide permanent utilities, drainage, and irrigation easement as
considered, heard, and approved by the Council at its July 23, 2013, public hearing for application number
VAC-03-13, and as shown on the attachment hereto (Exhibit A) and as shown on the "Affidavit of
Correction"for plat note number 6 (Exhibit B).
This Resolution shall be in full force and effect immediately upon its adoption and approval.

I,Michael S.Byrns,a Professional Land Surveyor,licensed by the State of Idaho,on behalf of JUB Engineers,Inc.,as a portion of
the procedure required by the City of Eagle,Idaho,Planning Department to vacate permanent utilities,drainage and irrigation
easements,do hereby append this change to the plat of Lakemoor Subdivision No.1,recorded in the office of the Ada County
Recorder on July 26th,2007 as Instrument No.107105832,in Book 98 of Plats at Pages 12560 through 12566. The purpose of
the vacation is to remove the easements along a portion of Lot 54 of Block 7 in preparation of re-platting.
As a portion of the procedure required by the City of Eagle,Idaho,Planning Department to vacate permanent utilities,drainage
and irrigation easements,Plat Note 6 of Lakemoor Subdivision No.1 shall be modified to read:
6.All lot lines common to public right-of-way and private roads shall have a 14-foot wide permanent utilities,
drainage and irrigation easement,and all exterior boundaries and rear lot lines EXCEPT the three exterior boundary
lines of Lot 54 of Block 7 that are dealcted as 582'45'41"W.445.04';N11'20'06"W,100.00':and 578"39'54"W,
74.88'shall have a 12-foot wide permanent utilities,drainage and irrigation easement unless otherwise dimensioned.
However,this shall not preclude the construction of proper hard surfaced driveways for access to each individual lot.
As a portion of the procedure required by the City of Eagle,Idaho,Planning Department to vacate permanent utilities,drainage
and irrigation easements,two pages of Plat of Lakemoor Subdivision No.1,depicting the note change and graphically depicting
the easements being vacated,are attached.
