BYLAWS OF THE EAGLE DESIGN REVIEW BOARD
ARTICLE I
BOARD CREATED MEMBERSHIP, QUALIFICATIONS: The Design Review
Board shall R mction on behalf of the Planning and Zoning Commission and City Council.
The Board shall be composed of seven (7) members, and one nonvoting member who shall
be from the City Council. Members of the Board shall be appointed with proper
representation from such fields as architecture, landscape architecture, business,
engineering, and a citizen at large. The Zoning Administrator, upon consent of the City
Clerk, may seek assistance from other such employees of the city as is necessary to fulfill
the duties of the Design Review Board.
TERM OF OFFICE, VACANCIES: The.members ofthe Board shall take office as of
the date of their appointment, confirmation, and qualification. The term of the
appointment shall be for three (3) years, with the exception of the City Council
representative who shall serve a term of up to one year as defined by the City Council. All
members shall be eligible for reappointment. In the event of a vacancy of a position on the
Board, the Mayor shall appoint a new member, with the consent of the City Council, for
the balance of the unexpired term.
DUTIES, JURISDICTION, AND AUTHORITY: It shall be the responsibility of the
Board to protect property rights and values, enhance important environmental features of
the City, and to ensure that the general appearance of buildings and structures, along with
development of the land, shall not impair or preclude the orderly and harmonious
development of the community.
The Board shall review all development proposals within the Design Review Overlay
District. Within this District, the Board, with input from the Zoning Administrator, shall
regulate landscaping and beautification laws, review building design, and review site
planning, signs, grading, and development. This includes, but is not limited to, the
regulation and restriction of the type of building, number of stories, size of building,
construction, reconstruction, alteration, repair, or use of buildings and structures. The
Board shall ensure compliance with the requirements of the respective design review
overlay districts, City of Eagle comprehensive plan, and relevant ordinances.
Lack of a quorum of Board members shall require review of pending business by the
Board on the Thursday following the scheduled board meeting for which a quorum was
not present.
EMPLOYEES AND EXPENDITURES: Any expenditures of the Board (exclusive of
gifts) shall be within the amounts appropriated and set aside by the City Council for the
Board.

ARTICLE II
OFFICERS: The general officers of the Eagle Design Review Board shall be Chairman
and Vice - Chairman, who shall hold office for one year and until their successors are
elected. Officers may hold successive terms.
Section 1: Annually, at the first regular meeting of the calendar year, the Eagle
Design Review Board shall elect a Chairman and Vice - Chairman, who will take office
immediately after being elected. Vacancies in these offices occurring during the course of
the year will be filled by election at the next regular meeting. Any Board member may
nominate another Board member for the position of Chairman and Vice - Chairman.
Section 2: The Eagle City Clerk/Treasurer, or individual appointed by the City
Clerk/Treasurer shall serve as the secretary of the Board
Section 3: The principal duties of the Chairman shall be to preside at all meetings
and to have general supervision of the affairs of the Eagle Design Review Board. The
Chairman shall make such appointments as may be required, subject to approval of the
Board membership.
Section 4: The principal duties of the Vice - Cbairmman shall be to discharge the
duties of the Chairman in the event of the absence or disability, for any reason whatsoever,
of the Chairman.
Section 5: Pursuant to Eagle City Code, it is the responsibility of the City Clerk to
be custodian of all public records, ordinances, resolutions and such other papers and
documents as may be delivered into his/her custody. All records shall be open to the
public, except as noted in Idaho Code Section 9 -340.
Section: 6: The Zoning Administrator, or individual assigned by the Zoning
Administrator, shall give notice of all meetings and public hearings. It shall also be the
duty of the Zoning Administrator to provide the Board with all essential documentation
regarding items under their review.
ARTICLE III
MEETINGS:
Section 1: The Design Review Board shall hold its regular meetings on the second
and fourth Thursday of each month at 6:00 p.m. All meetings shall be open to the public.
Section 2: Special meetings may be called at any time by the Chairman, or by the
request of three (3) or more members of the Board. A written notice stating the time,
place and purpose of such meeting shall be posted at least twenty four (24) hours before

the meeting. No business shall be transacted except that mentioned in the notice of the
�t special meeting, unless moved and passed by a majority vote of the attending Board.
Section 3: Three (3) voting members of the Eagle Design Review Board shall
constitute a quorum.
ARTICLE IV
Section 1: The Chairman, with approval of the Board, may establish at any time,
standing and/or special committees as are deemed necessary to carry on the work of the
Board.
Section 2: The Chairman, with approval of the Board, shall appoint the members
to fill the standing committees. The appointment or reappointment of standing committee
members shall be made at the second regular meeting of the year, and their term shall not
exceed one year; however, they may be reappointed by the Chairman.
ARTICLE. V
PARLIAMENTARY AUTHORITY: The rules contained in the current edition of
ROBERT'S RULES OF ORDER NEWLY REVISED shall govern the Board in all cases
to which they are applicable and in which they are not inconsistent with these Bylaws, any
' special rules of order the Board may adopt, or any federal, state, county, or city statutes
applicable to the Board.
DESIGN REVIEW BOARD TESTIMONY GUIDELINES:
It is this Board's intent to allow all applicants, and those individuals signed up to testify
either in support of or in opposition to a particular request, the opportunity to testify
within reason. Due to the number of applications this can only be accomplished by setting
standards in terms of time limitations both for the applicant and others wishing to testify.
Therefore, with the understanding that the Design Review Board may make exceptions for
unique and unusual circumstances and complex issues, the following time limitations shall
apply:
Applicant (or his/her representative) - ten (10) minutes
Zoning Administrator (or assigned staff member) - ten (10) minutes
Other technical representatives testifying on behalf of the City - five (5) minutes
Homeowner's Association representatives - ten (10) minutes
Neighborhood Group representatives - ten (10) minutes
Individuals testifying - three (3) minutes of non-repetitive testimony

When all public testimony has been taken the applicant (or his/her representative) will then
be allowed five (5) minutes for rebuttal and the Zoning Administrator (or assigned staff J
member) will be allowed five (5) minutes for comment.
ARTICLE VI
AMENDMENT OF BYLAWS: These bylaws can be amended, at any regular meeting of
the Board by a two- thirds (213) vote, provided that the amendment has been submitted in
writing at the previous regular meeting, or included in the agenda of the next regular
meeting.
