BOX 477 EAGLE, IDAHO 83616 208-939-6813 Mayor' Jerry Deckard Council: Ted Arnold Don Brooks Orval Krasen Le Roy Pearman May 8, 1979 The regular meeting of the Eagle City Council was called to order by Mayor Deckard on May 8, 1979 at 7:30 P. M. at the Eagle City Hall. ARNOLD, KRASEN and PEARMAN were present. Moved by KRASENaand seconded by PEARMAN that the minutes of the special meeting of the Eagle City Council on April 24th be approved with the following corrections: Page 1, Paragraph 2 on Eagle Sewer and Water District, Line 3, delete the period after "District" and add "and is outside the 1976 draft planning limits of the Eagle Water and Sewer District." Page 2, line 8, change page 60 to page 61. Page 4, bottom of page, Section "G" belongs under the Eagle Zoning Ordinance following the last entry on page 3. Motion resulted as follows: AYE: ARNOLD, KRASEN, PEARMAN. Motion carried. RESOLUTION NO. 3-79 Mayor Deckard read Resolution No. 3-79 amending Resolution No. 1-79 concerning Variance Fees to read $100.00. Moved by KRASEN and seconded by ARNOLD to adopt Resolution No. 3-79. Roll call on the motion resulted as follows: AYE: ARNOLD, KRASEN, PEARMAN. Motion carried. OFFICIAL ZONING MAP Moved by ARNOLD and seconded by KRASEN to update the official zoning map with recommended corrections that the council has made and return it to the planning and zoning commission for a public hearing. Motion resulted as follows: AYE: ARNOLD, KRASEN, PEARMAN. Motion carried. BUDGET Moved by ARNOLD and seconded by PEARMAN to make the following changes in the expense portion of the 1978-79 fiscal budget for the City of Eagle. May 8, 1979 Page 2 INCRASE Annual audit fee from Advertising and legal publications Park Maintenance $550.00 - $650.00 $1300.00 - $1600.00 $800.00 - $1100.00 DECREASE Planning and zoning expense from Summer movie program from Professional services from Mixcellaneous from $500.00 - $300.00 $600.00 - $450.00 $3000.00 - $2850.00 $500.00 - $300.00 ARNOLD amended his motion to include: Library Library - Revenue Sharing Fund $12,562.60 2,989.00 Motion resulted as follows: AYE: ARNOLD, KRASEN, PEARMAN. Motion carried. Mayor Deckard told the council he would like to appoint Dick Fisher to the Eagle Planning and Zoning Commission. Moved by KRASEN and seconded by PEARMAN that the appointment of the mayor be accepted by the council. Motion resulted as follows: AYE: ARNOLD, KRASEN, PEARMAN. Motion carried. Mayor Deckard announced that this was the time and the place for a public hearing to be held on a change in the variance procedures established by the Eagle Zoning Ordinance. There being no testimony from the audience the public hearing was declared closed. Moved by KRASEN and seconded by ARNOLD to accept the recommendations of the Eagle Planning and Zoning Commission on the changes to the variance procedures in the Eagle Zoning Ordinance; that these changes be put in ordinance format for first reading at the next regularly scheduled meeting. Motion resulted as follows: AYE: ARNOLD, KRASEN, PEARMAN. Motion carried. Randy Nelson from Ada Planning Association made a presentation on transporation routes in Ada County. Ron Marshall presented the council with an annexation request involving three pieces of property. Moved by ARNOLD and seconded by PEARMAN to send this request for annexation along with the adjoining four parcels of property to the Planning and Zoning Commission for their recommendation on zoning. The recorded propertys are owned as follows: Marc Marz, Frank Marz, Donald Wilder, Michael Burkhart, Floyd Chastain, M. Kleng, and Carl Marshall. May 8, 1979 Page 3 Moved by KRASEN and seconded by ARNOLD to amend the motion to include that the planning and zoning commission also be asked to recommend changes to the comprehensive plan and zoning ordinance that would be necessary upon annexation of these parcels of property. Vote on the amendment resulted as follows: AYE: ARNOLD, KRASEN, PEARMAN. Motion carried. Vote on the original motion resulted as follows: AYE:i ARNOLD, KRASEN, PEARMAN. Motion carried. Mayor Deckard asked attorney WELSH to review the applications for a cable tv franchise and asked the two partys involved to provide our council with financial statements. Moved by PEARMAN and seconded by ARNOLD to pay the May bills. Motion resulted as follows: AYE: ARNOLD, KRASEN, PEA~NL~N. Motion carried.
