The regular meeting of the Eagle City Council was called to order by
Mayor Deckard at 7:30 P. M. on December 1~, 1980 at the Eagle
City Hall. ~
Members present: HALEY, KRASEN, PEARMAN.
Minutes of the previous meeting of November 25, 1980 were corrected
as follows:

Moved by KRASEN and seconded by HALEY to approve the minutes of November 25,
1980 as corrected.
Motion resulted as follows: AYE: HALEY, KRASEN, PEARMAN. Motion carried.
Mayor Deckard announced that this was the time and the place for a public
hearing on an ordinance for a plan~ing and zoning commission.

and the authorization of the commission to hire such employees and technical
advisors.
There being no further public testimony, the public hearing was declared
closed.
The draft will be put in ordinance form for first reading at the January
meeting and will be changed to add: Section 4: DUTIES Item 7. "And
such other duties as are required by Idaho Code."
Mayor Deckard announced that this is the time and the place for a public
hearing on a setback ordinance. Councilman Decker arrived at the meeting.
There being no public testimony, the public hearing was declared closed.
The draft will be put in ordinance form, with changes as suggested by
planning and zoning commission for first reading at the January meeting.
Mayor Deckard announced that this is the time and the place for a public
hearing on an amendment to the zoning ordinance to allow dry line sewers
'and septic tanks in a density other than R-1.
Mel Lawrence, Boise, Idaho, the applicant for this amendment spoke.
Garth Baldwin, Eagle, Idaho, spoke in favor of the amendment.
Scott Brown, Boise, Idaho, spoke in favor of the amendment.
Floyd Calhoun, Eagle, Idaho, spoke in favor of the amendment.
Joe Nemelka, Eagle, Idaho spoke against the amendment.
Frank Stoppello, Eagle, Idaho, felt that sewer should be in before development
occurrd.
There being no further public testimony to come before the council, the
public hearing was declared closed.

Moved by KRASEN and seconded by PEARMAN that further consideration of this
matter be tabled until the second meeting in January, which is January
27, 1981.
On January 12, 1981 the council will attend the regular meeting of the
Eagle Sewer Board to discuss this amendment.
Motion resulted as follows: AYE: DECKER, HALEY, KRASEN, PEARMAN. Motion
carried.
Mayor Deckard reported that the "Pepsi" signs in Eagle were placed there
before the Design Review Ordinance was in effect.
Bob Watson, representing Watson and Maxey spoke to the council concerning
their violation of the zoning ordinance in occupying a building which
has not received a final inspection.
This matter was deemed an administrative problem and will be taken care
of by Mayor Deckard.
Moved by DECKER and seconded by PEAILMAN to approve an off premise wine
license to Savway Dairy Farmer.
Motion resulted as follows: AYE: DECKER, HALEY, KRASEN. NAY: PEARMAN.
Motion carried.
Moved by KRASEN and seconded by DECKER that renewal of the beer and wine
license of the Eagle Bank Club be approved providing they comply with the
requirements of ARTICLE XIV, OFF-STREET PARKING AND LOADING FACILITIES,
of Eagle City Ordinance No. 40, by Deeember 31, 1980.
Motion resulted as follows: AYE: DECKER, HALEY, KRASEN, PEARMAN.
Motion carried.
Moved by PEARMAN and seconded by HALEY that there be no regular meeting
of the Eagle City Council on December 23, 1980.
Motion resulted as follows: AYE: DECKER, HALEY, KRASEN, PEARMAN.
Motion carried.
Moved by KRASEN and seconded by HALEY that the outstanding bills for
the month of December be paid.
