WHEREAS, Coleman Homes, LLC, requested a vacation to the final plat of Eaglefield Estates Subdivision No.1 to vacate a section of plat note number 14 that references the common driveway easement located within Lots 1-5 and Lots 7-11, Block 5, and vacate the alley and common driveway easement located within Lots 1-5 and Lots 7-11, Block 5; and WHEREAS, On April 15, 2013, the Planning and Zoning Commission recommended approval of the vacation (VAC-02-13), with conditions,to the Council; and WHEREAS,Legal notice of the City Council hearing on the vacation was published in the Valley Times on April 22, 2013, and April 29, 2013; and WHEREAS, On May 14, 2013, the City Council held a public hearing on the proposed vacation (VAC-02-13), and voted to approve the vacation with conditions; and WHEREAS, The City Council hereby finds that the proposed vacation complies with the provisions of Section 50-1306A of the Idaho Code, "Vacation of Plats-Procedure", and Section 9-6-2 of Eagle City Code, "Vacations and Dedications." NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF EAGLE,IDAHO. The Eagle City Council hereby vacates a section plat note number 14 that references Lots 1-5 and Lots 7-11, Block 5, and vacate the common driveway easement located on Lots 1-5 and Lots 7-11, Block 5 of the final plat of Eaglefield Estates Subdivision No. 1, as considered, heard, and approved by the Council at its May 14, 2013, public hearing for application number VAC-02-13, and as shown on the attachment hereto(Exhibit A)and as shown on the"Affidavit of Correction"for plat note number 14 (Exhibit B). Carter, a Professional Land Surveyor, licensed by the State of Idaho, as a portion of the procedure required by the City of Eagle, Idaho Planning Department to vacate common driveway easements, do hereby append this change to the plat of Eaglefield Estates Subdivision No. 1, recorded in the office of the Ada County Recorder on May 10, 2013 as Instrument No. 108057394, in Book 100 of Plats at Pages 13,150 through 13,157. The purpose of the vacation is to remove Lots 1-5 and Lots 7-11, Block 5 from the common driveway requirement. As a portion of the procedure required by the City of Eagle, Idaho Planning Department to vacate common driveway easements Plat Note 14 of Eaglefield Estates Subdivision No. 1 shall be modified t to read: "14) Lots 2-10, Block 3; and 1-22, Block 4; are subject to common driveway easement lines as shown which shall provide perpetual ingress and egress for adjacent lots and said lots shall be prohibited from direct access to dedicated streets. Maintenance for said driveways are provided for in the covenants, conditions, and restrictions(CC&R's) provided for this subdivision. Said easements shall run with the land and also have a blanket public utility, irrigation and drainage easement."
