Minutes - 1978 - City Council - 01/10/1978 - RegularJanuary 10, 197~ The regular meeting of the Eagle City Council was called order at 7:30 P. M. by Mayor Deckard on January 10, 197~. Brad Herrick was excused. to Moved by ARNOLD and seconded by LOWE that the minutes of the previous meetings of December 13th and December 30th be approved as printed. Roll call on the motion resulted as follows: YEAS: ARNOLD, ~OWE, PEARMAN. Motion carried. Russ Burtner, J. U. B. Engineers, representing Eagle Hills West #4 requested approval of the hard plat of that subdivision. Moved by PEARMAN and seconded by ARNOLD to accept the hard plat of Eagle Hills #4. Roll call on the motion resulted as follows: YEAS: ARNOLD, LOWE, PEARMAN. Motion carried. The attorney presented the council with Ordinance #39. AN ORDINANCE OF THE CITY OF EAGLE DEFINING A GEOGRAPHICAL AREA OF CITY IMPACT AND ESTABLISHING AN EFFECTIVE DATE. PURSUANT TO SECTION 67-6526, IDAHO CODE. Moved by ARNOLD and seconded by LOWE to dispense with the rule of three readings and the reading of the ordinance in its entirety. Roll call on the motion resulted as follows: YEAS: ARNOLD, LOWE, PEARMAN. Motion carried. Moved by PEARMAN and seconded by LOWE to adopt Ordinance #39. Roll call on the motion resulted as follows: YEAS: ARNOLD LOWE, PEARMAN. Motion carried. Mayor Deckard presented Fred Lowe with a certificate of appreciation. New Councilman Krasen and Pollard were given the oath of office by the city clerk. Moved by KRASEN and seconded by ARNOLD to elect LeRoy Pearman president of the council. Roll call on the motion resulted as follows: YEAS: ARNOLD and KRASEN. NAYES: POLLARD. ABSTENSION: PEARMAN. Motion carried. Mayor Deckard made the following council appointments: PEARMAN, finance; ARNOLD, Planning and Zoning, KRASEN, Planning Association, POLLARD, library. Ada Moved by KRASEN, seconded by POLLARD to appoint Judith A. Mendiola as City Clerk. Roll call on the motion resulted as follows: YEAS: ARNOLD, KRASEN, PEARMAN, POLLARD. Motion carried. January 10, 1978 Page 2 Moved by PEARMAN and seconded by KRASEN to appoint Vern Schoen as building inspector. Roll call on the motion resulted as follows: YEAS: ARNOLD, KRASEN, PEARMAN, POLLARD. Motion carried. Moved by ARNOLD and seconded by PEARMAN to appoint the firm of Clemons, Cosho, Humphrey & Samuelson as attorney. Roll call on the motion resulted as follows: YEAS: ARNOLD, KRASEN, PEARMAN, POLLARD. Motion carried. Andy Pollard was excused from the remainder of the meeting. Moved by KRASEN and seconded by PEARMAN that authority be given to the mayor and city clerk to invest the idle funds. Roll call on the motion resulted as follows: YEAS: ARNOLD, KRASEN, PEARMAN. Motion carried. Moved by KRASEN and seconded by PEARMAN to adopt Resolution No. 1-78: "A copy of the minutes of each meeting of the City Council will be furnished to each member of the Eagle Planning and Zoning Commission prior to their next regular meeting." Moved by KRASEN and seconded by PEARMAN to amend the resolution as follows: Section 1, line 1, "A copy of the minutes of each regular meeting - - " Roll call on the amending resulted as follows: YEAS: ARNOLD, KRASEN, PEARMAN. Motion carried. Roll call on the adoption of Resolution No. 1-78 resulted as follows: YEAS: ARNOLD, KRASEN, PEARMAN. Motion carried. Moved by KRASEN that the Eagle City Council adopt by-laws and standing rules. Motion died for lack of a second. Moved by ARNOLD and seconded by KRASEN to search for or rules that were written at time of incorporation. Roll call on the motion resulted as follows: YEAS: KRASEN, PEARMAN. Motion carried. any by-laws ARNOLD, Moved by PEARMAN and seconded by ARNOLD to open Eagle Village Subdivision #2 for discussion. Roll call on the motion resulted as follows: YEAS: ARNOLD, KRASEN, PEARMAN. Motion carried. Moved by PEARMAN and seconded by KRASEN to accept the preliminary plat of Eagle Village Subdivision #2. Roll call on the motion resulted as follows: YEAS: KRASEN, PEARMAN. NAYES: ARNOLD Motion carried. Moved by KRASEN and seconded by PEARMAN that the meeting be adjourned at 9:15 P. M.
