WHEREAS, Gardner Mace Ranch,LC, requested a vacation to the final plat of Mace River Ranch Subdivision No. 1 to vacate a portion of the utility, drainage, and irrigation easements from Lot 8, Block 3 and Lot 3,Block 4(Mace River Ranch Subdivision No. 1); and WHEREAS, On January 21, 2014, the Planning and Zoning Commission recommended approval of the vacation (VAC-01-14), with conditions,to the Council; and WHEREAS, Legal notice of the City Council hearing on the vacation was published in the Valley Times on January 27, 2014, and February 3, 2014; and WHEREAS, On February 11, 2014, the City Council held a public hearing on the proposed vacation (VAC-01-14), and voted to approve the vacation with conditions; and WHEREAS, The City Council hereby finds that the proposed vacation complies with the provisions of Section 50-1306A of the Idaho Code, "Vacation of Plats - Procedure", and Section 9-6-2 of Eagle City Code, "Vacations and Dedications;"and NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF EAGLE, IDAHO. The Eagle City Council hereby vacates a portion of the utility, drainage, and irrigation easements from Lot 8, Block 3 and Lot 3, Block 4, of the final plat of Mace River Ranch Subdivision No. 1, as considered, heard, and approved by the Council at its February 11, 2014, public hearing for application number VAC-01-14, and as shown on the attachments hereto(Exhibit A). This Resolution shall be in full force and effect immediately upon its adoption and approval. ADOPTED by the Council of the City of Eagle, Idaho,this 8th day of April, 2014.
