Minutes - 2014 - City Council - 02/11/2014 - Regular EAGLE CITY COUNCIL Minutes February 11,2014 PRE-COUNCIL AGENDA: 5:30 p.m.- 6:30 p.m. A. Arts Commission Report: Meg Glasgow, Chairman of the Arts Commission, provides Council an overview of the Public Arts Survey that was previously conducted. Discusses the Boise Philharmonic; we are joining with them to bring the Summer Concert Series to Eagle. Currently we have a call out to artists to display their work at City Hall, St. Luke's Gallery and the Pop Galleries in First Friday; discusses the Art's in the Park project; exciting changes are coming to the Saturday Market; Public Art; and the Eagle Sculpture Invitational. General discussion. B. Library Director's Report: Director Bumgarner distributes the January 2014 Usage Statistics and discusses the same. January we were up 11% over last year; gate count was up 8%and our circulation is up. We are heading for a gate count of 310,000 which is the second best ever. Discussion on the children's programs which are doing very well. We are starting a marketing awareness campaign called Geek the Library which is nationally funded through OCLC and the Bill and Melinda Gates Foundation. We are creating poster that we are going to put throughout the building(displays some posters). Discusses the program. General discussion. C. Department of Environmental Quality Presentation-Pete Wagner(DEQ),David Luft(Air Quality), Lance Holloway(Water Quality) Pete Wagner,Administrator, Boise Regional Office: Distributes copies of the power presentations. The issues we are going to talk about tonight are near and dear to our heart. Provides Council an overview of the Treasure Valleys Air Quality. Dave Luft, Regional Air Shed Manager, displays a power point and provides Council an overview of the air Quality in the Treasure Valley. Lance, Holloway, Regional Watershed Manager, displays a power point about the Lower Boise River Total Phosphorus TMDL and provides the Council an overview. D. Mayor and Council Reports: Mayor: No report Butler: After Mr. Guerber and Mr. VanArnem talked about ITD issues I asked if we could get that on an agenda. I contacted Dave Szplett then I emailed you on Susan. On March 1 Dave Szplett or someone else will be here. I put the things on that Mr. Guerber and Mr. VanAmem mention so if other Council Members want something to be discussed they will need to contact the Mayor. Another thing, I think it is always good that when we want to talk we go through the Mayor and not be so informal. This is a procedure that we need to utilize and try not to interrupt. Compass will do the modeling that we proposed. Compass will not be able to model adding lanes to Hwy 44 beyond what is beyond Communities In Motion that is 4 lanes from Hwy16 into town. If there is additional model showing additional lanes on the State system we will have to do that ourselves and I will look for a contingency for that. General discussion. City Attorney Cherese McLain: It is a lawsuit by three individuals against the City in regards to an alleged defect with a development agreement which was signed by the City. ALL AYES; MOTION CARRIES Mayor recognizes Gretchen Gilbert, President of the Chamber. She has been working really, really hard for the last couple of weeks to put on the State of the City. 4. PUBLIC COMMENT: Patricia Minkiewicz wants to know the difference between an appeal and a lawsuit. City Attorney Cherese McLain explains the difference. Cheryl Bloom, I need to read this into the record: Has the Council been notified of the Petition and the letter that accompanied the Petition from Dana Hofstetter that was faxed to Susan Buxton this afternoon? Cherese McLain, City Attorney: I'm sorry this is all part of the pending litigation that will go into Executive Session. Cheryl Bloom takes her seat. 5. Peak Alarm Company Schedule of Service and Equipment Agreement: Repair agreement for City Hall building. (MA) Kunz: Discusses Item#7 in the Contract on the increase of fees. Has the cost of this contract increased by 10%year over year. PR-Facilities Director Aho: this for the door mag locks and this is a standard contract that they utilize for their services. Kunz: On this matter there are a series of responses that the developer has provided to the Site Specific Conditions and in reading through some of those responses, discusses the responses, several of the responses merely say"noted"and I want to confirm with Planning and Zoning that that response of"noted"means there is an understanding that they agree they will fulfil those site development agreements and that there are no anticipated problems with fulfilling the"noted Site Specific Conditions of Approval. Planner Baird-Spencer: my understanding yes,that is in the affirmative that they are aware and have been made aware of that requirement. (NAAQS). DEQ conducts air quality monitoring to determine compliance with the NAAQS. If an area violates a NAAQS, the area is considered Non -Attainment. People's health is at risk. • Plan must be developed to regain and stay in compliance. • Permanent and enforceable control measures must be implemented. — The Ada County I/M Program and local "burn ban " ordinances are examples of control measures. • The State would solicit the participation of elected officials, regulated businesses, and the general public to evaluate ozone reduction strategies. • The strategies must be detailed in technically supported and legally enforceable plans known as State Implementation Plans (SIPs). SIPs are federally enforceable. Attainment SIP, Maintenance SIP. (30 years). • Economic impacts — Difficult for new businesses to locate, or to modify existing businesses — More stringent permitting requirements — Stigma of nonattainment What is Being Done? Implemented Ozone Reduction Measures • Stage 1 vapor recovery at gas stations • Local ordinances for air quality — Open burning bans based on AQI (Inconsistent) — Residential wood heat bans based on AQI • Vehicle emission testing in Ada & Canyon Counties • DEQ air quality permitting program • Outreach and education • Local efforts — governments and individuals • "Low hanging fruit" has been completed 2/11/2014 4 Voluntary Measures Motor vehicles • Reduce VMT - Carpool, transit, bike, link trips, etc. • Tune up your car • Don't idle • Complying with vehicle I/M requirements Gas -powered lawn and garden equipment • Keep maintained • Replace with electric alternatives Limit paint and solvent use • Low VOC paints Don't burn Questions?
