BOX 477 EAGLE, IDAHO 83616 208.939-6813 Mayor: Jerry Deckard Council: Floyd Decker Carol Haley Orval Krasen LeRoy Pearman October 14, 1980 The regular meeting of the Eagle City Council was called to order by Mayor Deckard at 7:30 P. M. on October 14, 1980 at the Eagle City Hall. DECKER, HALEY, PEARMAN were present. The minutes of September 23, 1980 were approved as printed. Minutes of September 30, 1980 were corrected as follows: page 1, paragraph 1, ~eg~e~ special and then approved. Bernard Gratton, president of Farmers & Merchants Bank requested an extension of their "Conditional Use Permit." Moved by DECKER and seconded by PEARMAN to grant approval of a one year extension on the conditional use permit of Farmers and Merchants Bank. Motion resulted as follows: AYE: DECKER, HALEY, PEARMAN. Motion carried. Moved by HALEY and seconded by PEARMAN to recommend approval to the Ada County Zoning Commission of conditional use application #80-31-CU for Monroc/Doil Lane. Motion resulted as follows: AYE: DECKER, HALEY, PEARMAN. Motion carried. ORDINANCE # 62 - AREA OF IMPACT Moved by HALEY and seconded by PEARMAN that the council dispense with the rule requiring an ordinance be read in full and that the ordinance be read by title only according to 50-902 Idaho Code. Roll call on the motion resulted as follows: AYE: DECKER, HALEY, PEARMAN. Motion carried. Mayor Deckard read Ordinance #62 by title only. Frank Stopello, Route #3 Arlington Drive representing himself and an organization known as the Eagle Citizens Association, a non profit corporation made up mostly of Eagle Citizens. The testimony was asked to be part of the public record in opposition to Area of Impact Ordinance #62 and Annex "A" thereof. They wanted to take the opportunity ~to inform the council that their organization has compiled some referendum petitions and will in fact pass them out to the Citizens of Eagle pursuant to Ordinance #41 which provides for direct legislation. The intent will be to repeal the Impact Area Ordinance. Further, they are going to submit an initiative petition in the same regard which will prohibit any annexation or impact area south of the south channel of the Boise River for a period of 5 years from the date of any election that passes the initiative vote. October 14, 1980 Page 2 A letter of testimony from Councilman Krasen was read into the minutes. Moved by HALEY and seconded by PEARMAN to adopt Ordinance #62 and Annex "A" thereof. Roll call on the motion resulted as follows: AYE: DECKER, HALEY, PEARMAN. Motion carried. Mayor Deckard read Resolution #6-80 regarding the Area of Impact. Moved by HALEY and seconded by DECKER to adopt Resolution #6-80. Roll call on the motion resulted as follows: AYE: DECKER, HALEY, PEARMAN. Motion carried. Moved by DECKER and seconded by HALEY to approve the beer license transfer from Ray Ayers dba Sun Ray Dairy to J. A. Trimble Oil Co., Inc. dba Savway Dairy Barn. Motion resulted as follows: AYE: DECKER, HALEY, PEARMAN. Motion carried. Moved by DECKER and seconded by PEARMAN to confirm the mayors appointment of Donna Abbott to the Eagle Public Library Board as trustee for a term of five years. Motion resulted as follows: AYE: DECKER, HALEY, PEARMAN. Motion carried. A traffic plan for the Eagle Village Shopping Center was presented to the council. Moved by DECKER and seconded by PEARMAN to approve the Eagle Village Shopping Center traffic plan. Motion and second were withdrawn. Moved by DECKER and seconded by PEARMAN to forward the traffic plan to the Planning and Zoning Commission for their recommendation and that we urge the commission to have their comment back to us by the next council meeting. Motion and second withdrawn. Moved by DECKER and seconded by PEARMAN that the Eagle Village Shopping Center traffic plan be submitted to the planning and zoning commission for their recommendation, such recommendation to be received by the next council meeting at which time the council will act on the recormnendation. Roll call on the motion resulted as follows: AYE: DECKER, PEARMAN NAY: HALEY. Motion carried. Street lighting in Eagle Village Subdivision was discussed. Mayor Deckard told the council that Idaho Power had given a cost breakdown of 7 lights for $54.46 monthly with a one time trenching cost of $41.00. Moved by HALEY and seconded by DECKER to destroy the cash receipts of 1978 that have been audited. Roll call on the motion resulted as follows: AYE: DECKER, HALEY, PEAiLMAN. Motion carried. October 14, 1980 Page 3 Moved by PEARMAN and seconded by HALEY to approve the claims against the city for the month of September. Motion resulted as follows: AYE: DECKER, HALEY, PEARMAN. Motion carried. Moved by HALEY and seconded by PEARMAN to authorize the city clerk to sign the final plat of Eagle Ridge Subdivision. Motion resulted as follows: AYE: DECKER, HALEY, PEARMAN.
