Ordinance - 2014 - 710 - Create Title 11/Summary - 01/14/2014 SUMMARY OF ORDINANCE NO. 710 AN ORDINANCE OF THE CITY OF EAGLE, ADA COUNTY IDAHO, ESTABLISHING TITLE 11 "PLANNED DEVELOPMENTS", SECTION A "SPRING VALLEY", CHAPTER 1 "DEVELOPMENT STANDARDS, INTERPRETATION AND DEFINITIONS", CHAPTER 2 "PERMITTED USES", CHAPTER 3 "DESIGN REVIEW", CHAPTER 4 "SPECIFIC USE STANDARDS", CHAPTER 5 "OFF STREET PARKING AND LOADING", CHAPTER 6 "NON-CONFORMING USE", CHAPTER 7 "PLANNING UNIT MASTER PLANS", CHAPTER 8 "ZONING ADMINISTRATION AND ENFORCEMENT", CHAPTER 9 "AREA OF CITY IMPACT", CHAPTER 10 "HISTORIC PRESERVATION", CHAPTER 11 "DEVELOPMENT AGREEMENT", CHAPTER 12 "MINIMAL PROPERTY MAINTENANCE", AND CHAPTER 13 "LAND SUBDIVISIONS", AND PROVIDING AN EFFECTIVE DATE. A summary of the principal provisions of Ordinance No. 710 of the City of Eagle, Ada County, Idaho, adopted on I—/I-/— /4 ., is as follows: Section 1: Eagle City Code Title 11 "Planned Developments", Section A, "Spring Valley", is hereby established as follows: Chapter 1: Development Standards Interpretation & Definitions—short title; purpose; applicability; interpretation; scope of regulations; and definitions. Chapter 2: Permitted Uses—uses; land use districts; land use standards; setbacks and general lot development regulations. Chapter 3: Design Review—general applicability; purpose and goals; effect of other provisions;definitions;Eagle Architecture and Site Design Book; design requirements,objectives, and considerations; landscape and buffer area requirements; signage; lighting; administrative and board level applications; application requirements; notification; design review applications processing; appeals; terms of approval; modifications; restrictions on other required documents; sureties; and inspections. Chapter 4: Specific Use Standards—purpose; supplemental general provisions; supplemental yard and height regulations; commercial and industrial uses restricted; and unique land uses. Chapter 5: Off Street Parking and Loading—purpose;application;design and maintenance; additional regulations; additional design and maintenance regulations; joint/offsite parking facilities; parking disabled vehicles; parking in lieu of payments; bicycle parking; schedule; and loading space requirements. Chapter 6: Non-Conforming Use—applies ECC 8-5. Chapter 7: Planning Unit Master Plans (PUMP)—purpose, goal, and objective; PUMP compliance with PADA; ownership requirements; PUMP application requirements; and procedures for approval. Chapter 8: Zoning Administration and Enforcement—zoning administrator; zoning permits and certificates of occupancy; pre-application meetings; conditional uses; variances; Page 1 of 3 design review administrative and board level review; appeals; zoning upon annexation; schedule of fees;request for hearings by affected persons;notice requirements; and violations and penalties. Chapter 9: Area of City Impact—applies ECC 8-8, effective on December 21, 2012. Chapter 10: Historic Preservation—ECC 8-9, effective on December 21, 2012. Chapter 11: Development Agreement—sets forth the history of M3/Spring Valley development agreements. Chapter 12: Minimal Property Maintenance—applies ECC 8-11, effective on December 21, 2012. Chapter 13: Land Subdivisions—authority; purpose;jurisdiction; interpretation; and rules and definitions. Section 2: If any provision in this Ordinance shall be declared by any court of competent jurisdiction to be contrary to law, then such provision shall be null and void and shall be deemed severable from the remaining provisions in this Ordinance and shall in no way affect the validity of the other provisions of this Ordinance or Eagle City Code. Section 3: All prior ordinances or parts thereof,to the extent inconsistent herewith, are hereby repealed and shall, to the extent of such inconsistency, have no further force or effect. Section 4: This Ordinance, or a summary thereof in compliance with Section 50-901A, Idaho Code, shall be published once in the official newspaper of the City, and shall take effect immediately upon its passage, approval, and publication.
