The regular meeting of the Eagle City Council was called
to order by Mayor Deckard at 7:30 P. M. on September 12, 1978.
ARNOLD~KRASEN PEARMAN and POLLARD were present.
KRASEN asked that the minutes of the previous meeting be
corrected to include that the city council received a letter
from Mrs. Ashton concerning a street name change in Eagle
Ranch Subdivision, and that the mayor was to respond after
receiving pertinent information on the situation.
Hearing no other corrections or additions to the minute~
they stand approved as corrected.

The mayor informed the council that the grant for comprehensive
planning has been signed by JUB ENGINEERS and that they are
currently working on it.
EAGLE VILLAGE SUBDIVISION #3
Reported by KRASEN that the state will not approve any hook-ups
for at least a three month period of time and that is
dependent upon the sewer district meeting the demands of the
health department.
Moved by KRASEN and seconded by POLLARD to table action on
Eagle Village #3 Subdivision until word is received from the
health department as to sewer hook-ups.
Motion resulted as follows: AYE: ARNOLD, KRASFN, PEARMAN
and POLLARD. Motion carried.

Moved by KRASEN and seconded by POLLARD to table action on
Hayes Subdivision until sewer hook-ups are available and
approved by the central district health.

GOECHNFR BEER AND WINE LICENSE APPLICATION
The attorney reported that there are no state restrictions
on issuinq a beer and wine license next to a church.
He further cited section Eagle Zoning Ordinance Section 3-4.2
under Uses Allowed in a commercial district - any retail or
service activity except uses primarily oriented to the auto,
such as service stations and drive-ins.
Moved by KRASEN and seconded by ARNOLD to send this application
to the planning and zoning commission to obtain further
data on the planned use and traffic design at the
intersection. Motion resulted as follows: AYE: ARNOLD,
KRASEN, PEA~AN and POLLARD. ~tion carried.
EAGLE VILLAGF ~1 - ?SAIL BOXES
Mayor Deckard appointed KRASEN and POLLARD to serve on a
committee of two to try and solve the mail box situation
with the post office as to placing the boxes in the
designated places in the subdivision.
IDAHO TRANSPORTATION DEPARTMENT
Mayor D~ckard reported that the Idaho Transportation Department
wil'l perform a traffic study in Eagle and that the city
will receive the results of that study before the next
city council meeting.
AREA OF IMPACT
Attorney Welsh stated that as yet we do not have the signed
copy of the agreement reached with Garden City in regards
to the Area of Impact. Two representatives from the
Northwest Neighborhood Association talked to the council
in regards to the area they would like to be in.
REMODEL OF WARD HOUSE
Building Inspector Shoen reported to the council that this
building was moved in without permission originally, but that
a public hearing was held and a variance given to Mrs. Ward
to move the building but/that it was to be used for storage
only.
Moved by KRASEN that we refer this to committee and that they
report back to the council at the next meeting. Motion died
for lack of a second.

SUN RAY DAIRY BEER AND WINE LICENSE APPLICATION
Moved by POLLARD to approve the application for package
beer and wine submitted by the Sun Ray Dairy. Motion
died for lack of a second.
Moved by PEA~N and seconded by KRASEN that this application
be submitted to the planning and zoning commission for
their imput. Motion resulted as follows: AYE~ ARNOLD
PEA~MAN and K~ASEN. NAY: POLLARD. Motion carries.
MEMBERSHIP IN INDEPENDENT DISTRICTS
Councilman KRASEN told the council that he felt that the
council should have a membership on each of the independent
districts. He said that the Eagle Ranch Water Company had
already stated they would like a council member to sit
on their board. The council asked the mayor to explore
this situation and report back to the council.
EAGLE ELEMENTARY SCHOOL SITE
The location of the new Eagle Elementary School Site will
come before the county commissioners for hearing the last
part of September.
Moved by KRASEN and seconded by PEA~4AN that the mayor
attend this hearing and give testimony in favor of the
site as it is now.
Motion resulted as follows: AYE: ARNOLD, KP~SEN, PEA~AN
POLLARD. Motion carried.
AUDIT -LETTER OF UNDERSTANDING
~oved by POLLARD and seconded by ARNOLD to sign the
Mu~cipal Audit-Letter of Understanding in the amount of
$650.00 as submitted by Jackson, Messouri & Bates.
Motion resulted as follows: AYE~ ARNOLD, KRASEN, PEARSON
POLLARD. Motion carried.
FISCAL BILLING
Moved by POLLARD and seconded by KRASEN to Day the fiscal
bills the last working day of September after-approval of
the president of the council. Motion resulted as follows~
AYE: ARNOLD, KRASEN, PEA~4AN and POLLARD. Motion carried.
ZONING ADMINISTRATOR
Moved by POLLARD and seconded by KRASEN to draw up a
resolution naming Judy Mendiola as zoning administrator.
Motion resulted as follows: AYE~ ARNOLD, KRASEN, PEA~MAN
POLLARD. Motion carried.

ZONING ORDINANCE
A set of corrections was submitted by the attorney resulting
from a meeting between the mayor and attorney to review the
zoning ordinance.
A work session will be held by the council on September
19, 1978 at 7:30 P. M.
Moved by KRASEN and seconded by ARNOLD to hold a public
hearing on the zoning ordinance on October 10, 1978 at
the city hall at 7:30 P. M.
There being no further business to come before the council,
the meeting was adjourned.
