The regular meeting of the Eagle City Council was called to order
by Mayor Deckard at 7:30 P. M. on May 12, 1981 at the Eagle City
Hall.
Members present: DECKER, HALEY, KRASEN, PEARMAN.
Moved by KRASEN and seconded by HALEY that the minutes of the previous
meeting of April 28, 1981 be approved as printed.
Motion resulted as follows: AYE: DECKER, HALEY, KRASEN, PEARMAN.
Motion carried.
Park Commissioner HALEY announced that a bid for Hillside Park
had been awarded to N. Freeman Construction in the amount of
$26,030.00 on May 12, 1981.
Mayor Deckard read Ordinance #70 by title only.
WHEREAS the Eagle City Council received an application for Terry
Klein for a zoning ordinance amendment, and upon receiving such
application met all the specifications of Article XVII AMENDMENT,
Eagle city Zoning Ordinance #40, and;
WHEREAS this application is in compliance with the Eagle Comprehensive
Plan, and;
WHEREAS this amendment is in concert with all other general requirements
of the Eagle Zoning Ordinance, and;
WHEREAS, all requirements of law have been met in accordance with public
hearings by the Planning and Zoning Commission and their recommendations
and public hearing by the Eagle City Council,
THEREFORE, I move for adoption of Ordinance #70 amending the Eagle
Zoning Ordinance to provide for an M-IA Zoning Designation.
Moved by DECKER and seconded by PEARMAN.
KRASEN called for point of order that motion was not in order at this
time since it had been read only once by title only.
Moved by DECKER and seconded by PEARMAN to waive the requirement that
causes Ordinance #70 to be read three times and that we dispense with
the full reading of the ordinance and that it be read by title only.
Roll call on the motion resulted as follows: AYE: DECKER, HALEY,
KRASEN, PEARMAN. Motion carried.

WHEREAS the Eagle City Council received an application for Terry

AN ORDINANCE AMENDING ORDINANCE 40, ARTICLE III, SECTION B OF THE
CITY OF EAG~, IDAHO, BY ADDING A NEW ZONING DESIGNATION OF M-IA
AND ESTABLISHING THE REGULATIONS FOR THE DEVELOPMENT AND SPECIFIC
PURPOSE OF SAID ZONING DISTRICT.
Roll call on the motion resulted as follows: AYE: DECKER, HALEY,
KRASEN, PEARMAN. Motion carried.

Moved by DECKER and seconded by PEARMAN to waive the requirement that

Mayor Deckard read Ordinance #71 by title only.
WHEREAS, the owner of the lands and territory, situate in Ada County
and particularly described .in Section One of Ordinance #71 has requested,
in writing, annexation of said lands to the City of Eagle; and
WHEREAS, the Eagle City Council has found and determined that said lands
and territory are contiguous and adjacent to Eagle City and that
annexation of said lands can reasonably be used for orderly development
of Eagle City and said annexation is in accordance with the Eagle
Comprehensive Plan;
WHEREAS, the Eagle City Planning and Zoning Commission, pursuant to
public notice as required by law, held a public hearing on February
3, 1981, and recommended to the Mayor and Council that annexation be
approved and that this property be zoned M-IA; and
WHEREAS, the Eagle City Council, pursuant to public notice as required
by law, held a public hearing on April 14, 1981, on the proposed zoning
for the property described in Ordinance #71, Section 1, all as required
by Idaho Code Section 67-6525 DECKER moves and PEARMAN seconds for
adoption of Ordinance #71 AN ORDINANCE ANNEXING CERTAIN LANDS AND
TERRITORY, SITUATE IN ADA COUNTY, IDAHO AND CONTIGUOUS TO THE CORPORATE
LIMITS OF THE CITY OF EAGLE; ESTABLISHING AND DETERMING THE LAND USE
CLASSIFICATION OF SAID LANDS AS M-IA: PROVIDING THAT COPIES OF THIS
ORDINANCE SHALL BE FILED WITH THE ADA COUNTY AUDITOR, THE ADA COUNTY
TREASURER, THE ADA COUNTY ASSESSOR, AND THE IDAHO STATE TAX COMMISSION,
AS REQUIRED BY LAW: AND PROVIDING AN EFFECTIVE DATE.
Councilman KRASEN read a statement and asked that it be entered as
a part of the minutes. Statement is attached hereto.

KRASEN moved and HALEY seconded a substitute motion that with the
permission of the applicant that this annexation be tabled and final
action be taken after the revised or new comprehensive plan is adopted,
if the applicant does not agree, the annexation be denied for the
reasons set for in the written testimony attached.
Roll call on the motion resulted as follows: AYE: KRASEN, HALEY,
NAY: DECKER, PEARMAN. Mayor Deckard was called on to break the tie.
His vote was AYE. Motion carried.
Councilman KRASEN gave a report on the sewer meeting he attended.
Moved by DECKER and seconded by HALEY to pay the claims against the
city for April.
Roll call on the motion resulted as follows: AYE: DECKER, HALEY,
KRASEN, PEARMAN. Motion carried.
There being no further business to come before the council, the meeting
was adjourned.
