The regular meeting of the Eagle City Council was called
to order at 7:30 P. M. on October 9, 1979 by Mayor Deckard
at the Eagle City Hall.
ARNOLD, KRASEN, PEARMAN STURR were present.
Moved by KRASEN and seconded by ARNOLD that the minutes of
August 14, 1979 be corrected as follows:
Para. 3 delete and replace with: Moved by KRASEN and
seconded by ARNOLD that the minutes of the special meeting
of July 27, 1979 be approved as written.
Roll call on the motion resulted as follows: AYE: ARNOLD,
KRASEN, PEARMAN, STURR. Motion carried.
Page 2, para. 8. - 3rd line, afters Marz, enter "Kleng, Marz"
Last para. - after Plan, add: "There being no public testimony
the hearing was declared closed.

Para 7 on Ord 42 - add following to start para. - "Ordinance

announced that the issue of the Wilder deannexation and the
pending litigation need be discussed with the city attorney.

"The executive session of the Eagle City Council was called
to order at 8:21 P. M. on August 14, 1979 by Mayor Deckard.
ARNOLD, KRASEN, PEARMAN, STURR were present. At the
mayor's request, city attorney Stanley W. Welsh explained
the requirements of Idaho Code 50-222 through 50-230 and
how they may or may not apply to the request for deannexation
from Donald E. and Audrey L. Wilder. Further, he explained
the probable legal position the City of Eagle could take in
court proceedings on this matter. The executive session
was adjourned at 8:54 P. M."

Moved by KRASEN and seconded by ARNOLD that the minutes of
the special meeting of September 18, 1979 be approved as
printed.

STURR. Motion carried.
Moved by ARNOLD and seconded by PEARMAN that the following
appointments be made for the election judges and clerks of
the 1979 election:
Kathy Becker - Judge
Cindy Avrum - Clerk
Connie Boudreau - Clerk
and that the compensation of these judges
$25.00 each.

Moved by ARNOLD and seconded by KRASEN to include an advisory
ballot in the November, 1979 election to see if the voters
would support a bond issue for a community center.
Motion resulted as follows: AYE: ARNOLD, KRASEN, PEARMAN,
STURR. Motion carried.
Moved by ARNOLD and seconded by STURR that the issue of
liquor by the drink be placed on the ballot for the November,
1979 election.
Motion resulted as follows: AYE: ARNOLD. NAY: KRASEN,
PEARMAN, STURR. Motion defeated.
Annexation ordinances 44, 45, 46 were read for the second time
by title only.
Annexation ordinances 47, 48, 49, 50 were read for the first
time by title only.
Mayor Deckard read a letter from Ron Marshall concerning the
one way street between State and Idaho Street and'the
paving of the alleys that parallel State Street and run from
Eagle Road and to 1st and to 2nd Streets.

Moved by KRASEN and seconded by STURR that the mayor forward
these recommendations to the Ada County Highway District
for their action.
Motion resulted as follows: AYE: ARNOLD, KRASEN, PEARMAN,
STURR. Motion carried.
The beer and wine license applications of Jerry's Shopping
Center, Eagle Beverage, Jim-Bo's Cafe, and Sun Ray Dairy
were reviewed.
Moved by ARNOLD and seconded by PEARMAN that these licenses
be issued for 1980 if an application is made.
Motion resulted as follows: AYE: ARNOLD, KRASEN, PEARMAN,
STURR. Motion carried.
A special meeting of the Eagle City Council will be held
November 7, 1979 to canvass the votes after the election
of November 6, 1979.
The Eagle City Council meeting was recessed at 8:25 P. M.
The Eagle City Council meeting was reconvened at 8:30 P. M.
Moved by STURR and seconded by KRASEN that the Area of
Impact Agreement as written by Councilman Krasen be put
into final format and that Councilman Krasen and Mayor
Deckard present this agreement to the county commissioners
individually and ask for a joint meeting between them and
the City of Eagle.
Motion resulted as follows: AYE: ARNOLD, KRASEN, PEARMAN,
STURR. Motion carried.
Councilman Sturr submitted the names Of Bob Rader and Dean
Dillon fo Mayor Deckard for his consideration for the Eagle
Planning and Zoning Commission.
Councilman Pearman reported that he had visited with Mr.
Campbell, Downing Downs concerning a violation against an
ordinance of the City of Eagle.
Moved by PEARMAN and seconded by KRASEN that the bills of
September be approved as presented.
Motion resulted as follows: AYE: ARNOLD, KRASEN, PEARMAN,
STURR. Motion carried.
