Minutes - 1974 - City Council - 11/12/1974 - Regular CFI'Y OF EAGLE P.O. BOX 477 · EAGLE, IDAHO 83616 November 12, 1974 The regular meeting of the City of Eagle was held November 12, 1974 at 7:3© P. N. John Smidt made a motion to approve the minutes as written. LeRoy Pearman seconded the motion. Joe Stewart, Signs Inc., appealed to the council that they grant a variance on Ordinance #10 and allow Tru-Value 0il Co. to place a sign on the corner of Highway 44 and Eagle Road that is larger than the one allowed for in the Ordinance. John Smidt made a motion to instruct the Planning and Zoning Commission to study the restrictions of signs in this ordinance and report back to the council. Elmer Bacus seconded the motion. Emily DeShazo abstained. Representatives from Jim-Bo's Cafe and the Bank Club requested the council to lower the beer license fee. John Smidt made a motion to check into ordinances from other municipalitys and wait until December to discuss this matter. LeRoy Pearman seconded the motion. John Smidt made a motion to accept the treasurer's report and Elmer Bacus seconded the motion. Elmer Bacus made a motion to ~pprove the following purchase payments, Desk Chai~ $119.50, Typewriter Table $46.10~ and Vacumn Cleaner $50.00 for a total of $215.60 that was budgeted under fixed assets. LeRoy Pearman seconded the motion. LeRoy Pearman asked Attorney Cosho to check the code governing municipalitys to see if we are obligated to carry Workman's Compensation under the State Insurance Fund. John Smidt made a motion to table a raise for the Mayor until budgeting time. Attorney Cosho made reference to Section 50-203 of the Idaho Code where it is illegal to raise the salarys of elected officials at this time. Le Roy Pearman seconded the motion. John Smidt made a motion to approve the recozanendation of ~h~ Plafining and Zoning Commission concerning Gem Realty. Elmer Bacus seconded the motion. Emily DeShazo abastined. John Smidt made a motion to dispense with the rules and adopt the corrected version of Ordinance #20 creating a Planning and Zoning Commission. John Smidt made a motion to refuse a variance to John Nills to place a sign on Budget Furniture that would exceed the specifications in our ordinance. He ~eferred the matter to Planning and Zoning. Elmer Bacus Seconded the motion. John Smidt made a motion to direct the City Clerk to find a competent certified surveyor to survey the boundary line of the City of Eagle closest to the Beer property, establish the line and make a rough drawing of the number of feet that exist between the trailer and the city limits. Upon her recommendation the Nayor is to hire this service done for the City and sent to Attorney Cosho. Elmer Bacus seconded the motion. The City Clerk was instructed to draft an ordinance creating a park and recreation commission ~for the approval of the council at the December meeting.
