Special Meeting Minutes
December 26,2013
1. CALL TO ORDER: Mayor Reynolds calls the meeting to order at 5:30 p.m.
2. ROLL CALL: Present: DEFAYETTE, BUTLER, PIERCE. Absent: GRASSER.
A quorum is present.
3. UNFINISHED BUSINESS:
A. Discussion of renegotiation of lease of Ada-Eagle Sports Complex
Mayor introduces the item.
Discussion amongst the Council. Pierce is interested in re-negotiating the lease.
Discussion regarding the interaction between the elected officials at the County thus far
regarding the Sports Complex. Defayette feels that the current lease allows for the use
that Ryan Neptune is proposing. The park provides a barrier for the landfill and the City
has been maintaining and improving it. Defayette feels that the City can either invest in a
lot of money in attorney fees and renegotiate or we can move forward in purchasing land.
She feels the best way to spend money is for the purchase. Butler states that it is his
opinion that it is worthless to renegotiate the lease. He is concerned with the 6 month
termination clause that exists in the lease. He does not want any additional fees to go
towards the park. Butler feels the City should move forward purchasing the portion of
the property that the City has already invested in, where infrastructure has been installed
and improvements have been made, approximately 20 acres. This would protect the
investment the City has already made. Discussion.
City Attorney Mimura relays a discussion with Ada County Legal Council Jana Gomez.
Comments on the termination language pros and cons, future development possibilities,
maintenance and operation fees for the park. Discussion for direction and options to
move forward.
Discussion amongst the Council.
Defayette moves that we make an offer of purchase of the 20 acres that has been
improved, and the additional, between 14 and 15 (acres) that is the pump track at
an offer of$4,000 an acre, if we are looking at 35 acres the price would be $140,000.
Seconded by Butler. Discussion. Aho: The pump track is 14.45 acres. Defayette
amends her motion, to say and cancel the lease. So if they accept our purchase offer
then we cancel the rest of the lease. Aho: Outside of that acreage that you are talking
about right now of purchasing is the BMX track, the track is outside of that area.
Defayette: I think we are out of business with BMX. Pierce: It sounds like they said they
aren't going to do it anymore anyways. Aho: That is a volunteer use group and it has
happened at other BMX tracks where a volunteer use group disbands and another one is
formed. Butler seconds the second motion to cancel the lease,with the
understanding that that 20 acres of improved land, also includes the footprint for
the hole where the Veledrome was and where the terrain park was going to go in.
So to have a specific area, it would be good for Mike (Aho) to have somebody do a

legal description. Susan Mimura: For clarification Mayor and Council, as I understand it
the 20 acres would not only incorporate the Veledrome, the improvement such as parking,
concession stand, bathrooms, but would go eastward towards the ridge to the property
that the City currently owns where the water tank is, the 3 acres, it would also run where
the easement to that property is—so you would no longer have to worry about that
easement, because you would own it. Then would run all the way to, I believe it is Goose
Creek in that corner. Defayette: Correct. Reynolds: How much acreage would that be?
Mimura: That would be 34.45 acres. BUTLER AYE; DEFAYTEE AYE. PIERCE
AYE. MOTION CARRIES.
B. Discussion of purchase price of Ada-Eagle Sports Complex (or portion thereof)

4. NEW BUSINESS:
A. Discussion of cancellation of lease

Butler moves to adjourn. Seconded by Defayetee. ALL AYES: MOTION
CARRIES...
