Jerry Deckard Council: Floyd Decker Carol Haley Orval Krasen LeRoy Pearman November 25, 1980 The regular meeting of the Eagle City Council was called to order by Mayor Deckard on November 25, 1980 at 7:30 P. M. at the Eagle City Hall. Members present: DECKER, HALEY, KRASEN, PEARMAN. Minutes of the previous meeting of November 12, 1980 were corrected as follows: Page 2, paragraph 2 ~pp~m~m'opinion Page 2, paragraph 3, line 11 add: Ordinance #66 - Marshall was read by title only for the first time. Motion resulted as follows: AYE: DECKER, HALEY, KRASEN, PEARMAN. Motion carried. Councilman K~SEN gave a report on the adhoc co~ittee of water line L.I.D. Councilman KRASEN gave a comprehensive plan report update. Mayor DECKARD reported that the BANK CLUB is under negotiation for parking facilities and will be at the next council meeting. Moved by PEAR/MAN and seconded by DECKER that in accordance with 50-902 Idaho Code, the requirement for ordinances to be read on three (3) different days be dispensed with as pertains to Ordinance numbers 44, 45, 47, 48 and 50. Mayor Deckard read Ordinance #48 - Marie Main annexation by title only. Mayor Deckard read Ordinance #50 - Verlan Mace annexation by title only. KRASEN statedthat during the course of its deliberations concerning Eagle City Ordinance Numbers 44, 45, 47, 48 and 50, the Eagle City Council has considered, among other things, the following: A. The Eagle Comprehensive Plan B. Eagle City Zoning Ordinance #40 and its amendments C. Idaho State Local Planning Act of 1975 (I.C. 67-650---) D. Annexation section of I. C. 50-222 thru 50-233 E. Recommendations of the Eagle Planning and Zoning Commission F. Public testimony Based on these deliberations, this council has reached the following conclusions and makes the following recommendations and motions. A. The requirements of continuity have been met. These annexations are not contrary to the Eagle Comprehensive Plan. D. Proper notification has been given and hearing procedures have been followed as outlined in I.C. 67-6509 and 67-6511. Moved by KRASEN and seconded by PEARMAN to adopt the above findings and adopt Ordinance #44 - Leonard Mace annexation with the assigned zoning of "A" Agriculture. Roll call on the motion resulted as follows: AYE: DECKER, HALEY, KRASEN, PEARMAN. Motion carried. Moved by KRASEN to adopt the above findings and adopt Ordinance #45 Quarter Circle DJ annexation with assigned zoning of "A" Agriculture. KRASEN withdrew his motion. Moved by PEARMAN and seconded by DECKER that the rule requiring ordinances be read in full be dispensed with according to 50-902 I. C. and that the following ordinances be read by title only: Ordinance #44, 45, 47, 48 and 50. Roll call on the motion resulted as follows: AYE: DECKER, HALEY, KRASEN, PEARMAN. Motion carried. Moved by KRASEN and seconded by HALEY to reconsider Ordinance #44 in ~ of the preceeding motion. Roll call on the motion resulted as follows: AYE: DECKER, HALEY, KRASEN, PEARMAN. Motion carried. November 25, 1980 Page 3 Moved by KRASEN and seconded by PEARMAN to adopt the above findings and adopt Ordinance #44 - Leonard Mace annexation with the assigned zoning of "A" Agriculture. Roll call on the motion resulted as follows: AYE: DECKER, HALEY, KRASEN, PEARMAN. Motion carried. Moved by KRASEN and seconded by HALEY to adopt Ordinance #45 - Quarter Circle annexation with the assigned zoning of "A" Agriculture and to adopt the findings as previously given. Roll call on the motion resulted as follows: AYE: DECKER, HALEY, KRASEN, PEARMAN. Motion carried. Moved by KRASEN and seconded by PEARMAN to adopt Ordinance #47 - Leonard Mace annexation with the assigned zoning of "A" Agriculture and to adopt the findings as given previously. Roll call on the motion resulted as follows: AYE: DECKER, HALEY, KRASEN, PEARMAN. Motion carried. Moved by KRASEN and seconded by DECKER to adopt Ordinance #48 - Marie Main annexation and the assigned zoning of "A" Agriculture and to adopt the findings as given previously. Roll call on the motion resulted as follows: AYE: DECKER, HALEY, KRASEN, PEAILMAN. Motion carried. Moved by KRASEN and seconded by PEARMAN to adopt Ordinance #50 - Verlan Mace annexation with the assigned zoning of "A" Agriculture and to adopt the findings as previously given. Roll call on the motion resulted as follows: AYE: DECKER, HALEY, KRASEN, PEARMAN. Motion carried. KRASEN submitted testimony to be entered into the minutes that is a reply to the testimony that was given on these annexations. Councilpersons HALEY and Decker spoke in favor of the annexation and their reasons for casting an aye vote. Council PEARMAN requested his comments be written in the record. "I would fully endorse and vote for the southern annexation of the property in question here tonight. The reasons for my position are that these areas need to be controlled for the benefit of the citizens of the City of Eagle. Since being a member of the council, since the incorporation of the city, it has generally been accepted by the council in the past as to having an area of impact of this statue with full realization that these areas would be incorporated into the City of Eagle. The first recommendation for this area of impact was made in 1976, and since that time has only been altered to excludethe Blue Heron Rookery. In 9 years of service to the City it has been my experience that at the present time we have one of the best councils, mayor and clerks that have ever been, and I feel they are truly dedicated to the welfare of the city and to the City of Eagle. They have put in a great deal of time and effort into their position and decision making policy, and I think they should be highly commended for this. As to the opposition November 25, 1980 Page 4 of the city limits extending past the South fork of the Boise River, I would like to point out to those people that the first settlers and fathers of our community first settled on Eagle Island and the townsite was named for the Eagle's eyries along that island. People like Whitey and Verlan Mace who are requesting annexation are the founding fathers of this community .... and refusing to allow them to be residents of the City of Eagle is unacceptable to me." Moved by KRASEN and seconded by PEARMAN that the Board of County Commissioners be notified by letter that the City of Eagle recommends the "do nothing" alternative, at this time, on the Southwest Community Wastewater Management Study. Motion resulted as follows: AYE: DECKER, HALEY, KRASEN, PE~JlMAN. Motion carried. Design Review Application #9-80 for Cathy Roberts to construct an assay office and testing laboratory in an existing garage on alley behind the green house on the SW corner of First Street and Highway 44. Ron Marshall, chairman of the Design Review Committee, spoke on the application. Moved by KRASEN and seconded by DECKER that we approve Design Review Application #9-80 and that Ordinance #55 was used in consideration of this application. That the application conforms with Ordinance #55 and that the applicant complied with the findings of the Design Review Board. Motion resulted as follows: AYE: DECKER, HALEY, KRASEN, PEARMAN.
